Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-71-92 be received;
2 . THAT the Ministry of Municipal Affairs and the Region of Durham
be advised that the Town of Newcastle has no objection to the
Official Plan Amendment to the County of Victoria Official Plan;
3 . THAT a copy of Report PD-71-92 be forwarded to the Ministry of
Municipal Affairs, the County of Victoria and the Region of
Durham Planning Department.
3 . THAT the interested parties listed in this report and any
delegation be advised of Council's decision.
1. BACKGROUND
1. 1 On June 29, 1992 the Town of Newcastle received a request for
preliminary comments for a proposed amendment to the Victoria
County Official Plan.
1. 2 The proposed Official Plan Amendment would redesignate a 11. 6
hectare (26. 8) parcel of land located in Part 11, Concession 1
Township of Manvers from "Agricultural" to "Industrial', and
"Highway Commercial" to permit the development of a fourteen (14)
lot industrial park containing a maximum of twenty percent (20%)
commercial uses. The development would proceed on private
services subject to approvals from the Ministry of Environment.

1. 3 In response, Staff had noted concerns regarding the intrusion of
industrial/commercial into the Oak Ridges Moraine. Staff had
suggested a number of issues be investigated prior to formulating
a decision on the proposal including a hydrological assessment of
the impact of the proposal, investigation the need for and
feasibility of undertaking special measures to secure sensitive
areas from contamination, secure the aesthetic qualities of the
proposal to ensure the landform is not diminished.
1.4 On January 6, 1992 the Town received notice that the County of
Victoria had submitted the amendment to Ministry of Municipal
Affairs for approval. To shorten the approval process however,
the County of Victoria has circulated the amendment on behalf of
the Ministry and has requested that the Town forward its comments
directly to the Ministry.
2. LOCATION AND SURROUNDING LAND USES
2 . 1 The subject property is located in Part Lot 11, Concession 1,
Township of Manvers. More specifically, east side of Highway 35,
approximately 1. 5 kilometres north of the Town of Newcastle.
2 . 2 The surrounding land uses consist of two existing industrial
uses, a lumber yard and a manufacturer of cement products, both
located on the west side of Highway 35; a large vacant rural land
holdings to the north and a agricultural operation to the east.
Residential uses are located to the south.
Staff have also been advised that there is an application for
proposed industrial uses directly north of the existing
industrial uses.
3. STAFF COMMENTS
3 . 1 Staff recognize the importance of industries locating within
growing municipalities and the difficulties of agricultural land-
based rural communities have in attracting industrial
development. At the same time it must be recognized that rural

industrial development can have a negative impact on the
environment and the agricultural community.
3 . 2 Staff do not anticipate any impacts on the Town of Newcastle and
therefore do not have an objection to the amendment to the County
of Victoria Official Plan.

NOTICE OF ADOPTION OF OFFICIAL PLAN AMENDMENT NO. 55 BY THE
COUNTY OF VICTORIA
TAKE NOTICE that the Council of the Corporation of the County of
Victoria adopted Amendment No. 55 to the Victoria County Official
Plan on the 19th day.of June, 1991, pursuant to Sections 17 and
21 of the Planning Act, S.O. 1983. The Amendment will be
forwarded to the Ministry of Municipal Affairs for approval.
The' Amendment revises Schedule 'A' of the Victoria County
Official Plan to redesignate approximately 11.6 hectares
(28.6 acres) of land constituting part of Lot 11, Concession 1,
Township of Manvers from the Agricultural Designation to the
Industrial Designation. The amendment also incorporates textual
changes by adding a new Section (6.18.8) to the Industrial
Designation policies. The effect of the amendment is to permit
the development of a mixed use industrial park containing
approximately 14 lots for dry type industrial uses and a limited
amount of compatible Highway Commercial development. The land to
be redesignated by this amendment 'is shown on the Key Map as the
'LAND SUBJECT TO PROPOSED AMENDMENT' .
A copy of the Amendment is attached for your information.
If you wish to object to this Amendment, then a notice of request
for referral to the Ontario Municipal Board for a Hearing should
be submitted to the Minister of Municipal Affairs, 10th Floor,
777 Bay Street, Toronto, Ontario M5G 2E5. Along with the
request for referral, you should state in writing your. reasons
for objecting to the Amendment. A copy should also be sent to
the County of Victoria at the address given below. Please quote
Amendment Number 55 to the Victoria County Official Plan and file '
number 16-OP-0036-055 in all correspondence sent.

AMENDMENT NO. 55 TO.THE VICTORIA COUNTY OFFICIAL PLAN
1. PURPOSE
The purpose of this Amendment is to redesignate
approximately 11.6 hectares (28.6 acres) of land
constituting part of Lot 11, Concession 1, Township of
Manvers, to the Industrial Designation.
2. BASIS
This Amendment is based upon an application received to
change the land use designation on the property to allow
for the establishment of an industrial park which will
be occupied by dry industrial uses and a limited number
of compatible Highway Commercial uses.
3. ACTUAL AMENDMENT
3.1 The Victoria County Official Plan, as amended, is
hereby further amended by the addition of the
following. after Section 6.18.7:
116.18.8 On land designated as Industrial on part
of Lot 11, Concession 1, Township of
Manvers; bounded on the west by Highway
35, on the north by the Second Concession
Road and to the easby the Township Road
which was formerly Highway 35, only dry
industrial and commercial uses shall be
permitted. An industrial or commercial
use will be considered to be dry if the
on site sewage disposal facilities are
primarily for the use of employees and no
'industrial liquid wastes, or washing,
cooling or processing water is discharged
into the subsurface sewage disposal
systems. ' In addition to the permitted
industrial uses, up to 20 percent of the
land designated industrial may be used
for the following highway commercial
uses: an auction barn; motor vehicle,
construction equipment or marine sales,
service, and rentals; and wholesale or
retail uses that require a large display
or storage area and carry one line of
non-perishable goods; provided that the
use meets the criteria for a dry
commercial use. SDevelopment of the land
by consent, plan of subdivision or
condominium shall not be approved until
such time as a hydrogeology report has
been submitted which demonstrates to the
satisfaction of the Ministry of the
Environment the capacity of the site to
support private, individual water supply
and sewage disposal systems.1 Zoning of
the subject land shall be placed in a
Holding category to prohibit development
until such time as the required
hydrogeology report has been approved by
the.Ministry of the Environment. "
3.2 Schedule 'A' of the Victoria County Official Plan is
hereby amended by redesignating part of Lot 11,
Concession 1, Township'of Manvers, from the Agricultural
to Industrial designation as shown on Schedule 'A'
attached hereto and forming a part of this amendment as
the "land to be redesignated Industrial".

4. BACKGROUND
4.1 Proposal
The applicant is proposing the creation of an
industrial park which would be comprised of up to
14 lots. The uses intended to be located in the
park would be limited to dry (low water use)
industrial development and a limited amount of dry
highway commercial development. With respect to
the highway commercial component, the draft.
policies limit the commercial component to 20% and
prohibit high water use activities such as hotels,
motels and restaurants.
4.2 Existing and Abutting Land Uses I -°
The property is presently vacant and is comprised
of gently to moderately sloped, cleared fields
which have been previously used for agricultural
purposes. Surrounding land uses consist of two
existing and one proposed industrial property to
the west on the opposite side of Highway 35, a
large vacant rural holding to the north, two
residential lots and a 30.4 hectare (75 acre)
-agricultural property to the east and a residential
lot to the south (see Appendix 'A' - Land Use Map) .
4.3 Servicing
The proposed development is to be serviced by
individual well and subsurface sewage disposal
facilities. With respect to the ability of the
site to support the proposed servicing, the
applicant has submitted a_ prelviminag

that the preliminary data be confirmed by on-site
testing. In terms of the adequacy of the soils for
sewage disposal purposes, the findings of the
report suggest that the soils on-site are somewhat
variable such that individual site assessment will
be necessary for each lot proposed.
The final hydrogeological report will need to be
accepted by the M.O.E. before any subdivision of
the property is permitted and prior to a holding
provision being lifted from any zoning applied to
the property.
4.4 Official Plan Policv
The goal of the Victoria County Official Plan
regarding industrial development is to obtain a
wide industrial base. The objectives of the Plan
in this regard, are to encourage the expansion and
development of. industries and diversification into
special service industries. A further objective of
the plan is to encourage limited service, dry
industrial uses to locate within industrial parks
within the Townships . The proposed development is
consistent with the goal and objectives of the Plan
concerning industrial development.
