Subject EXTENSION OF DRAFT APPROVAL

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report PD-233-92 be received; and
2 . THAT the Region of Durham be advised that the Town of
Newcastle objects to a further extension of draft approval for
Subdivision 18T-81008 .
1. BACKGROUND
1. 1 The subject lands are located in Part Lot 29, Concession 2
former Newcastle Village. The lands are east of Foster Creek
and north of Highway 2 with frontage on the north side of
Given Road. Draft Plan approval was awarded to the subject
lands on March 29, 1983 .
1. 2 The applicants have been granted extension of draft approval
several times by the Ministry of Municipal Affairs and Durham
Region since draft approval first expired March 29, 1986. The
conditions of draft approval have also been amended three
times, most recently on July 27, 1992 . Responsibility for
granting extension of draft approval is now vested with the
Commissioner of Planning for the Region.

Staff were advised by the Region of Durham Planning Department

that drat approval for the above referenced plan would lapse
on January 3 , 1993 pursuant to the Planning Act, unless an
extension was granted prior to the lapsing date.
2 . STAFF COMMENTS
2 . 1 In October of 1988 the owners agent had request an additional
one year extension to the Draft Approval as they suggested
that they had worked diligently in attempting to fulfil
conditions of approval and providing the necessary
documentation for registration, however were unable to satisfy
the November 301 1988 deadline. From staff's perspective,
since that time little or no action has taken place to further
the proposal towards registration, yet draft approval has
continually been extended to accommodate the applicant's
request.
2 . 2 Staff consulted with Community Services and Public Works Staff
prior to the drafting of this report. Community Services
Staff have advised that the parkland as proposed in this
application no longer satisfies the neighbourhood parkland
requirements. The parkland needs for this neighbourhood of
Newcastle Village has been planned for in a more comprehensive
and central location. The proposed park in this proposal
would reduce the Town's ability to provide a larger, central
facility. In addition, this park has not been included in the
lot development charge policy report and therefore is now
considered premature.
2 . 3 Public Works Staff have advised that this development is not
sequential for storm water management operations. As well
concern remains with the operation of the proposed
intersection at Highway 2 .

2 . 4 Staff note that the proposed intersection at Highway 2 ,
although temporary, is not in keeping with the intent of the
Official Plan policies, which permit arterial and collector
roads only to intersect with arterial roads. As well staff
have a concern for the duration of the "temporary" access.
Although the surroundings land are subject to a proposed plan
of subdivision, at this time there are servicing constraints
which prevent the proposal from proceeding.
3 . CONCLUSION
3 . 1 In consideration of the concerns expressed by the Public Works
Department,the dissatisfaction with the proposal by Community
Services Department and the comments contained in the report
Staff are not in a position to support further extension of
draft approval.

Please note that approval issued by the Region with respect to the
above referenced draft plan will lapse on January 3, 1993, pursuant
to The Planning Act, unless an extension is granted prior to the

The Region is now considering the matter of granting an extension
If there is any reason that the extension should not be granted,
please advise me immediately. If we do not hear from you within 30
days, we will assume that your municipality does not have any
objections to said extension.
