Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1.
THAT Report PD -93 -95 be received;
2.
THAT Rezoning Application Dev 95 -042, submitted by Fridel
Ltd
on behalf of Grace Wilson to remove the holding symbol
to
permit the creation of 3 new dwelling lots be APPROVED;
3.
THAT the amending by -law attached hereto be forwarded
to
Council for approval;
4.
THAT a copy of this report and the amending by -law
be
forwarded to the Region of Durham Planning Department;
5.
THAT the amending by -law be circulated in accordance with
regulations made under the Planning Act;
6.
THAT all interested parties listed in this report and
any
delegation be advised of Council's decision.
1. APPLICATION DETAILS
1.1 Applicant: Fridel Ltd
1.2 Owner: Grace Wilson
1.3 Rezoning: from "Holding Urban Residential Type 1 ((H)Rl) to
"Urban Residential Type One (R1)"
1.4 Area: 0.2 hectares
2. LOCATION
2.1 The subject lands are located at 64, 66 and 68 Foxhunt Trail south
of Highway # 2 east of Townline Road, in Part of Lot 35 Concession
2 former Township of Darlington.

3 BACKGROUND
3.1 In June of this year, Staff received an application to amend the
Comprehensive Zoning By -law 84 -63 to remove the "Holding" symbol
from the subject lands. Removal of the Holding symbol will enable
3 separate residential lots to be created.
3.2 Applications have been made to sever these lands creating 3 new
residential lots (LD 140- 142/95). The applications were heard by
the Land Division Committee and approved by the Committee on May
29, 1995. A condition of the land division applications was the
removal of the Holding Symbol.

5 OFFICIAL PLAN POLICIES
5.1 Within our existing Official Plan, the lands are designated
Residential. This application meets the intent of the Official
Plan in that the lands will be developed residentially.
6 ZONING BY -LAW PROVISIONS
6.1 Within the existing Comprehensive Zoning By -law 84 -63, the lands
are zoned "(Holding) Urban Residential Type One [(H)Rl] ". The
purpose of this application is to remove the Holding symbol,
leaving the lands zoned Urban Residential Type One (R1).
7 AGENCY COMMENTS
7.1 In accordance with departmental procedures, the application was
circulated to obtain comments from other departments and agencies.
All agencies circulated have responded stating that they have no
objection to the application to remove the holding symbol.

8 STAFF COMMENTS
8.1 Staff have advised the Public Works Department to lift the 0.3
metre reserve along the subject land's Foxhunt Trail frontage.
8.2 Some of the conditions related to the associated Land Division
Applications have been satisfied. Remove of the Holding Symbol is
one of the last conditions to be satisfied.
9 CONCLUSION
9.1 In that this application complies with the Zoning By -law and
conforms to the Official Plan, Staff recommend that the application
be approved and that the attached by -law be passed.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY -LAW NUMBER 95-
being a By -law to amend By -law 84 -63, the Comprehensive Zoning By -law for the former Town
of Newcastle.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable
to amend By -law 84 -63, as amended, of the former Town of Newcastle to implement rezoning
application DEV 95 -042.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1. Schedule "4" to By -law 84 -63 as amended, is hereby further amended by changing the zone
designation from:
"Holding - Urban Residential Type One ((H)Rl) to "Urban Residential Type One (RI)"
as shown on the attached Schedule "A" hereto.
2. Schedule "A" attached hereto shall form part of this By -law.
3. This By -law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 36 of the Planning Act.
BY -LAW read a first time this day of 1995.
