Report #: PD -56 -95 File #: A95/009, A95/018 & A95/019 By-law # Subject: MONITORING OF THE DECISIONS OF THE COMMITTEE OF ADJUSTMENT FOR THE MEETING OF MAY 25, 1995 FILES: A95/0091 A95/018 & A95/019 Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report PD -56 -95 be received; 2. THAT Council concur with the decisions of the Committee of Adjustment made on May 25, 1995 save and except A95/009; and 3. THAT Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment in the event of an appeal. 1.1 In accordance with Section 45 of the Planning Act R.S.O. 1990, all applications received by the Municipality for minor variance are scheduled to be heard within 30 days of being received by the Secretary Treasurer. The Committee heard three (3) applications at the May 26, 1995 meeting APPROVING all three. 1.2 Details of each application and the Committee of Adjustment decisions are included in the attachments. Application A95/009 was tabled from an earlier meeting to allow the applicant to revise the application. 1.3 A95/009 originally requested a variance from the by -law to permit the construction of an accessory building 109.3 m2 (1176 sq. ft.). Existing accessory structures brought the ...2 X22 REPORT NO.: PD -56 -95 PAGE 2 total floor area of accessory structures to 123 m2 1320 (sq. ft.) or 106% of the total floor area of the house. The By -law permits 40% coverage for all accessory structures. 1.4 The applicant reduced the floor area of the accessory structure to 99 m2 (1064 sq. ft.) for the June 5, 1995 meeting. The Committee of Adjustment approved the revised application, although Staff did not support the application. Given the nature of the variance, the fact no neighbouring land owners have to date spoken in objection to the application and the time and expense of an Ontario Municipal Board appeal, Staff do not recommend appealing the Committee's decision. 1.5 Staff have reviewed the balance of the Committee's decision with respect to the above- referenced applications and are satisfied that they conform to the general intent of the Official Plan and the Zoning By -law. 1.6 Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staff's official status before the Ontario Municipal Board in the event of an appeal of the decision of the Committee of Adjustment.
