Report Subject: A minor variance application to facilitate the construction of an accessory
building containing an Additional Dwelling Unit by increasing the maximum
total lot coverage for all accessory structures from 10% to 14% and
increasing the maximum height from 5.25 metres to 6.7 metres.
Recommendations:
1. That the Report for Minor Variance Application A2022-0027 be received;
2. That all written comments and verbal submissions were considered in the
deliberation of this application;
3. That application A2023-0024, for Minor Variances to Section 3.2.f.ii.c.i) and Section
3.2.f.ii.d) of By-law 2021-082, as amended in Zoning By-law 84-63, to facilitate the
construction of an accessory building containing an Additional Dwelling Unit by
increasing the maximum total lot coverage for all accessory structures from 10% to
14% and increasing the maximum height from 5.25 metres to 6.7 metres be tabled
to address site design issues for a period of no longer than 6 months.
4. That all interested parties listed in this report be forwarded a copy of the
Committee’s decision.

Additional Dwelling Unit by increasing the maximum total lot coverage for all
accessory structures from 10% to 14% and increasing the maximum height from
5.25 metres to 6.7 metres.

2. Background
2.1 The applicant had come in a few times prior to the minor variance application being
formally submitted, to discuss the proposed Additional Dwelling Unit (ADU) in an
accessory structure that the owner was looking to construct on their lot. Planning Staff
have informed the applicant of concerns with the proposed height to the mid-point of
roof.
2.2 On May 15th, 2023, the applicant submitted a minor variance application to request to
increase the maximum total lot coverage for all accessory structures from 10% to 14%
and increasing the maximum height from 5.25 metres to 6.7 metres. There is currently
to existing accessory structures on the lot, and the owner is looking to keep one of the
existing accessory structures once the proposed ADU in an accessory structure is
constructed.
3. Land Characteristics and Surrounding Uses
3.1 The subject site is located near the Southeast side of Second Street at Elgin Street.

3.2 The surrounding uses are all urban residential. The CN railroad is located south of the
subject site.
4. Public Notice and Submissions
4.1 Pursuant to the requirements of the Planning Act, the appropriate signage
acknowledging the application was installed on the subject site. In addition, the
appropriate notice was mailed to each landowner within 60m of the subject site.
4.2 At the time of writing this report, Staff did receive any concerns or objections from any
members of the public.
5. Departmental and Agency Comments
5.1 The Development Engineering Division of the Planning & Infrastructure Services, has
no objection with this application subject to all existing drainage patterns remaining
unaltered by the proposed accessory structure.
5.2 The Building Division of Planning and Infrastructure Services has no objection to the
proposal. A building permit is required for the proposed accessory structure.
5.3 Clarington Emergency and Fire Services Department has no objection.
5.4 Development approvals staff have undertaken research into previous variances for an
accessory building containing an Additional Dwelling Unit and the proposed building
height is the tallest proposed to date. The height of an accessory building containing an
Additional Dwelling Unit is a critical consideration as the building is typically located
closer to a share property line and located in the rear yard of a property. Increased
building height can potentially lead to concerns with overlook and privacy. Staff
recommend the tabling of application A2023-0024 for a period of no longer than 6
months to allow staff and the applicant to further discuss the height of the proposed
building.

6. Conclusion
6.1 Given the above comments, Staff recommend the tabling of application A2023-0024 for
a period of no longer than 6 months to allow staff and the applicant to further discuss
the height of the proposed building.
