DISCLOSURE OF PECUNIARY INTEREST Councillor Mutton indicated that he would be disclosing a pecuniary interest with respect to Report TR-5S-00. Councillor Novak indicated that she would be disclosing a pecuniary interest with respect to the delegation of Linda Gasser and Report PD-090-00. MINUTES Resolution #GPA-394-00 Moved by Councillor Schell, seconded by Councillor Trim THAT the minutes of a regular meeting of the General Purpose and Administration Committee held on September 5, 2000 be approved. "CARRIED" DELEGATIONS (a) Jan Moffat, clo Bowmanville RIA, P.O. Box 365, Bowmanville, LIC 3L1 - Requested that she be given permission to use the Municipality's Coat of Arms in the BIA colouring book which is provided free of charge to various groups for distribution to children. She noted that the request should be granted FORTHWITH. . 301 G.P. & A. Minutes -2 - September 18, 2000 . DELEGATIONS CONT'D (b) Julius DeRuyter, 227 Bridgeland Avenne, Toronto, M6A IY7- expressed support for the recommendations contained in Report PD-OS7-00 and highlighted the changes which have been made to the site plan. The commercial component of the development has been altered from 23,000 square feet to 17,000 square feet. He was present to answer questions from Members of the Committee. (c) Lee Parsons, Malone Given Parsons Ltd., 140 Renfrew Drive, Suite 201, Markham, L3R 6B3 - circulated copies of his presentation which was made with an overhead projector. He advised that Malone Given Parsons was retained by Clarington to examine: a) the market role and function of Newcastle Village; b) identifY existing markets and future market opportunities; c) determine if the proposal will benefit or compromise Newcastle Village's market function; and d) recommend a course of action. His presentation included the following: . Main central area boundary This site - has excellent visibility and accessibility and can be established as an eastern gateway to the main central area Main central area provides a mix of uses in addition to commercial Commercial context - the downtown has a low vacancy rate of 3 .2% Trade area; and Conclusions . . . . . . He noted that there is a market support for the proposed development and other development opportunities in the village. He suggested that a high standard of urban design is recommended at this important gateway. (d) Libby Racansky, 3200 Hancoek Road, Courtice, LIE 2Ml _ circulated a copy of her letter dated September 18, 2000, along with her comments on Report PD-090-00. She requested that Recommendations 1,3,4, 5, and 6 be approved by Council. She suggested that Recommendation 2 and amendment to map A I, A2, C I and G be referred back for comments by the general public. She also suggested that an amendment to Section 14.4.3 (5 metre setback) in the Official Plan is needed for the wetland protection as well as changes to the tree preservation by-law and other by-laws are also required. She noted that, due to the recent information, it would be only fair to designate the lands located outside of subdivisions as provincially significant wetlands. Councillor Novak stated a pecuniary interest with respect to the delegation of Linda Gasser, vacated her chair and refrained from discussion and voting on the subject matter. Councillor Novak lives in close proximity of the subject site. (e) Linda Gasser, 7421 Best Road, Orono, LOB IMO - re: Report PD-090-00 - circulated a copy of her presentation dated September IS, 2000 and made the following points: . . not only should the wetlands within the revised boundaries of the Black Farewell Wetlands Complex be included in the Official Plan Amendments but the wetlands on the Birchdale Site should also be identified as provincially significant wetlands. She suggested that George Reynolds Drive road alignment be revisited as part of the process proposed in Report PD-090-00. G.P. & A. Minutes . DELEGA nONS CONT'D - 3 - September 18, 2000 . Since the Hancock neighbourhood design plan will be re-evaluated, a review should also be undertaken for the Glenview Neighbourhood Plan. Along with the proposed Adelaide Avenue alignment review, all proposed roads in the Glenview Neighbourhood including local roads such as George Reynolds Drive should be a part of a review at the municipal level. CLOCA are compromising their ability to be taken seriously as stewards of public lands by selling off/leasing out, granting easements over some of the very lands that were acquired with public funds, to private interests. She supports public acquisitions of environmentally sensitive lands to ensure that these lands are protected and not sold to make a profit. It is imperative that the municipality bring forward a comprehensive site alteration by-law at the earliest opportunity. This will ensure the protection of Black Farewell Wetland Complex and other sensitive areas in the municipality. . . . (f) Kerry Meydam, 3828 Trulls Road, Courtice, LIE 2L3 - re: Report PD-090-00 - expressed concurrence with the comments made by Libby Racansky and Linda Gasser. She requested more opportunities to review the maps in detail and requested clarification on why the wetlands are not consistently displayed on different maps. Resolution #GPA-39S-00 . "CARRIED" The meeting reconvened at II :OS a.m. (g) Leigh and Sylvie Parker, 9582 Old Highway 35, R.R. #2, Orono, LOB IMO - re: Oak Ridges Trail - advised prior to the meeting that they would not be addressing Members of Committee. (h) Wayne Kennedy, 84 Beaucage Road, Orono, LOB IMO - re: Oak Ridges Trail - was called but was not present (i) Fran Harvey, Consultancy Services, 8801 Mosport Road, Orono, LOB IMO - Oak Ridges Trail - circulated a copy of her presentation and several photos and advised that she is already being harassed by patrons of Mosport Park who trespass, litter, some of whom even have guns. She has been in the process of rehabilitating her property for II years and does not want bikers and polluters on her property. Before the Oak Ridges Trail is allowed to continue, she suggested that further studies of the wetlands, meadows and creeks should be undertaken. Although she is not opposed to the trail, she requested that Council find an alternate route. . 303 G.P. & A. Minutes . DELEGATIONS CONT'D . - 4- September 18, 2000 (j) J. Susan Gonld, 9004 Mosport Road, Orono, LOB IMO - Oak Ridges Trail _ circulated two photographs of her house in close proximity of the Oak Ridges Trail. Advised that she is already living with the nightmares of Mosport who cannot control the number of patrons that they have and, as a result, she has called the police services several times. There are 24 hour parties, security signs have been tom down, hunters, poachers, bikes, trespassers and peeping toms have invaded her property. She questioned why ORTA would have a walking trail so close to a race track. She advised that her public liability insurance rates will increase if this trail is allowed to proceed in its proposed location. She offered to work with ORT A in an attempt to find an alternate route to address the concerns of the affected residents. (k) Roy Forrester, 6 Mill Lane, Orono, LOB IMO - reo Oak Ridges Trail- noted that he has been told by staff of Mosport Park that trespassing is not a problem. He is sure that hikers, will not do any damage to the environment and that trespassing on residents properties will not be a problem. He assured Members of the Committee that ORTA will meet all of the Ganaraska Conservation Authority's requirements. Members ofORTA have reviewed alternate routes but feel that the recommended trail is the only option. (I) Carl Schenk, 190 Chnrch Street, Bowmanville, LIC 3A6 - reo Oak Ridges Trail - circulated a copy of his presentation and advised that he is a resident of Bow manville, belongs to the Oak Ridges Trail Association, is a Ganaraska Forest Member and has served as Director of Valleys 2000 Committee in Clarington. Over the past couple of years he has spent many hours with Roy Forrester evaluating unopened road allowances within the Oak Ridges Moraine as well as established trails within the Ganaraska Forest to determine the best possible route for the Oak Ridges Trail. He reiterated the need for and the importance of the Oak Ridges Trail which is to "support and promote a variety of tourism and recreational and open space opportunities and linkages that are compatible with the character and environmental sensitivity of the country side," The second major issue is accessibility to the Moraine and the need to increase public appreciation and understanding of its historical evolution, its amazing eeo-diversity and its infonnative role in creating excellent ground water reserves and in nourishing our precious streams which are dependant on the permeable soils and transmissive characteristics of the Oak Ridges Moraine. To the land owners who fear that a signed trail will aggravate various problems, he noted that urban dwellers also experience similar problems and concerns associated with the throwaway, socially irresponsible and law breaking segments of our society. (m) Gary Ford, 106 Bruton Street, Port Hope, LIA 3W4 - reo Oak Ridges Trail - expressed support of the recommendations contained in the Addendum to Report WD-32-00 and stated that no problems have been experienced in the Port Hope portion of the trail. (n) Robert Ellison, I Remora Royal Way, Toronto, M2H IL2 - Oak Ridges Trail - advised that he anticipates an average of 20 to 30 organized groups of hikers every three to four months. His experience in the past eight years has indicated that hikers are much more responsible and have great respect for the environment and other people's properties. In his opinion, the whole length of the trail should be in a natural environment, not on public roads. . 304 . . . G.P. & A. Minutes DELEGATIONS CONT'D PUBLIC MEETINGS - S- September 18, 2000 Resolution #GPA-396-00 Moved by Councillor Mutton, seconded by Councillor Schell THAT the Committee recess for lunch for one hour. "CARRIED" The meeting reconvened at I: I 0 p.m. Councillor Novak chaired this portion of the meeting. Pursuant to the Plarming Act, the Council of the Municipality ofClarington, through its General Purpose and Administration Committee, is holding a Public Meeting for the following applications: (a) Rezoning Application - Part Lot 34, Concession 2, Former Township of Darlington - 1276467 Ontario Ltd., Ashton Development (Clarington) Ltd. The Clerk's Department sent public notice for the rezoning application by first class mail on or before August 18,2000 to all property owners within 120 metres of the subject property in accordance with the latest municipal assessment record. In addition, notices were also posted on the site prior to August 18,2000. This notice procedure is in compliance with the Ontario Regulation made under the Planning Act. (a) Report PD-086-00 - 1276467 Ontario Ltd., Ashton Development (Clarington) Ltd.- the purpose and effect ofthe application is to rezone the subject lands from "Environmental Protection (EP) Zone" to "Urban Residential Type One (RI) Zone" to permit the development of ten (10) - IS metre frontage single detached dwelling lots. Ron Weir, 110 Auburn Lane, Courtice, LIE 2E9 - advised that he is speaking on behalf of Mark Williams, Chuck Moore, S. & R. Loeb, Paul Droad, K. & R. Marishita and Diane Trauzzi who also live adjacent to the site. He requested clarification on what percentage of these properties is considered environmentally protected. He and his neighbours have several concerns pertaining to the environment and wildlife habitat. Libby Racansky, 3200 Hancock Road, Courtice, LIE 2MI - circulated a copy ofa memorandum dated January 12, 1996, from the Director of Public Works to Members of Council wherein he stated that if an application for rezoning was received to develop the lands adjacent to Auburn Lane and Farewell Creek, the appropriate agencies in the Municipality ofClarington would evaluate the land for development suitability. She opposes this development because of environmental concerns and she fears that what happened in Whitecliffe will be duplicated in this endeavour. "The public ended up paying for remedial erosion control". She requested clarification as to why wires are already in the ground. 305 G.P. & A. Minutes . - 6- September 18, 2000 PUBLIC MEETING CONT'D. Linda Gasser, 7421 Best Road, Orono, LOB IMO - questioned the safety and the wisdom of building houses on unstable slopes. She suggested that the developer, when taking remediation measures, probably did a lot of damage to these environmentally protected lands. Even though this land is located in the urban area, "EP" should remain "EP". Brian Parsons, 95 Auburn Lane, Courtice, LIE 2E9 - advised that he and Kevin Seagra oppose development of these lots because the area is presently being used as an access point to recreational use. He noted there is a general lack of green space available to the public in this area and that he was under the impression that environmentally protected lands should remain environmentally protected. AlIau Maenza, 103 Auburn Lane, Courtice, LIE 2E9 - concurred with the comments made by the previous speakers and is in opposition to this project. Glen Genge, D.G. Biddle and Association, 76 King Street East, Oshawa, LIB IBS - noted that this development is to complete the Whitecliffe Subdivision. He advised that large single family homes similar to those in the adjacent area will be built if this project is approved. The front portion of these lots is zoned residential and the rear portions are environmentally protected lands. A slope stability study has been done and the bank will be stabilized through the development process. . PLANNING AND DEVELOPMENT DEPARTMENT Proposed Rezoning Applications I2764670nt. Ltd. THAT the proposed by-law attached to Report WD-32-00 (Attachment NO.5 to Addendum to Report WD-32-00) be passed by Council authorizing the use of the unopened/closed road allowances as shown on the maps (Attachments No. I and 2 to Addendum to Report WD-32-00); THAT Roy Forrester (ORTA - Clarington Chapter), the Ganaraska Conservation Authority and the property owners who expressed concern be advised of Council' s decision; and THAT the Townships of Manvers, Scugog and Hope be advised of Council's decision.
