Recommendations: 1. That the Report for Minor Variance A2023-0018 be received. 2. That all written comments and verbal submissions were considered in the deliberation of this application. 3. That application A2023-0018 for minor variances to section 3.1 c. of Zoning By-law 84-63 to facilitate the construction of an accessory building by increasing the maximum total accessory floor area from 90 square metres to 149 square metres and to increase the height from 4.5 metres to 5.9 metres be tabled to allow the applicant to submit a full and complete application; and 4. Application Details 1.1 Owner: N/A 1.2 Agent: Michael Provenzano 1.3 Proposal: Minor variances to section 3.1 c. of Zoning By-law 84-63 to facilitate the construction of an accessory building by increasing the maximum total accessory floor area from 90 square metres to 149 square metres and to increase the height from 4.5 metres to 5.9 metres. 1.4 Area of Lot: 4,128 square metres 1.5 Location: 645 Townline Road North, Darlington 1.6 Legal Description: Part Lot 35, Concession 3, Former township of Darlington 1.7 Zoning: Agricultural (A) 1.8 Clarington Official Plan Designation: Environmental Protection 1.9 Durham Region Official Plan Designation: Major Open Space 1.10 Heritage Status: None Municipality of Clarington Committee of Adjustment A2023-0018 2. Background Page 3 2.1 On March 301h, 2023, a minor variance application was submitted by the prospective owner, however due to an incomplete application form Staff are recommending this application be tabled until the owner of the subject site provides authorization to allow this application to be heard. 3. Land Characteristics and Surrounding Uses 3.1 The subject site is located at 645 Townline Road North, Darlington, which is located on east side of Townline Road, 300 metres south of Pebblestone Road. 3.2 The surrounding uses to the immediate north, south, east, and west are existing rural residential properties. 4. Public Notice and Submissions 4.1 Pursuant to the requirements of the Planning Act, the appropriate signage acknowledging the application was installed on the subject lands. In addition, the public notice was mailed to each landowner within 60m of the subject site. 4.2 At the time of writing this report, Staff have not received any inquiries regarding the proposal. 5. Departmental Comments 5.1 The Development Engineering Division of Planning & Development Services has reviewed the proposal and have the following comments: • The provided plans indicate the proposed accessory structure will be constructed with a gabled roof. A grading plan is required to confirm that drainage from the accessory structure will not impact the neighbouring property to the north. Please indicate the discharge locations for roof water leaders. • The provided grading plan shall also confirm that existing drainage patterns will remain unaltered by the proposed accessory structure. • The provided plans may be subject to additional comments related to grading and servicing at the Building Permit stage. 5.2 The Building Division of Planning and Development Services have no comments related to this proposal. 5.3 Clarington Emergency and Fire Services Department have no concerns with this proposal. Municipality of Clarington Committee of Adjustment A2023-0018 Page 4 5.4 5.5 A permit pursuant to Ontario Regulation 42/06 under the Conservation Authorities Act needs be acquired from CLOCA prior to starting construction. 6. Conclusion 6.1 Staff recommend tabling the application for a minor variance to Section 3.1 c. of Zoning By-law 84-63 to facilitate the construction of a second story loft within an existing accessory structure by increasing the maximum total accessory floor area for the subject site from 90 square metres to 175 square metres.
