RECOMMENDATIONS:
1. RECEIVE FOR INFORMATION

2. REZONING APPLICATION TO PERMIT CONVENIENCE STORE

THAT Report PSD- 019 -04 be received;

4. BROOKHILL NEIGHBOURHOOD DESIGN PLAN
THAT Report PSD- 022 -04 be received;
THAT staff be authorized to prepare a Secondary Plan for Brookhill
Neighbourhood and request proposals from consultants and report back to
Council when considered appropriate;
THAT a new urbanist approach be investigated for the design of the
Brookhill Neighbourhood;
THAT the Brookhill Neighbourhood Secondary Plan Study Area
incorporate all the lands identified on Attachment 1 to Report PSD- 022 -04
including lands designated as Future Urban Residential; and
THAT no additional Neighbourhood Design Planning Studies commence
in 2004.
5. SOUTH COURTICE BUSINESS PARK STUDY

CORRESPONDENCE FOR INFORMATION
I - 1 Ian Macnab, Chief Administrative Officer, Kawaratha Conservation,
providing Council with copies of their 2004 proposed budget. Mr. Macnab
is requesting that Council endorse its full implementation to the Regional
Financial and Administration Committee.

1- 2 P.M. Madill, Regional Clerk, Region of Durham, advising Premier
McGuinty that the Region of Durham on February 11, 2004, passed the
following resolution:
"a) THAT the Provincial Government be requested to proceed
expeditiously with improvements to the Provincial highway
network in Durham Region, including:
i) The extension of Highway 407 to Highway 35/115,
including two high -speed freeway connections to
Highway 401;
The expansion of Highway 401, including the
construction of new and improved interchanges; and
The extension of Highway 404 and the related
widening of Highways 12 and 48;
b) THAT the Provincial Government be requested to take the
following actions in the immediate term to facilitate the timely
implementation of these improvements:
i) Resume and expedite completion of the Highway 407
East extension EA study;
ii) Continue with the implementation of new Highway
401 interchanges at Lake Ridge Road and Stevenson
Road, in accordance with the approved cost sharing
agreement between the Minister of Transportation
and the Region of Durham;
iii) Complete the necessary EA and design studies, and
budget financing, to widen Highway 401 to a 10 -lane
cross - section, from Brock Road to Stevenson Road,
as the first step in the ultimate expansion program;
iv) Review and update the previously completed
Preliminary Design Report for Highway 401 between
Brock Road and Courtice Road, especially as it

relates to the location and configuration of future
interchanges and grade separations;
v) Conduct a study to determine the future configuration
of Highway 401 and its interchanges and grade
separations, from Courtice Road to the east Durham
boundary;
vi) Initiate design for the Highway 404 extension and
Highway 48 expansion; and
vii) Proceed with planned improvements to Highway 7/12
between the north and south junctions of Highway 7;
and
c) THAT copies of Joint Report #2004 -J -6 of the Commissioner
of Planning and the Commissioner of Works be forwarded to
the Honourable Dalton McGuinty, Premier of the Province of
Ontario, the Honourable Harinder Takhar, Minister of
Transportation, the Regional Municipality of York, all
Durham MPP's and area municipalities within Durham."

1 - 5 Greg Martino, Account Manager, Municipal Relations, Municipal Property
Assessment Corporation (MPAC), responding to a citizen group's request
to review the current Assessment Process. Mr. Martino notes that 2003
was the first back -to -back update of assessment values in Ontario's
history. MPAC has set and is working towards achieving performance
standards regarding Assessment Roll Quality. Since the inception of
Current Value Assessment, Assessment Roll Quality following each
reassessment continues to meet or exceed the international standards as
set by International Association of Assessing Officers (IAAO). According
to the IAAO's international standards, the quality of an assessment update
ic rla+arminAri thrnimh the relatinnshin between the assessed value and

the actual sale value of a property which sold in the base year. This is the
assessment -to -ratio or the ASR. The closer the ratio is to 1.00, the more
accurate the assessment. When the ASRs for many properties are
examined, the median ratio can be determined for each property type.
The median of a group of numbers is the middle number after they have
been sorted from lowest to highest. The analysis also determines the
degree of uniformity (Coefficient of Dispersion or COD) of the assessment
update. The COD measures how tightly the ASRs are clustered about the
median. The more uniform the assessments, the lower the COD. A
further indication of the Assessment Roll Quality can be measured through
a review of both Request for Reconsideration (RfR) and Appeal activity
immediately following a reassessment. RfRs and Appeal activity have
declined consistently in Ontario since the inception of CVA in 1998.

1 - 10 Frank Haylow, Director, Fire and Emergency Services, The Municipality of
Port Hope, writing to the Ganaraska Region Conservation Authority
expressing a concern with the lack of location and emergency signs within
the forest area. Due to the massive size of the forest area and the
number of people that use it, firefighters feel that both emergency
response and rescue could be unnecessarily prolonged as locating victims
is extremely difficult without a location. Signage would also assist
emergency personnel if there ever happened to be a forest fire, especially
if outside assistance was required. Fire Officers are requesting that the
Ganaraska Region Conservation Authority include monies in their 2004
budget for location signs within the forest area. If total signage of the
forest is not financially feasible within the current budget year, signage
could be phased in provided that the main intersections are identified as
soon as possible.

1- 11 Linda Laliberte, General Manager /Secretary- Treasurer, Ganaraska Forest
Conservation Authority, responding to Mr. Haylow's letter regarding the
concern with the lack of location and emergency signs within the
rnnnrnckn Fnrpst. Within the Central and East Forest there are location

markers that are referenced on both the new Central and East maps.
There are 30 of these location markers in the Central forest and 33 in the
East Forest.. Staff is currently working on completing the West forest map
in 2004, which will also contain additional location reference markers. The
2004 budget does provide for additional funding for signage in the forest
and the staff at the Ganaraska Forest would be happy to meet with Mr.
Haylow to explain the ongoing Ganaraska Forest signage program and
the work of the Ganaraska Forest Fire Committee.

1 - 13 John Gerretson, Minister of Municipal Affairs, Minister Responsible for
Housing, Minister Responsible for Seniors, writing to Council to affirm the
provincial position on the GST rebate for municipalities. Finance Minister,
Greg Sorbara, has stated quite clearly that the Ontario government has no
intention of clawing back the rebate. The GST funding will help Ontario's
municipalities meet the fiscal challenges they face.

1 - 15 John Gray, Mayor, the Corporation of the City of Oshawa, writing to The
Honourable Dalton McGuinty, advising that the City of Oshawa proclaimed
unanimous endorsement of the University of Ontario Institute of
Technology's (UOIT) request to the Province of Ontario, for full support as
approved by the previous government. UOIT requires worthy investments
in order to complete all necessary development currently underway on
campus. UOIT has had and will continue to have the most significant
impact on Oshawa and the Region of Durham since Colonel Sam
McLaughlin brought General Motors Canada to Oshawa.

round will involve a total of five separate Public Information Centres to be
held at geographically diverse locations across the Region of Durham.

1-25 A.C. Wong, Manager, Environmental Health Division, Region of Durham,
advising Council that the sewage system management agreement with the
Municipality of Clarington is about to expire on Mach 31, 2004. Mr. Wong
advises that they have had great success in administering the OBC -Pt. 8
(sewage system) and would like the opportunity to renew their agreement
for another three years. They are proposing a small change in the user
fee structure to reflect the work performed on behalf of the municipalities.

D - 1 T.G. Gettinby, Deputy Clerk- Administrator, the Township of Brock,
requesting Council's endorsement of a staff report prepared by their
planning consultant, providing comments on the discussion papers
released by the Region of Durham Planning Department with respect to
the Regional Official Plan Review.

D - 2 Ian Macnab, Chief Administrative Officer, Kawartha Conservation,
providing Council with details on the Provincial White Paper on
Watershed -based Source Protection Planning released by the Province on
February 12th, 2004. It is proposed to establish Source Protection
Planning Boards to coordinate and review key functions that will be part of
the source water protection planning process and will be the Board of
Directors of the conservation authority. Each region will have a multi -
stakeholder Source Protection Planning Committee comprised of five
municipal representatives and ten stakeholders. Conservation authorities
have been proposed as the lead agencies for source, water protection of
surface and ground water resource planning. Municipal input and support
for the plan will be an important consideration. Written comments
regarding the white paper may be submitted until April 12th, 2004.

D - 3 Jean - Michel Komarnicki, President, and Richard Toms, Director of
Clarington Visual Arts Centre advising that they will celebrate the 100th
Anniversary of the Cream of Barley Mill in the year 2005. The Mill is home
to the Visual Arts Centre of Clarington. The year 2005 is also the 100th
Anniversary of the Rotary Club. They hope to have a significant fun event
focused on the Mill and would take in other historic sites in the community.
They would appreciate our input and ideas in planning this event.

with the weight of the Blue Boxes. Seniors are suggesting that perhaps
the use of wheels would make them more mobile and the addition of lids

Cross, Region of Durham, requesting Council to declare the month of
March, 2004 as "Red Cross Month" in conjunction with a flag raising
ceremony. When disaster strikes, Red Cross staff and volunteers leap to
action to help those affected.

D - 7 Jo -Anne Cerovich, Area Co- ordinator, Clarington, March Door to Door
Fundraising Campaign, Kidney Foundation of Canada, requesting Council
to declare the month of March, 2004 as "Kidney Health Month" in
conjunction with a flag raising ceremony. Since 1964, the Kidney
Foundation has invested $64 million into research.

D - 8 Sally Barrie, Administrator, Durham Region Community Care, requesting
Council to declare June 3, 4 and 5, 2004 as "Community Care Tag Days ".
The annual event is a key role in the fundraising efforts to assist local
Community Care programs.

D - 9 Connie Vail, RN, BScN., Public Health Nurse, Durham Region Health
Department, requesting Council assistance to aid in the awareness of ATV
safety and declare the week of May 10 to May 16th, 2004 as "ATV Safety
Week ". The campaign will include media information, distribution of
resources in the community and a community event in the Ganaraska
Forest highlight the week. The Durham Region ATV Safety Coalition has
representatives from Durham Region Police Service, Durham Region
Health Department, Durham Region Works Department, Ontario Ministry
of Transportation, Municipality of Clarington, Township of Brock, Township
of Scugog, Ganaraska Region Conservation Authority, Outback ATV Club
and the Perfect Getaway ATV Guided Tours. The goal is to reduce the
number of injuries related to ATV use by promoting safety.

D - 10 Shawn Taylor, R.P. Bio., President, Westside Marsh Reconfiguration
Project, requesting a further extension until April 15, 2004, to their Noise
By -Law Exemption, to ensure sufficient time to complete the work before
the spring breakup. The initial extension was granted in a letter dated
December 22, 2003, to provide permission to conduct 24 hour dredging
operations until March 1, 2004. The dredging sub - contractor was unable
to complete the work, by March 1, 2004, due to severe cold weather and
ice formation in January and February.

D - 11 The Corporation of the Town of North Perth advising Council that the
Town of North Perth on February 2, 2004, passed the following resolution:
"WHEREAS the Provincial Government has recognized our water
resources as "precious" and "vital ";
AND WHEREAS Environment Canada further recognizes that
"financing by municipal governments for the treatment of water
supplies and wastewater is becoming increasingly constrained ";
AND WHEREAS Environment Canada has stated that "metered
households generally show reductions in water usage ", and that
"water conservation can generate significant environmental
benefits ";
AND WHEREAS the United States Environmental Protection
Agency, under its Guidelines for Water Conservation Plans lists
Universal Metering as a Level 1, or minimum measure for water
conservation;
NOW THEREFORE BE IT RESOLVED that the Council of the
Town of North Perth requests the Government of Canada invest in
a plan to help fund universal metering programs for small
municipalities;

AND FURTHER that the Province of Ontario invest in a similar
plan;
AND FURTHER that the funding to follow the traditional one third
being paid by each level of government;

assistance pertaining to the Rick Hansen Wheels In Motion event as
follows:
• Recruiting more participants and teams of participants; if every
Member of Council and the Accessibility Advisory Committee
committed to recruiting 10 participants, this would be a solid base
and extremely beneficial to the success of their event;
• Involvement of Mayor Mutton as the Honorary Chair of the event on
Sunday, June 13, 2004; and
• Provide access to distribution channels /communication to recruit
municipal employees and the community -at -large to the event.

Region of Durham on February 11, 2004, passed the following resolution:
"a) THAT the draft by -law, Attachment 1 to Report #2004 -RTIC-
1 of the Commissioner of Planning, providing for the transfer
of the lower -tier power relating to public transportation
systems, other than highways (transit) to the Region, be
presented to Council for enactment; and
b) THAT the by -law, if enacted, be forwarded to the Council of
the lower -tier municipalities requesting resolutions
consenting to the by -law, and further, that their responses be
received on or before March 24, 2004."

advising Council that Loyalist Township on February 9, 2004, passed the
following resolution:
"WHEREAS the Minister of Finance and the Minister of Municipal
Affairs jointly issued a letter dated December 22, 2003, to the
Municipal Treasurers;

AND WHEREAS the above letter stated as follows: "municipalities
are asked to recognize that the government cannot commit in
advance to a Fall 2004 reconciliation ";
AND WHEREAS that statement generates a significant degree of
uncertainty for both the 2003 and 2004 fiscal year where actual
costs incurred have in the past been funded by a year end
reconciliation;
AND WHEREAS the project shortfall resulting from the above
statement for the 2003 and 2004 years combined, if the CRF
allocation remains at its current level, is 7% of the 2003 tax levy;
AND WHEREAS the Reeve of the Municipality has already issued
a letter in response to the Deputy Minister of Finance expressing
Council's concern;
NOW THEREFORE BE IT RESOLVED that the Council of the
Corporation of Loyalist Township request support from other
municipalities on this same matter."

advising Council that the Township of Ramara, passed the following
resolution:
"THAT Council ask the Liberal Provincial Government to retain all
Power Generation in public ownership, so that the residents of
Ontario can have power at cost and a reliable system; and
THAT this resolution be circulated through AMO."

D - 16 Brian Knott, City Solicitor /Clerk, City of Sarnia, advising Council that the
City of Sarnia on Janaury 26, 2004, passed the following resolution:
"THAT Sarnia City Council supports the efforts being made by the
Mayors of some of the larger Canadian cities to realize full
municipal rebates of the GST, and a 5 cent per litre share of the
Federal Gas Tax; and
THAT a similar position be adopted by other municipalities with
respect to PST; and
THAT the City of Sarnia believes that a percentage of the revenues
realized by the 8 percent PST, and 7 percent GST, imposed on
goods and /or services in the various municipalities within the
Province of Ontario, and collected and remitted by the
organizations and businesses within said Province, be negotiated
between representatives of all governments, and that the agreed
upon figure be remitted by the organizations and businesses

directly to the municipality based upon the time schedules now
implemented; and
THAT this motion be forwarded to the usual municipalities, to AMO,
to our local MP and MPP, and to the Mayor of Toronto."

D - 17 Victoria Leskie, County Clerk, County of Prince Edward, advising that the
County of Prince Edward passed the following Resolution and request
endorsement:
"WHEREAS Regulation 390/03 was filed on October 30, 2003
exempting "omitted assessments" for trailers for the 2001 and 2002
taxation years but not for the 2003 taxation year; and
WHEREAS not all campgrounds have been re- assessed for 2003
and thus not all campgrounds are being treated the same; and
WHEREAS notice of "omitted assessment" were not issued until
November 2003, after the trailer owners have paid their fees for
2003 and returned to their permanent residence;
THEREFORE BE IT RESOLVED THAT the Corporation of the
County of Prince Edward hereby requests the Minister of Revenue
to pass a regulation to exempt the "omitted assessment" for trailers
for the 2003 taxation year; and
THAT this resolution be sent to the Association of Municipalities of
Ontario, MPAC, and all Ontario municipalities for endorsement and
support."

D - 18 Denise Labelle - Gelinas, City Clerk, Corporation of the City of Cornwall,
requesting Council endorse a recommendation from a meeting on
February 9, 2004, made by the City Transportation Engineering to
regulate wheelchairs operation upon City highways including sidewalks.
The proposed by -law amendment to the Traffic & Parking By -law 069-
1989 would improve the safe operation of wheelchairs. However, in the
City's solicitor opinion this would increase the City's liability.
