MOTION
NOTICE OF MOTION
Moved by Councillor Robinson, seconded by Councillor Rowe
WHEREAS the Ministry of the Environment issues Certificates of Approval for
Organic Soil Conditioning Sites provided the applicants meet the conditions
required by the Environmental Protection Act and Ontario Regulation 347;
AND WHEREAS Certificates of Approval have been issued for various sites
throughout the Municipality of Clarington without municipal consultation;
AND WHEREAS the spreading of sewage biosolids has caused concern with
residents of the municipality in regard to the possible effects on wetlands and
groundwater sources;
NOW THEREFORE BE IT RESOLVED THAT the Ministry of the Environment be
requested to suspend all current Certificates of Approval and withhold granting of
any future certificates on lands located within the Municipality of Clarington.

1 - 6 Len Crispino, Ontario Chamber of Commerce, commending Council on
their efforts in pursuing Canada's bid for the Iter project in Clarington. Mr.
Crispino knows that the quality and amount of work that has gone into this
bid will be a sound base for success. They share in the conviction with
which Clarington has pursued this bid. The economic impact arising from
a successful bid is enormous, not just for the community but for Ontario
and Canada as well.

1 - 14 Robert Kyle, Commissioner and Medical Officer of Health, Region of
Durham, advising Council that the week of October 21 - 27, 2002, has
been organized by the National Quality Institute in conjunction with lead
sponsors focusing on Healthy Leadership. The week is designed to
expose Canada's corporate leaders to think strategically about
organizational and employee health strategies that protect and enhance
the health and well -being of their employees while enhancing the
economic health of their organizations.

1 - 15 Andy Mitchell, Secretary of State (Rural Develop ment)(FederaI Economic
Development Initiative for Northern Ontario), advising that the Government
of Canada has been very pleased to partner with the Province of Ontario
and local governments through the Canada - Ontario Infrastructure
Program. Working together, to date 300 projects across Ontario have
been approved and announced, representing a federal investment of over
$440 million and total project costs of over $1.9 billion. On September 30,
the Government of Canada's Speech from the Throne acknowledged the
success of programs such as the Canada - Ontario Infrastructure Program
by a signaling a long -term federal commitment to infrastructure: Working
with provinces and municipalities, the government will put in place a ten -
year program for infrastructure to accommodate long -term strategic
initiatives essential to competitiveness and sustainable growth.

With the extraordinary and positive response to the Canada - Ontario
Infrastructure Program, all federal funds available under the program have
been earmarked for eligible projects nominated by the Province of Ontario.
Since earlier this summer, the Government of Canada has closed the
window for project nominations and will only consider new projects for
which nominations have been previously agreed to by both Canada and
Ontario.

1- 17 Agricultural Groups Concerned about Resources and the Environment
(AGCare), providing Council with copies of fact sheets related to the
agricultural use of pesticides. AGCare is a coalition representing 45,000
Ontario field crop and horticultural producers on key issues such as crop
biotechnology, pesticides and nutrient management.

1 - 18 Rick Johnson, Chair, Regional Works Committee, Region of Durham,
writing to Hydro One regarding the power supply service and ESA
approval, traffic signal control devices. Since deregulation of the Ontario
electricity market, the supply of power to a number of new traffic control
signals and delays in the submission of the ESA inspection approval
certificate have resulted in serious motor vehicle collisions, well after
associated road improvements and the installation of the traffic signal
control plant have been completed by Regional forces. The Works
Committee is requesting that Hydro One and the Electrical Safety
Authority (ESA) review their respective permit and work order process, to
ensure the timely approval and the supply of power to new traffic control
devices in the Region of Durham.

1 - 19 Bruce Taylor, City Clerk, City of Pickering, writing to the Federal Electoral
Boundaries Commission of Ontario, advising that the City of Pickering on
September 17, 2002, considered the proposed electoral boundaries
restructuring within the Regional Municipality of Durham. Pickering
Council stated that the proposed Pickering- Durham riding is unacceptable
because it will divide the City's urban population and half of that
population will be added to that of three rural townships. The urban
interests of the Pickering population are very different from those of the
three rural townships. City Council has requested that the Commission
give consideration to a Federal riding that would include only the City of
Pickering.

1 - 21 M. de Rond, Clerk, Town of Ajax, advising Council that the Town of Ajax,
on October 15, 2002, passed the following resolution:
1. THAT the Council of the Town of Ajax approves a Regional
Smoking By -law, provided it is in the form of the draft By -law
appended to the Region of Durham "Regional Smoking
By -law Report ";
2. THAT it be recommended that a Regional Smoking By -law
include a provision to allow bars to also establish a
designated smoking room, no greater in size than 50% of the
occupiable public space of the premises;
3. THAT the Region review existing smoking regulations in
other Ontario racetracks, casinos and gaming
establishments, particularly the Blue Heron Casino and the
Woodbine and Mohawk Race Track/Slots, and consider
including similar standards for such facilities in a Regional
Smoking By -law."

1-22 Diane Holgate, General Manager, Ontario Central - Network Provisioning,
Bell Canada, advising Council that Bell Canada, Ontario Central- Network
Provisioning is pleased to release draft Telecommunications Community
Design Guidelines for the Greater Toronto Area. The draft guidelines
address a wide variety of planning policies across the GTA municipalities
regarding long term telecommunication network facilities planning and
siting, timing of access to a common trench, and coordinated facilities
design among utility partners. During the fall 2002, Bell will be
undertaking a comprehensive Outreach Program. The objectives of the
Program are to:
• Make presentations /workshop meetings pertinent to the content of
the Guidelines;
Obtain feedback from participants identified on the distribution list
and others as the participants deem appropriate;
Prepare a survey outlining the feedback from participants; and
Prepare a final document that the GTA municipalities and Bell can
implement fully.

Summary of Correspondence - 5 - October 28, 2002
1-23 Regional Municipality of Durham, advising Council that there are no health
concerns with respect to water quality in Durham Region's municipal water
supplies. The water in all municipalities and communities was, and
continues to be, safe to drink. Charges by the Ministry of the Environment
are based on reporting obligations imposed upon municipalities as part of
the regulations implemented by the Ontario government in August of
2000.

1-24 Sandra Kranc, City Clerk, City of Oshawa, writing to the Commissioner
and Medical Officer of Health, Region of Durham, advising that the City of
Oshawa on October 16, 2002, passed the following resolution:
1. THAT correspondence dated September 9, 2002, from Carol
Smitton, Committee Secretary, Region of Durham Health
and Social Services Committee, requesting City Council's
response with respect to the granting of a Region -wide
by -law regulating smoking of tobacco in public places and
workplaces be received for information;
2. THAT Oshawa City Council endorse the implementation of a
Regional No- Smoking By -law;
3. THAT it be recommended that a Regional Smoking By -law
include a provision to allow bars to also establish a
designated smoking room, no greater in size than 50% of the
occupiable public space of the premises;
4. THAT it be recommended that Section 1 (f)(iv) of the draft
by -law concerning the definition of 'designated smoking
room' be amended and redefined so as to include the
common area of the building or structure in the allotted non-
smoking area;
5. THAT it be recommended that the ventilation system
identified by the Pub and Bar Coalition of Ontario be
investigated."

1-28 John O'Toole, MPP, Durham, writing to the Honourable Tim Hudak,
Minister of Consumer and Business Services, forwarding a copy of a letter
from the Municipality of Clarington regarding matters relating to the
approval of a LCBO Agency Store in Hampton. Mr. O'Toole points out
that the Council resolution asks the Alcohol and Gaming Commission to
advise the Municipality directly when any future applications for storefront
LCBO operations are received.

1-29 Lakeridge Health Bowmanville, inviting participation in a Dialogue with
Lakeridge Health. In an open and informal setting we will have the
opportunity to express opinions and exchange ideas to help shape the
future of health care delivery in Clarington and across the region. The

Summary of Correspondence - 7 - October 28, 2002
1 - 31 Dennie Radcliffe, expressing appreciation for the prompt service received
when she made a request at the beginning of September. While walking
one morning, an elderly man who lives on Baldwin Street in Newcastle
caught the toe of his shoe on an elevation on the sidewalk and fell. Much
to her appreciation, two young men driving by spotted them and came to
the rescue. Ms. Radcliffe reported the incident to clerical staff and
suggested that sidewalk repairs would be appreciated in two trouble spots
along the main street of the village. The repairs have been completed.
She is most happy with the swift action of staff and wish to extend thanks
from herself and her neighbours in the village.

1-32 Marg Zwart, Treasurer, 2002 Great Canadian Town Band Festival,
providing Council with the outstanding balance on the loan they received
from the Municipality. As of September 12, 2002, the Great Canadian
Town Band Festival is separately incorporated and independent of the
Clarington Concert Band. They gratefully acknowledge that the festival
would not have continued without the Municipality's generous support.

1-33 Walter Gibson, The Terry Fox Run for Cancer Research, thanking Council
and staff for the assistance given to the organizing committee regarding
this year's Terry Fox Run. Mr. Grant Ashton and the staff at Operations
were especially helpful setting up the park with picnic tables, pylons and
the stage. On the day of the run, staff was invaluable preparing the route
for their participants. They received great compliments on the tour setup
and organization of the site.

1-34 Transport Canada, announcing the membership of the Green Space
Stewardship Advisory Committee. This committee will be tasked with the
development of a vision for the federally owned Green Space Lands. The
Committee will also assist in the development of the Green Space Master
Plan for the long -term protection of the federally owned portion of the Oak
Ridges Moraine and areas around the Rouge Park as Green Space in
perpetuity. The Green Space Strategy has three components:
Protection through continued federal ownership;
Guiding Principles under which the lands would be managed and
protected in perpetuity; and
Creation of a Stewardship Advisory Committee composed of
external land management entities and led by Transport Canada
with a mandate over the following twelve months to develop a
Master Plan embracing the Guiding Principles.

1-35 Federation of Canadian Municipalities, advising Council that the
Newfoundland and Labrador Federation of Municipalities, the City of
Mount Pearl and the Town of Paradise have won a major legal victory
over Sprint Canada Inc. on the issue of municipal government authority to
levy taxes on the gross revenues of telecommunications carriers.

1-36 Federation of Canadian Municipalities (FCM), advising Council that FCM
is encouraged by the federal government's initial commitment to assist
communities hit hard by the softwood lumber trade dispute, but more is
needed. That is the message FCM will be taking to the Government of
Canada as it continues its push for meaningful community and sector
adjustment measures.

1-37 Steve Blight, Program Manager and Rob James, Operations Manager,
Pilot Emission Removals, Reductions and Learning Initiative ( PERRL),
advising Council that PERRL is a new federal initiative which is part of
Canada's Action Plan 2000, the federal government's action plan to
combat climate change. It is designed to provide Canadian companies,
organizations and even individuals with an economic incentive to take
immediate action to reduce greenhouse gas emissions. Through PERRL,
the federal government plans to buy the rights to verified greenhouse gas
emission reductions from eligible projects, each on a fixed price per tonne
basis. PERRL is now accepting bids for GHG removals and reductions
from two types of new projects: landfill gas capture and combustion, and
CO2 capture and geological storage. Project proposals and bids will be
accepted until December 12, 2002.

CORRESPONDENCE FOR DIRECTION
D - 1 Dwight and Karen Short, advising Council that the crosswalk on Trulls
Road and Nash Road in Courtice is busy before and after school. About a
year or two ago there was an extra lane made for parking, or dropping off
children at school and they believe that it solved a couple of problems, but
not all of them. Mr. and Mrs. Short suggest either installing traffic lights or
widening the roads.

D - 2 Gerald Dafoe, Chief Executive Officer, Canadian Public Health
Association, requesting Council to proclaim November 24 to
December 1, 2002, as the Canadian HIV /AIDS Awareness Week and to
proclaim December 1 as World AIDS Day. Canadian HIV /AIDS
Awareness Week is a unique occasion when we can identify and examine
the health, social, political, legal and economic realities of HIV /AIDS. The
Canadian public needs to know that HIV /AIDS is still a crisis.
Summary of Correspondence - 9 - October 28, 2002
By involving communities in AIDS awareness efforts and informing them
of the disease's ongoing complexity within Canada, the groundwork is laid
for new and better HIV prevention programs and foster understanding and
support for people living with and affected by HIV /AIDS.

D - 3 Sid Ryan, President, CUPE Ontario, requesting Council to proclaim
October 30, 2002, as "Child Care Worker Appreciation Day ", a recognition
day for the many people who work providing care to children in the
Clarington community. Many of these workers (usually women) work for
low wages and little recognition for the important work they do. They
provide us with care for our children - an essential service.

D - 4 Suzanne McCrimmon, Economic Development Manager, Clarington
Board of Trade, requesting a joint partnership in the Business Retention
and Expansion project. Business Retention and Expansion (BR &E) is an
action - oriented and community -based approach to business and
economic development. It promotes job growth by helping communities
learn about issues and concerns of, as well as opportunities for, local
businesses and set priorities for projects to address these needs.
Ultimately, communities will have greater success in attracting new
business if existing businesses are content with local economic conditions
and community support.

D - 5 Julie Siciliano, requesting Council to erect lights at the park directly
opposite her house on Varcoe Road, for security reasons. This park
contains a baseball diamond, a large open field and two small parkettes.
It has been a late night meeting place for groups of people (often
teenagers and young adults) to drink liquor, smoke /ingest drugs and light
fires in public garbage cans. The fact that the park is unlit at night makes
it a perfect spot for these individuals to engage in these illegal activities,
The Durham Regional Police are aware of these activities and
occasionally drive through the park at night or fly overhead by helicopter
as an attempt to enforce security and order. As a local resident, she is
concerned that these kinds of activities are taking place in such close
proximity to where she lives. It is unsafe for her or her teenage children to
walk through the park at night and she feels insecure going to sleep at
night knowing there are intoxicated teenagers across the street.

D - 6 W. Kay Lycett on behalf of Wade Puk, requesting Council to legally close
a portion of Maynard Road that is not presently maintained by the
Municipality. Mr. Puk resides at 7437 Maynard Road, Orono, which is a
residential property fronting on the east side of a portion of Maynard Road
which is not presently being maintain by the Municipality as a public road.

D - 7 Daniel Millette, requesting Council to build a permanent skateboard park
in Courtice. Mr. Millette is a 15 year old who loves to skateboard but he
would be more interested in skateboarding if he had more designated
areas. He is aware that there is a skateboard park in Bowmanville and
that there is a mobile one but it would be a lot easier to have a skateboard
park in Courtice. Some people think that they are up to no good, that is
not true, some people ruin it for others. Another solution could be to pave
a flat parking lot with wooden ramps bolted down or perhaps some
concrete ramps, curbs and other things they could use.

D - 8 Janet Lange, Humane Society of Durham Region, requesting Council for
financial support. Ms. Lange is a volunteer with the Humane Society of
Durham Region. The facility that the Humane Society uses is in need of
repair. The building does not have a proper ventilation system, and the
lighting system is disgraceful in most areas. At night most of the animals
are left in the dark because the night lights do not work. There is also not
enough space for all the animals and, on average, they have to turn away
2 - 3 dogs per week. Recently the wagon they use to transport donated
food and any large abandoned or abused animals to the shelter had
broken down for good. They cannot afford to fix it. They are in need of
desperate help financially, not just to make the place look good but to
keep it running up to par and to keep the cycle of adoption and awareness
going.

D - 9 Local Spiritual Assembly of the Baha'is of Clarington, requesting Council
to proclaim the week of November 6 to 13, 2002, as Unity in Diversity
Week. This proclamation has been supported by the Baha'is of Clarington
for the past nine years and has had the Council's approval before. They
are also requesting approval to hang a banner. The activities that are
celebrating this event is a source of promoting the Oneness of Humanity
as well as eradication of prejudice.

D - 10 Allan Gotlieb, Chairman, Ontario Heritage Foundation, inviting Council to
participate in the Ontario Heritage Foundation's Young Heritage Leaders
Program 2002. Now in its third year, this London Life - sponsored program
provides opportunity to recognize young people, 18 years old and under,
who have made significant contributions to community heritage
preservation. The nomination deadline is Monday, December 16, 2002.

D - 11 Evelyn Rozario, President, Orono BIA, requesting Council to provide the
Orono BIA with an interest free loan of $3,500.00 to be paid back over the
next five years. The Orono BIA is currently in the process of having their
Christmas Wreaths for the main street refurbished. They have been using
these light fixtures for the last 12 - 15 years and they need to be reworked.
The work has been quoted at $5,000.00.

D - 12 Alderman John Schmal, President, Federation of Canadian Municipalities,
requesting Council to endorse the following resolution:
"WHEREAS a high quality of life depends on healthy and
sustainable communities;
WHEREAS air pollution threatens quality of life;
WHEREAS exposure to today's concentrations of fine particulate
matter, a major component of smog, increases the risk of
premature death, asthma attacks, breathing difficulty, lung cancer
and heart attacks;
WHEREAS thousands of Canadians die prematurely each year
from air pollution;
WHEREAS health costs from air pollution reach $1 billion dollars
annually in Ontario alone, according to the Ontario Medial
Association;
WHEREAS Canadians need to be fully informed on the state of the
air they breathe;
WHEREAS Canadians need to better understand options for
cutting air pollution;
WHEREAS it is known that the pollution causing smog can
contribute to climate change, and that taking action on clean air will
also help protect the climate;

provincial /territorial governments to develop and implement

BE IT RESOLVED THAT the Municipality of Clarington call on the
Government of Canada to accelerate the delivery of its Clean Air
Agenda and specifically focus on the need to develop and
implement a comprehensive Clean Air Action Plan that will:
Advance scientific understanding of the link between air
pollution and health;,
Provide financial resources to municipal governments for
programs that cut smog and climate pollution;
Ensure Canadians have access to accurate information on
the quality of their air and on action they can take to reduce
their exposure and their emissions;
Ensure significant emission reductions for the transportation
sector; and
• Partner with provincial /territorial governments to encourage
stronger pollution reduction standards for industry and the
electric power generation sector; and
BE IT FURTHER RESOLVED THAT this resolution be
communicated to our Member of Parliament, federal environment,
health and finance ministers, provincial finance, health,
environment and energy ministers, federal and provincial opposition
leaders, community media and the Federation of Canadian
Municipalities.

D - 13 Bruce Taylor, City Clerk, City of Pickering, advising Council that the City of
Pickering on October 7, 2002, passed the following resolution:
"WHEREAS Community Justice Alternatives of Durham Region has
provided victim support through the Victim Offender Reconciliation
Program (VORP) to Durham Region for 20 years; and
WHEREAS VORP is a non - profit organization that has established
community partnerships with some 200 agencies and 85
volunteers; and

WHEREAS the goal of VORP is to provide support to victims of
crime and greater accountability for offenders who have impacted
the lives of victims; and
WHEREAS in 2001, Community Justice Alternatives provided
support to 797 victims of crime; and
WHEREAS the Agency is funded by the Provincial Ministry of
Public Safety and Security; and
WHEREAS on June 11, 2002, Community Justice Alternatives was
advised of 70% cut in funding from $54,000 to $16,000; and
WHEREAS such a cut will place in crisis the ability to continue
services to victims in Durham Region;
NOW THEREFORE the Council of the Corporation of the City of
Pickering hereby requests that the Minister of Public Safety and
Security reinstate funding to Community Justice Alternatives of
Durham Region to the 2001 level; and
FURTHER THAT copies of this resolution be forwarded to all
Durham municipalities for their endorsement and to the Durham
Regional Health and Social Services Committee; and
FURTHER THAT a copy of this resolution be forwarded to the
Honourable Janet Ecker, Minister of Finance and all Durham
MPP's."

D - 14 Hazel McCallion, Mayor, City of Mississauga, advising Council that the
City of Mississauga is greatly concerned about the amount of litter that is
accumulating in communities, along sidewalks and roadsides, at
interchanges, in plaza parking lots, around construction sites and next to
schools. Ms. McCallion is requesting Council to appoint an anti - litter
ambassador to represent Clarington in an anti - litter public awareness

D - 15 Mayor, Town of St. Marys, advising Council that the Town of St. Marys
passed the following resolution:
"WHEREAS the Ontario Energy Board has consented to allow
Union Gas to charge a retroactive fee, which will cost the average
residential gas customer $120.00 and totals approximately $150
million, to recover additional system operation costs that occurred
during the winter of 2000/2001;

AND WHEREAS this retroactive charge will affect all customers
who receive Union Gas, including municipalities and their
taxpayers;
NOW THEREFORE BE IT RESOLVED THAT the Separated Town
of St. Marys asks that the provincial government issue a policy
directive under Section 27.1 of the Ontario Energy Board Act
disallowing the retroactive rate hike granted to Union Gas in order
to protect consumers and taxpayers;
AND FURTHER THAT copies of this motion be circulated to all
Ontario municipalities through the AMO asking for letters of support
and asking that they pass similar motions calling for action by the
provincial government against this unfair charge."

new and restrictive standards regarding their personal fuel holding
tanks, fuel tank stands, fuel lines, furnaces and chimneys;
AND WHEREAS the government enacted these rules without
public or private consultation;
AND WHEREAS this municipality feels that this legislation is unjust,
and will cause undue stress, hardship and cost;

Program services region wide; and
THAT the Region, in co- operation with the local Municipalities, apply for
funding to support O.V.E.R.T. and the Canadian Red Cross in providing
