NOTICE OF MOTION
Moved by Councillor Pingle, seconded by Councillor Schell
WHEREAS Council, at their meeting held on January 15, 2001, passed the
following resolution:
"THAT Report PD- 114 -00 be received for information;
THAT subject to Mr. Joe Domitrovic entering into a legal agreement with
the Municipality of Clarington to cover all legal and planning consulting
costs, the Counsel of the Municipality of Clarington attend at the upcoming
OMB hearing with respect to 3872 Courtice Road, mainly
Joe Domitrovic; and
THAT the Counsel be instructed to call an outside planning consultant to
defend Council's position in respect to this application, FORTHWITH."
AND WHEREAS the Municipality of Clarington is now not going to be
represented at the upcoming Ontario Municipal Board hearing with respect to this
and other related matters;
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE
MUNICIPALITY OF CLARINGTON THAT the portion of Resolution #C- 024 -01
respecting the payment of the Municipality's legal fees be rescinded.

1 - 3 Sandra Kranc, Acting City Clerk, City of Oshawa, advising Council that the
City of Oshawa on September 10, 2001, passed the following resolution:
1. THAT the City of Oshawa advise the Province that the
proposed Bill 90 - Waste Diversion Act should be
strengthened in the following areas:
• Consider greater or full funding by the industry of the
net operating costs of municipal recycling programs.
• Consider the issue of provincial funding for municipal
organic waste diversion programs.
• Consider greater representation of municipalities to
ensure that the Board will give fair consideration of
the interests of both sides.
• Consider and clarify the role of the WDO in terms of
governance reform particularly in the 905 area.
2. THAT a copy of Report OS -01 -354 dated August 27, 2001,
from the Acting Commissioner, Department of Operational
Services be forwarded to the Clerk of the Standing
Committee on General Government at Queen's Park, the
Toronto Environmental Alliance, the Region of Durham, the
AMRC, the Municipal Waste Integration Network (MWIN),
AMO, the City's Members of Provincial Parliament and other
lower -tier municipalities in the Region of Durham.

"THAT the Ministry of the Environment be advised of the City's
interest in participating in a groundwater study in partnership with
Central Lake Ontario Conservation, the Region of Durham and
adjacent area municipalities."

1 - 6 John Burrett, Acting Director, Economic and Social Policy, Federation of
Canadian Municipalities (FCM), inviting Council to submit resolutions on
subjects of national municipal interest for debate at the December 5 - 8
meeting of the National Board of Directors in Dawson City, Yukon. FCM
will take a stand only on issues that are clearly of national municipal
interest and which fall within the jurisdiction of the federal government.
Indirect municipal issues and local /regional issues will not be supported by
major research and lobbying activity, unless otherwise directed by
delegates at the Annual Conference or by FCM's National Board of
Directions. Submissions must be received no later than midnight on
October 17, 2001.

-7 John R. O'Toole, MPP, Durham, providing Council with information
regarding the 2001 -2002 grant applications for the Ministry of the Solicitor
General's Partners Against Crime initiative. Funds are being made
available this year to assist projects that will focus on reducing the
opportunity for crimes to be committed. Neighbourhood Watch programs
are but one example of a program that achieves this goal. The deadline
for applications is October 12, 2001.

1 - 8 Alexander McLean, writing to Jean Monty, Chairman /General Manager,
Bell Canada Ltd., regarding Claim #56 -6 -512 against Bell Canada. Mr.
McLean states that there is an obvious lack of response from Mr. Monty
and Bell organization regarding this claim. It is Mr. McLean's intention to
refer this case to claims court and put on the table the complete details
contained in his `Bell File', being any and all correspondence between
himself and Bell Canada to substantiate his claim. He seeks
honesty /fairness and integrity from those companies who serve the
communities, as a whole, and does not expect exploitation, as has been
demonstrated by Bell Canada Ltd. /Contractors, with regards to his
property.

1 - 9 George E. Gouldburn, expressing his objections to the Clarington Official
Plan Application Amendment for the Courtice Highway #2 /Main Central
Area Secondary Plan. The concern of the residential property owners
along the section from Maplefield Road (proposed) and Courtice Road do
not appear to lend any weight to the proposed planning process. Mr.
Gouldburn was a member of the Study group and many times voiced his
objections to the proposed designations being submitted by the planners
in regard to this area.

The designation of Medium Density Residential, if subject to the entire
area might work but the splitting of the 7 lots to allow detached homes
along Avondale Drive has effectively devalued their property by at least
40 %. Mr. Gouldburn wishes to personally appeal to Council and the
Planning Department to remove the split lot proposal on these 7 lots and
make the designation of this entire area Mixed Use. 'Develop a list of uses
that can be developed on these lots that would be more in keeping with
the proposed Courtice Downtown Development.

1 - 10 John R. O'Toole, MPP, Durham, advising Council that it was a pleasure to
attend the September 4, 2001, meeting to hear first -hand some of the
issues the municipality is facing. It was especially useful to learn of
Council's suggestions regarding an Oak Ridges Moraine meeting for
Clarington. Mr. O'Toole welcomes the opportunity to be copied on any
reports or resolutions dealt with by Clarington Council. This input is
important to his role at Queen's Park and will assist him in ensuring that
Clarington's voice is heard.

I - 11 Helen Schmid, writing to the Director of Planning Services and Council,
regarding the preferred name changes. Ms. Schmid has the following
suggestions for Victoria Street:

It occurred to her to rename the street to honour the late Dr. A.F.
McKenzie, who died April 4, having served our community for forty -five
years. He had considerable property fronting on Victoria Street. Some
suggested names are:

Ms. Schmid would be pleased, as a volunteer, to poll all six householders
whose property fronts all, or partially, on Victoria Street with a list of
names from the Planning Department.

Council with the comprehensive proposal that the Town of Kirkland Lake
provided to the City of Toronto at a Works Committee meeting on
September 10, 2001. The "Enviroganic 2010 Waste Diversion
Partnership" is a fully integrated composting and waste disposal proposal
that provides for a single environmentally and economically superior
solution to its waste management challenges.

1 - 16 Michael Binder, Assistant Deputy Minister, Spectrum, Information
Technologies and Telecommunications, Industry Canada, writing to
Council regarding Industry Canada's

towers. Under the Radiocommunication
responsible for radicommunications in Canada including antennas and
their supporting structures. Industry Canada, in recognizing the
importance of considering the potential impact of antenna installations on
their surroundings, has instituted procedures for applicants. These
procedures include a mandatory consultation process in order that land -
use authorities, such as the Municipality of Clarington, are consulted by
applicants when radio systems incorporating significant antenna structures
are proposed. In this way, municipalities have early notification of
proposed antenna towers within their community. By the same token,
they are given an opportunity to influence the siting of a tower as well as
the opportunity to develop a consultation protocol which is appropriate for
their community. Industry Canada is of the view that it is through
consultation with land -use authorities that the siting of towers is
influenced. It is equally so that

Social Services, thanking the Ministry for the opportunity to submit the
Feasibility Study for a new 15 -bed shelter in Bowmanville. The
recommendations put forward by thprofessional consideration on of var ous
a new facility on the present site, following careful o
alternatives, is the most appropriate and cost - effective approach, given
the deficiencies of their existing building. A new structure would be a
tremendous improvement on the current situation, given the on -going and
difficult -to- eradicate presence of mould in the building. They feel that this
approach provides a long -term solution which addresses various problems

1-23 Suzanne Nobes, Coordinator, Community Relations and Volunteers, The
Oshawa /Clarington Association for Community Living, providing Council
with a copy of the Oshawa /Clarington Association for Community Living's
2000/2001 Annual Report. This past year they have continued to provide
excellent care and the highest quality of service to over 450 individuals
with a developmental disability. The Association, in May of this year,
joined the ranks of 250 elite organizations worldwide by successfully
meeting the requirements of a 2 year Accreditation Designate from
Accreditation Ontario. They would not have been able to reach this
achievement had it not been for the incredible teamwork within their
organization and from our community.

1-30 Judith Spring, Chair, Board of Trustees, Lakeridge Health, writing to The
Honourable Tony Clement, regarding their redevelopment project. The
Durham Regional Cancer Centre is their highest priority and they are
publicly about to launch a major community fundraising campaign to raise
the community funds portion of this project. An announcement of
commencement of this project after many years of waiting will be welcome
news to the community. Ms. Spring wishes Mr. Clement to be aware of
concerns they have of the impact of potential stoppages in the completion
of their new north wing at the Oshawa site.

1-39 Elizabeth Witmer, MPP, Minister of the Environment, writing to Council
regarding biosolids and related water testing. On June 13, 2001, Bill 81
was introduced to legislation to set and enforce clear, consistent
standards for nutrient management on farms and protect the environment.
Specially trained Provincial Officers from the Ministry of the Environment
with a knowledge of agriculture would ensure focused and effective
environmental enforcement of strong, new standards. This Bill would
assist the Ministry of the Environment in protecting the environment with
strong, new preventive measures. Under Bill 81, be developedtfodalled
Nutrient Management Act 2001, standards
land- applied materials containing nutrients relating to agriculture, including
livestock manure, commercial fertilizer, o the sampling iosolids and and analysis program
pulp and paper sludge. With regard
planned for the ground and surface waters in the Clarington area,
Ms. Witmer is pleased to advise that ministry staff informed her they
anticipate the drilling of the test wells will be completed by the end of
September, 2001, and the sampling conducted in October. Further, staff
have indicated that the results of the analysis should be available by late
autumn.

the Region of Peel, on September 13, 2001, passed the following
resolution:
"THAT the reports of the Commissioner of Planning dated
September 11, 2001, titled 'The Oak Ridges Moraine - Strategic
Directions, Results of Public Participation, Recommendations and
Response to the Province' and the attached report (Appendix 1)
titled 'Oak Ridges Moraine Proposals for the Protection and
Management of a Unique Landscape - Results of Public
Participation and Recommendations, August 2001' be received;
AND FURTHER, that the report dated September 4, 2001, titled
`The Oak Ridges Moraine - Supplementary Report' be received;
AND FURTHER, that Regional staff acknowledge the need for
Provincial Legislation for the Oak Ridges Moraine (ORM) area and
support the strategic directions in the subject report, monitor the
Provincial Oak Ridges Moraine process, and report back to Council
on a regular basis;
AND FURTHER the Province be requested to fund initiatives as
outlined in Attachment 1 (therein referred to as Appendix 3) to the
report of the Commissioner of Planning, dated September 11,
2001, titled `The Oak Ridges Moraine - Strategic Directions, Results
of Public Participation, Recommendations and Response to the
Province', through the proposed Oak Ridges Moraine Legacy Trust,
with special priority given to groundwater management initiatives;
AND FURTHER, that the Town of Caledon has indicated in its
report commenting on the Oak Ridges Moraine provincial initiative,
that Caledon would encourage an Oak Ridges Moraine policy that
after a settlement boundary has been defined by an Area
Municipality under the auspices of its growth management strategy
in the Town of Caledon, the boundary should remain fixed for a
minimum of 5 years with a potential objective of a 10 year horizon.
In this context, Caledon further comments that this policy would
reflect the intent of the Oak Ridges Moraine vision to tie expansion
of settlement areas to broader growth management strategies,
while still accommodating the manner in which growth management
is implemented in Caledon. This implementation, in Caledon,
involves a multi -year phased program for completing detailed
community plans for various settlement areas, establishing
settlement boundaries in accordance with the Growth Strategy
approved in the five -year review;

Arran - Elderslie, advising Council that the Municipality of Arran - Elderslie on
September 24, 2001, passed the following resolution:
"WHEREAS many municipalities are unable to incorporate any
reliable provincial grant commitment into effectively planning for the
massive financial obligations associated with the upgrades required
to meet the new Ontario Drinking Water Regulation;
AND WHEREAS the lack of such information creates an
environment of extreme financial uncertainty in rural Ontario for
businesses and residents alike;
THEREFORE, the Council of Arran - Elderslie petitions the Ontario
Government to immediately provide reliable confirmation of OSTAR
funding levels to all Municipalities related to meeting the new
Ontario Drinking Water Regulations;
FURTHERMORE, Council asks for the support of other
Municipalities in petitioning the Government to act quickly on this
request."

D - 11 Sharon Johnson and Brad Cooper, Ontario Volunteer Emergency
Response Team Inc. (O.V.E.R.T.), requesting Council to provide monetary
assistance to O.V.E.R.T. regarding the New York terrorist attack.
O.V.E.R.T. is currently on Level 1 stand by to assist Emergency Measures
Ontario and Toronto's Urban Heavy Rescue Team in providing rescue and
recovery operations to the victims of the New York City disaster, as
requested by the Provincial Government. There is a high probability that
O.V.E.R.T. will be in the second wave of rescue workers to be deployed to
New York City. They are currently seeking pledges for financial support of
any kind to increase their preparations and decrease their deployment
time in the event that they are called into service.

D - 13 Councillor Bill Weaver, Acting Mayor, Municipality of Chatham -Kent,
advising Council that the Municipality of Chatham -Kent passed the
following resolution regarding Ontario Power Generation's rate increase:
"WHEREAS the Municipality of Chatham -Kent recognizes
economic development as a priority issue for the continued growth
and viability of this community;
AND WHEREAS Ontario Industry has historically enjoyed the
competitive advantage of an abundant supply of inexpensive
power;
AND WHEREAS the Ministry of Energy, Science and Technology
has approved a 0.7 cent per kilowatt -hour increase in energy costs
to all Ontario energy providers to service the stranded debt of the
former Ontario Hydro which was then passed on local business and
residential customers;
AND WHEREAS the price hike will result in an approximate 10%
increase in energy costs, this represents a significant rise in the
operational costs of local businesses;
AND WHEREAS business and industry have requested assistance
and relief from the said price increase;
NOW THEREFORE the Council of the Corporation of the
Municipality of Chatham -Kent resolves to ask the Ontario Ministry
of Energy Science & Technology to consider the economic
implications of this drastic increase in order to pay down the debt
left stranded by Ontario Hydro. Council also resolves to forward
this Resolution to all members of the Association of the
Municipalities of Ontario with a population of more than 50,000."
