MOTION
NOTICE OF MOTION
Moved by Councillor Robinson, seconded by Councillor Trim
WHEREAS the Municipality of Clarington has repeatedly reaffirmed its opposition
to any new landfill sites or expansion to existing landfill sites within its
boundaries;
AND WHEREAS technologies creating energy from waste such as incineration
have proven to be an effective method to increase diversion from landfill;
AND WHEREAS the Wesleyville Generating Station is currently on the market
and has a 401 interchange, is accessible to rail and dock facilities, a power
transmission link and the basic facility foundation:
NOW THEREFORE BE IT RESOLVED THAT the Municipality of Clarington
confirm its strong support for an energy- from -waste facility;

AND FURTHER THAT the Municipality of Clarington supports the use of
Wesleyville Generating Station as a possible site, suggesting that a feasibility
study be undertaken;
AND FURTHER THAT copies of this resolution be forwarded to the Regional
Municipality of Durham, the City of Toronto, the City of Peterborough, all area
municipalities within the Region of Durham, the Greater Toronto Services Board,
the Town of Port Hope -Hope, Ontario Power Generation, the Ministry of the
Environment, John O'Toole, MPP, Doug Galt, MPP, Jerry Ouellette, MPP, The

Michael Harris, Premier of Ontario, that Regional Council on
May 23, 2001, passed the following resolution:
"a) THAT the Government of Ontario be urged again to pass
strong and effective new legislation, to be called the
Ontarians with Disabilities Act, on or before November 23,
2001, that embodies the principles in the Ontario
Legislature's October 29, 1998, unanimous resolution;
b) THAT this resolution be forwarded to aIPHa for consideration
at its 2001 Annual Conference and to the Association of
Municipalities of Ontario for endorsement; and
c) THAT the Premier of Ontario, the Minister of Citizenship, the
Leader of the Opposition, the Liberal and New Democrat

1 - 6 Scott Bolton, Operations Technician, Region of Durham, informing Council
that a survey of approximately 300 km of watermain is to be conducted in
areas of Pickering/Whitby and Bowmanville. The survey will occur in the
summer of 2001 and should be completed by August 31, 2001. As part of
their water system quality standards, watermains are to be surveyed for
leaks every five years. Using traditional sounding and correlation or
acoustic data logging techniques, the consultant "listens" for sound on
direct contact points such as main line valves, fire hydrants, curb - valves,
etc. There is no interruption of water service, no excavation and no traffic
re- routing required. Only if a leak has been pinpointed and a repair
warranted by their depot staff, would any excavation take place.

Chris Hodgson, Minister of Municipal Affairs and Housing, that the Region
of Durham on May 23, 2001, passed the following resolution:
"a) THAT the proposed timetable for the implementation of a
Region specific GO Transit Development Charge as
indicated in Report #2001 -F -37 of the Commissioner of
Finance, be approved to allow the expeditious
implementation of a GO Transit Development Charge;
b) FURTHER, that Report #2001 -F -37 be forwarded to the
Greater Toronto Services Board as the response by the
Region of Durham to the GTSB resolution requesting
changes to Provincial legislation to allow the GTSB to
directly impose development charges for GO Transit; and

1 - 9 Doris Foster on behalf of Kendal Recreation, thanking Council for the
approval of a grant for the Kendal Recreation. As this is the first time they
have asked for this funding they are truly grateful. To this date, they have
purchased a pitchers safety screen, upgraded their Junior E.O.B.A.
equipment and will be purchasing uniform tops for their house league
teams.

Clarington Report on Local Governance was presented to and received for
information by the Council of the Regional Municipality of Durham at their
meeting held on May 23, 2001.

1 - 11 P.M. Madill, Regional Clerk, Region of Durham, advising The Honourable
Chris Stockwell, Minister of Labour, that the Region of Durham on
May 23, 2001, endorsed the following resolutions of the Western Ontario's
Warden Association:
"THAT, in the event an arbitrated settlement for ambulance workers
exceeds the Ministry's 2% salary cap for increases, the Province of
Ontario be requested to fund their 50% share of the increase based
on the arbitrator's award; and further
THAT a copy of the resolution be circulated to all delivery agents
and to Upper -Tier Municipalities for circulation to their member
municipalities."
"THAT the Western Ontario Wardens' Association support and
endorse the attached letter from the Country of Middlesex to the
Minister of Labour regarding the need for essential service
legislation for ambulance workers; and further
THAT this endorsement be forwarded to all delivery agents and to
Upper -Tier Municipalities for circulation to their member
municipalities."

1 - 13 John R. O'Toole, MPP, Durham, advising Council that the Municipality of
Clarington will be receiving an invitation to the Minister of Municipal Affairs
and Housing meeting on June 18, 2001, regarding "Smart Growth."
Essentially, they are looking ahead to identifying the essential priorities to
address growth pressures. We must balance our infrastructure needs
along with a sustainable quality of life. Mr. O'Toole's riding has a
significant agricultural component and he need not remind us of the
importance of having these interests represented. Our community is rich
in tradition and we are fortunate to have informed and involved
stakeholders from every sector.

1- 14 Sgt. Paul Malik, Durham Regional Police Services, advising Council that
two veteran police officers with a combined 51 years of policing
experience have been appointed as the new Deputy Chiefs of Police for
the Durham Regional Police Services. Their names are Rod Piukkala and
Chuck Mercier.

1 - 15 Kurt Johansen, Project Manager - Environmental Assessment, Nuclear
Waste Management Division, Ontario Power Generation, following up with
Council on their presentation earlier this year regarding Darlington Used
Fuel Dry Storage Project Environmental Assessment. The first round of
EA Public Open Houses are to be held in Bowmanville and Courtice on
June 6 and 12 respectively. Mr. Johansen has provided Council with a
copy of the newspaper advertisement and the household drop card that
will be used to invite the public to these open houses.

1 - 16 Roger Anderson, Regional Chair, Region of Durham, writing to The
Honourable Chris Hodgson, Minister of Municipal Affairs and Housing,
regarding the GTSB proposals for its future role and mandate.
Mr. Anderson has great concern and there are several issues which, for

Summary of Correspondence - 5 - June 11, 2001
1 - 17 Robert A. Richards, President and Chief Administrative Officer, Ontario
Property Assessment Corporation (OPAC), updating Council on a number
of initiatives that OPAC has recently undertaken to reduce costs, improve
the quality of their products and enhance the delivery of excellent
customer service. To meet these challenges, organizational changes will
be implemented. There will be two new departments, Customer Relations
and Property Values. Also a new Quality Services department is being
built to ensure the highest quality products and services are delivered to
customers, and to evaluate performance against international
benchmarks. OPAC will also be taking advantage of the opportunities
presented by technologies such as the Internet, handheld computers, a
call centre and a Geographic Information System (GIS).

1 - 18 Hannah Yang, Coordinator, Fund Raising Events, Multiple Sclerosis
Society of Canada, thanking Council for their help in making the 2001
Bowmanville Super Cities WALK for MS such a tremendous success.
They were so fortunate to have amazing weather on WALK day. Ms.
Yang is happy to report that the Durham WALKs raised over $250,000 on
WALK day. Bowmanville brought in approximately $27,000. The money
raised from the Durham WALKs will be used to fund national research
projects and to provide services for persons with MS and their families
living in the Durham Region.

1 - 19 The Honourable Chris Hodgson, Minister of Municipal Affairs and
Housing, informing Council that the government is undertaking a province -
wide consultation process on Smart Growth. The consultation will engage
people from across the province, including municipal elected officials and
municipal professional staff. Input from the public and key stakeholders
will assist in developing a strategy to promote and encourage growth in
ways that will sustain a strong economy, build strong communities and
support a healthy environment. Municipal input will be essential to the
success of an Ontario Smart Growth strategy. Some municipal elected
officials and professional staff have been invited to participate in regional
stakeholder meetings. Mr. Hodgson has also asked the ministry's regional
staff to hold sessions with municipal elected officials and staff to discuss
the goals and principles for Smart Growth as they relate directly to
municipalities.

1-20 David Young, Attorney General, Minister Responsible for Native Affairs,
announcing that effective March 31, 2001, all of Ontario's municipalities
have successfully transferred the jurisdiction of the Provincial Offences
Act (POA) (with the exception of the City of Toronto). Negotiations with the
City of Toronto are progressing toward a transfer later this year.

1- 21 P.M. Madill, Regional Clerk, Region of Durham, advising The Honourable
Michael Harris, Premier of Ontario, that the Region of Durham on May 23,
2001, endorsed the resolution of the County of Essa regarding the use of
photo radar on Provincial Highways.

1-22 Charlie Macaluso, Chief Executive Officer, Municipal Electric Association,
informing Council that, at a hearing in Toronto, the presiding judge
approved a proposed settlement of a class action lawsuit against Ontario
Hydro brought by the province's municipal electric distribution utilities.
Working together, the MEA's member utilities launched the suit in 1997.
When the Ontario government introduced the Energy Competition Act in
1998 and restructured Ontario Hydro, the class action was transferred to
one of Ontario Hydro's successor companies, Ontario Power Generation
Inc. (OPGI). With the judge's approval of the proposed settlement, unless
OPGI reconsiders the settlement, the municipal electric utilities
participating in the settlement will each receive a portion of a $29 million
payment from OPGI; enjoy the benefits of a $5 million fund, financed by
OPGI and jointly administered with MEA, to explore and develop
commercial opportunities in the competitive electricity market in Ontario;
and have the legal fees and disbursements of the Class paid by OPGI.

On May 9, 2001, the Region's Works Committee received for information
a consultant's report for EnvirosRIS regarding current waste diversion
practices and recommendations from the Region's Waste Management
Advisory Committee on how to improve waste diversion programs.

1 - 31 Chris Darling, Planner, Region of Durham, provided Council with a copy of
a strategic directions paper entitled: "The Oak Ridges Moraine - Proposals
for the Protection and Management of a Unique Landscape, May 2001."
The Regions of Durham, Peel and York with the assistance of
Conservation Authorities and other municipalities on the Oak Ridges
Moraine have scheduled several information meetings to provide an
opportunity for comment on the Oak Ridges Moraine Strategy.

Summary of Correspondence - 8 - June 11, 2001
1-32 Sherry Bonassa, Darlington Soccer Club, President, thanking Council for
the municipal grant approval. Running a club this size is a great deal of
work, and any and all help they receive is greatly appreciated. The Clerk's
Department has been very helpful regarding licensing their raffles and
other fundraising ventures they have, as has the Public Works
Department. The fields are showing the work that has been put into them
this Spring.

1-33 Michelle Nichols and Judy Skinner, Co- Chairs, Program Committee,
Canadian Breast Cancer Foundation, advising Council that this year
Durham Region has been designated an Official Run Site, and the CIBC
Run for the Cure will be held on Sunday, September 30, 2001, 10:00 a.m.
at Durham College in Oshawa. This is a 5- kilometer run, or 1- kilometer
walk, which will again take place through the grounds of Camp Samac.
This wonderful event is held in support of breast cancer research,
education, diagnosis and treatment. Approximately one in nine women in
the Durham Region will die of breast cancer.

Summary of Correspondence - 9 - June 11, 2001
D - 2 Christopher Weller, requesting that Council approve the holding of a
parade on Saturday, June 16, 2001, in the Village of Orono. The parade
is part of The Great Canadian Town Band Festival which is conducted by
the Clarington Concert Band. The anticipated time will be between
10:00 a.m. and 11:30 a.m. The route will be as follows:
West of park Street from the Arena grounds, north on Church
Street, west on Centre Street, south on Main Street, west of Station
Street, south of Leigh Street and west on Princess Street into
Sylvanus Gardens.

Committee and Dr. Robert Kyle, Commissioner and Medial Officer of
Health, Region of Durham, requesting that Council ban smoking in
restaurants by reviewing and updating our smoking by -law accordingly.
Scientific research conducted over the last decade has clearly determined
the health effects of involuntary exposure to second -hand tobacco smoke.
On May 16, 2001, the Ontario Tobacco Research Unit released Protection
from Second -Hand Tobacco Smoke in Ontario, a review of the health
effects and the evidence regarding best practices. In concludes that all
exposure to second -hand smoke is harmful and should be eliminated. It
also states that ventilation provides no adequate protection from exposure
to second -hand smoke.

D - 4 Michele Kennedy, Town Clerk, Town of Whitchurch - Stouffville, advising
Council that the Town of W hitch urch-Stouffville on May 15, 2001, passed
the following resolution:
"WHEREAS the Oak Ridges Moraine is one of the most significant
natural features in the Province of Ontario; and
WHEREAS the Oak Ridges Moraine forms a key element of a
connected system of natural features and wildlife corridors that
include the Niagara Escarpment Oak Ridges Moraine and other
connections along river valleys to the shore of Lake Ontario and the
shores of Lake Simcoe; and
WHEREAS the Ministry of Municipal Affairs has identified the need
for a Natural Heritage Corridor on the Oak Ridges Moraine in the
May 2000 publication of the Natural Heritage System for the Oak
Ridges Moraine; and

WHEREAS the joint Conservation Authorities have declared their
interest in maintaining a wild life corridor for the Oak Ridges
Moraine in the general vicinity of the Natural Heritage System for
the Oak Ridges Moraine; and
WHEREAS over 80% of the Town of Whitchurch - Stouffville is
situated on the Oak Ridges Moraine and provides the base flow for
the Rouge River, Black River, Duffins Creek and the headwaters of
the Holland River; and
WHEREAS the Town of Whitchurch - Stouffville has made significant
investments in the protection and enhancement of the Oak Ridges
Moraine through its Official Plans and Greenland Study; and
WHEREAS the Provincial, Municipal and Federal Governments and
Conservation Authorities have made significant contributions in
land dedications to public ownership that may be detrimentally
impacted if the Moraine was fragmented by urbanization;
THEREFORE BE IT RESOLVED THAT the Town of Whitchurch-
Stouffville does support the establishment of a Natural Features
Corridor, with help from all municipalities, agencies and authorities
involved with the Oak Ridges Moraine, for the preservation of a
significant east -west corridor over the entire length of the Moraine;
AND THAT Councillor Mark Carroll be provided with the Town's
Greenland Study and Rural Official Plan to present to the Oak
Ridges Moraine Ontario Municipal Board Hearing within the Town
of Richmond Hill as evidence of the Town of Whitchurch-
Stouffville's respect for the integrity of the Oak Ridges Moraine;
AND FURTHER THAT a copy of this resolution be forwarded to the
Ontario Municipal Board, Ministry of Municipal Affairs and Housing,
Toronto and Region Conservation Authority, Lake Simcoe and
Region Conservation Authority, Ministry of Natural Resources,
Ministry of the Environment and all municipalities whose borders
are within the Oak Ridges Moraine."

Summary of Correspondence - 11 - June 11, 2001
D - 5 Dave Dobson, Camp Director, Big Brothers & Sisters of Clarington,
requesting contributions and donations for the Champions of Change
Youth Leadership Camp. In addition to finance assistance, the camp
requires prizes, food, donations and businesses willing to advertise the
camp. No donation is too small. The Champions of Change Youth
Leadership Camp is an affiliation of Big Brothers and Sisters of Clarington.
The purpose of the camp is to provide an opportunity for girls and boys,
aged 10 - 16 to develop leadership skills through involvement within the
community. There are limited programs available for this age in the
summer that offer leadership training to help develop the skills needed to
find summer employment and to provide educational goals for the future.
The focus of the camp is to meet these needs. The camp also calls
attention to the widening gap between local teens and their communities.

D - 6 Marilyn Muizelaar, Membership Co- ordinator, Durham Region Parents of
Multiple Births Association (DRPOMBA), Multiples in Motion Conference
Program Co- ordinator, providing Council with documentation indicating
reasons why the Durham Region Parents of Multiple Births Association
should indeed be eligible for a grant. Ms. Muizelaar's questions of why
this organization's application for a grant was denied have not been
addressed and she respectfully request that we answer them.

D - 7 Pat Kemp, Clerk, County of Peterborough, advising Council that
Peterborough County on May 16, 2001, passed the following resolution:
"WHEREAS the Province of Ontario has downloaded the
responsibility of Land Ambulance to Upper Tier Municipalities as of
December 31, 2000, and has been aware of this downloading since
1997;
AND WHEREAS the municipalities need to know the funding
template in order to proceed with their 2001 budgets;
AND WHEREAS the approval of funding is essential to the
operation of the land ambulance service;
NOW THEREFORE BE IT RESOLVED THAT the Corporation of
the County of Peterborough hereby enacts as follows:
1. That the Minister of Finance and Minister of Health be
advised that if land ambulance funding approvals are not
received, we will be unable to meet legislated standards and
our community will be at risk;

2. That the Association of Municipalities of Ontario (AMO) and
the Land Ambulance Implementation Steering Committee
(LAISC) be requested to lobby for `fast track' approval of
funding, standards, and related issues;

Regions, the Association of Municipalities of Ontario and the City of
Peterborough for their support."

D - 8 Marilyn LaMarche, requesting Council to waive the fee for her regarding
cat licencing. Ms. LaMarche understands that the municipality is obliged
to impose their rules pertaining to pets, but she has two cats who go
yearly for complete check -ups, they are and always have been strictly
indoor cats and she is not able to pay for licencing. Ms. LaMarche is the
only one left in her family and she has just recently lost her mother. She
will be paying bills for the next year. She lives at 59 Jackman Road,
Bowmanville and the Pet Committee of the Bowmanville Valley Co -op
requires a letter from the municipality waiving the fees of licencing her
cats.
