The disposal of dead animals, including livestock, is the responsibility of the Ontario Ministry of Agriculture, Food and Rural Affairs. Protection of groundwater sources to ensure safe, potable drinking water supplies is a concern of the Durham Region Health Department. The Ministry of Environment also has regulation(s) under the Ontario Water Resources Act that sets out requirements for water wells. The Health Department believes that the "Dead Animal Disposal Act, RSO, 1990, Chapter D.3" outlines the requirements for the proper di protection of animals and /or removal by an approved deads operator. groundwater and surface water sources are an integral part of these regulations and guidelines. In the interest of protecting the health of our community, the Durham Regional Health Department would be pleased to meet with all of the stakeholders to ensure the protection of our groundwater sources for drinking water. This clause has been further regulated by way of Ontario Regulation 667/98 which states, `A person who captures but does not kill live wildlife under clause 31(1)(b) of the Act shall, not later than 24 hours after capture, release the wildlife as soon as possible into the area in close proximity to the capture site unless otherwise directed by the Ministry... . (Receive for Information) Summary of Correspondence _ 7 _ November 22, 1999 CORRESPONDENCE FOR DIRECTION D - 1 Correspondence from Mr. and Mrs. Mike Peel, 315 King Street East, Newcastle, LIB 1H4, expressing their concerns regarding the proposal of a new gas station and the commercial /retail space to be located at the east end of Newcastle on Highway 2. They are the third generation of Peel's to live in the Village of Newcastle. As a homeowner in the village for many years, they have started a family and they have moved into what they thought would be their dream home. They are happy toast, growth re houses west of the proposed site, homeowner hey have some 315 Kmg Street East, just concerns which include zoning changes, waste o n to refer correspondence to the Director of Planning and Development) D-2 Arnold Bark, Chair, Bowmanville Museum Board, expressing their interest in the Clarington Public Library, Bowmanville Branch building. They understand that it may become available in the near future with the development of a new building for the Library. Both the curator, Charles Taws and he have had an in -depth tour of the facility and they feel it would help solve many of the problems the Museum is currently facing. The Museum would use the building in many different ways. Part would be used to store their collections; currently all excess artifacts are stored in the Hampton Community Hall. This is not convenient or an ideal situation. By having the collection property stored in an area that can be climate controlled they can better ensure that the items will be available for conservation, study and display purposes. Also, the Hampton Hall Board is in need of additional space for their activities, and removal of the Museum artifacts would satisfy that requirement. Some space would be used to expand their displays, in particular their collection of Bowmanville built Dominion pianos and organs, as well as their antique doll and toy collection. Both continue to increase in popularity with visitors. Archive collection storage, provision of proper study space, and more adequate office space would be considerably improved. (Motion to refer correspondence nce to the Property Manager) Summary of Correspondence - 8 - November 22, 1999 D - 3 Gerry Meharg, Medadows of Tyrone - 594829 Ontario Limited, 28B Albert Street, Oshawa, L1H 855, advising the Municipality of Clarington that they have advised five property owners located on the east side of Liberty Street North that one of the draft plan conditions is that a sidewalk be constructed in front of their properties. All five owners tell them they do not wish to have a sidewalk constructed in that location. Some of the owners are neutral regarding the installation of street lights while two think lights would be beneficial. Mr. Meharg does not see the need or benefit of a sidewalk in that location and because they were not involved in the draft plan negotiations, they are not sure why this was even included as a requirement. They respectfully ask that the municipality remove this requirement from the draft plan conditions, as they will soon be having their engineer doing the necessary work leading up to the registration. If we would prefer that street lights be a requirement, they would point out that the draft plan conditions relating to the site of the northwest quadrant of Tyrone includes that a contribution be made towards the same street lights on Liberty Street presumably onn sm whereby they, ascur, they would respectfully ask that we set up s ome mecha developers of the northeast quads of f the northwest share of the street the northwest lights to be paid by the develop quadrant development becomes registered. Morgan, Chair, Ontario Family Fishing Weekend Steering Committee, advising Council that the Province of Ontario, in partnership with many non - government organizations like the Ontario Federation of Anglers and Hunters, declares one summer weekend (Friday, July 7 through Sunday, July 9, 2000) a licence -free fishing weekend. This special weekend includes fish festivals, clinics or educational activities which may be held in your area. They are requesting the municipality's help to publicize the 2000 Ontario o Family Fishing Weekend in any calendar of summer events we may publish participate. They also request that the municipality declare the weekend. Clark & Associates Limited, 4098 Concession Road 5, R.R. 91, Orono, LOB IMO, regarding the payment to elected officials. If there were definite laws or rules for this then there would be no problem. Obviously the problem with rules or laws is that they get outdated and then often exacerbate the condition that they were made to correct. One needs a simple law that will be suitable as long as we have elected officials and that will meet the changing times. Although it is not always obvious by the actions of some elected officials, the electorate perceives that the person elected has entered into a contract with the electorate to do a specific job, for a specific duration and at the time of the election the remuneration for the job was well known to the Candidates. It is the changing of the terms of reference after the election that causes the problem. Many people like himself work on contract rates that are either written or agreed to verbally. These rates extend through the life of the job unless there are unusual circumstances such as the job has changes, the contract goes on for a long period of time and has review clauses or some mutually agreed mechanism. It is seldom that a person can just say that I won't do the job for the agreed price. They will lose the job or be held to it by a legal challenge and they will seldom, if ever, get a second chance at another contract job with the same company, government or individual. When elected officials give themselves a pay raise after they have been elected they are, in fact, breaking the perceived contract that they made with the electorate. In private life this would not be tolerated. This is a problem as we need to have elected officials that are intelligent and are in touch with the world and particularly people that have been in a variety of walks of live so that the people are represented. If the pay scale is inadequate then it will be impossible for some potentially splendid officials to run for office. It would be best if one Federal Law could be put in place that would address this problem if the not withstanding clause did not get in the way. However if should go all the way down the list and someone should start it. Premier Harris could add this to His Common Sense Proposals and make it Ontario Law. If this is not possible, Clarington should instigate it or maybe Toronto. Whoever starts something like this will be looked on as a forward thinking problem solver. This would allow elected officials to get on with their job at least until the end of the term without the distraction of pay negotiations. (Similar letters are being sent to Mayor Lastman of Toronto, Premier Harris and Prime Minister Chretian.) (Motion for Direction) D - 6 J.W. Tiernay, Administrator, County of Peterborough, 470 Water Street, Peterborough, K91-1 3M3, advising that the County of Peterborough at its meeting on November 3, 1999, passed the following resolution: "THAT County Council endorse the resolution from the Township of Burleigh- Anstruther- Chandos being: that the County endorse a collective pricing arrangement with Bell Canada to allow for installation of phone lines in Municipal Operations Control Centres located within the County; Summary of Correspondence -to- November 22, 1999 AND FURTHER THAT the County approach Bell Canada with this request on behalf of the Municipalities'; AND FURTHER THAT the County of Peterborough circulate this resolution to other municipalities in Ontario and the Association of Municipalities of Ontario (AMO) asking for their support for our motion; AND FURTHER THAT discussions be held with Bell Canada that if a special rate is offered for the installation of phone lines in Municipal Operation Control Centres that those savings be retroactive to the municipalities that have already installed them; AND FURTHER THAT a copy of this resolution be forwarded to the CRTC advising them of the urgency of this matter."
