HomeMy WebLinkAbout72-25in -2W THE CORPORATION OF THE TOWN OF BOWMANVILLE By -Law No. 72 -25 Being a by -law to regulate the hours of closing for Barber Shops. WHEREAS certain barbers carrying on business in the Town of Bowmanville, have requested the Council to pass a by -law regulating the hours of closing for Barber Shops; AND WHEREAS the Council deems it adviseable to pass such a by -law: NOW THEREFORE pursuant to The Municipal Act, R.S.O. 1970, Chapter 284, Section 355, the Council of The Corporation of the Town of Bowmanville, HEREBY ENACTS AS FOLLOWS: 1. Barber Shops in the Town of Bowmanville shall during the whole of the year, be closed and remain closed at the following times: (a) On each Monday, Tuesday and Thursday between 6 o'clock in the afternoon and 5 o'clock in the forenoon of the next following day. (b) On the whole of each Wednesday. (c) On Friday, from 9 o'clock in the afternoon and 5 o'clock in the forenoon of Saturday. (d) On Saturday from 5 o'clock in the afternoon until midnight. (e) On any holiday defined in The Interpretation Act to include, Sunday, New Year's Day, Good Friday, Easter Monday, Christmas Day, the birthday or the day fixed by proclamation of the Governor General for the celebration of the birthday of the reigning Sovereign, Victoria Day, Dominion Day, Labour Day, Remembrance Day, and any day appointed by proclamation of the Governor General or the Lieutenant Governor as a public holiday or for a general fast or thanksgiving, and when any holiday: falls on a Sunday, the day next following is in lieu thereof a holiday; (f) Boxing Day. (g) Any day proclaimed by the head of the Council of the Town as a civic holiday. 2. Nothing in this by -law renders unlawful the continuance in a shop after the hour appointed for the closing thereof of any customers who were in the shop immediately before that hour or the serving of such customers during their continuance therein. 3. The time mentioned in this by -law shall be Standard Time except during such period and so long as the time commonly observed in the municipality is one hour in advance of Standard Time, the times mentioned in this by -law shall be reckoned in accordance with the time so commonly observed and not Standard Time. -2- 4. Any occupier of a Barber Shop who contravenes the provisions of this by -law is quilty of an offence and shall be liable to a minimum penalty of $50.00 up to a maximum penalty of $300.00. 5. Where the occupier of a Barber Shop is liable under the provisions of this by -law and in fact some Agent or Servant of the occupier has committed the offence, then such Agent or Servant is liable to the same penalty as if he were the occupier. 6. This by -law is enforceable under the provisions-of The Summary Convictions Act. 7. This by -law shall take effect on the 19th day of,,,1972. 8. By -Law No. 1596, By -Law No. 72 -14 and any by -law not consistent with this by -law are hereby repealed. READ a first and second time this 5th day of June, 1972.
