HomeMy WebLinkAbout67-21THE CORPORATION OF THE TOIIRq OF BOIrTMANVILIE BY-LAIJ NO. 67-21 A By-law to stop up and close the road running along the south boundary of the Queen's Block from Queen's Avenue easterly to Lot 30 on the said Queen's Block Plan of the Town of Bo-vnan- ville, and to provide for the sale thereof to the abutting owners. 74'H" MEAS the Council of the Corporation of the Town of Bow-manville deems it advisable to pass a By-law to close the road lying immediately southerly of the Queen's Block from Queen's Avenue easterly to Lot 30 according to said Queen's Block Plan, and to provide for the sale thereof to the abutting owners. AND _VaM-REAS the Town of Bowmanville has from time to time expended public funds in connection with the said road. AND I'TdEREAS notice of such by-law was published in the Canadian Statesman, a weekly newspaper published in the Town of Bowmanville in its issues dated June 7th, 14th, 21st and 28th; 1967. AND IVTHEREAS no person or corporation will be deprived of the means of ingress and egress to and from his or its land CD or place of residence by the passing of this by-law. NOIAT THEREFORE the Council of the Corporation of the Town of Bo�vmanville pursuant to The 1,11unicipal Act R.S.O. 1960, Chapter 249, Section 459 (111 (c) and (d) and Section 477 (1) hereby ENACTS AS FOLLOWS: 1. That the road shown on the Plan of the Queen's Block south of Queen Street and running easterly along the south boundary of the said Queen's Block from the eastern limit of Queen's Avenue to Lot 30 according to said Queen's Block be and the same is hereby closed and stopped up. 2. That the said part of the road lying southerly of the Queen's Block hereby stopped up and closed shall be offered for sale to the Goodyear Tire and Rubber Company of Canada Limited at the price of Tp1.00 subject to an easement reserved to the Town of Bowiianvi]-le, its servants,, employees, contractors and agents and the servants and employees of their contractors - 2 - and agents, in over, along and upon the westerly 100 feet for the purpose of maintaining a water hydrant and water pipes leading thereto from Queen's Avenue together with the right to enter thereon and lay, renew, repair the said water pipes and hydrant and to make such excavations as may be necessary for these purposes; PROVIDED that such easement may be terminated by Goodyear Tire and Rubber Company of Canada Limited or their successors in title upon 30 days notice and the said hydrant and all pipes shall thereafter be removed by the Town at the expense of the Goodyear Tire and Rubber Company of Canada Limited. 3. That upon payment of the said purchase price in full by the said Goodyear Tire & Rubber Company of Canada Limited the Mayor and Clerk are hereby authorized to sign and execute a conveyance of the said stopped up part of highway in favour of The Goodyear Tire & Rubber Company of Canada Limited and impress the Corporation Seal thereon subject to the aforesaid easement being in such conveyance.
