A by -law establishing The Bowmanville Cemetery
Board, providing for the transfer of the control
and management of The Rownian ville Cemetery to
the 'Bowmanville Cemetery Board, and defining the
duties and powers of The Bowmanvi lle Cemetery
Board.
WHEREAS it „is deemed expedient, pursuant to The z
Cemeteries Act, to establish a cemetery board and transfer to such
board the control and management of The Bovimanville Cemetery and de-
fine the duties and powers of such a board, and, subject to the app -.
roval of the Department of Health, of Ontario, to enact rules for the.
maintenance,' management, regulation and control.of, the Bownanville
Cemetery, including the making .of regulations for the ,laying out and
selling; of lots and the execution of conveyances of cemetery ,lots or
plots;
NOW THEREFORE the Council . of the Corporation of the Town
of Bowmanville, pursuant to the Cemeteries ,Act R. S0`00 1950 and � amend-
ments thereto,* HEREBY ENACTS as follows

l: There is hereby constituted and established for the control
and management of cemetefte s owned or controlled by the Tow' n, of Bow-
manville, a board which shall be known as The Bowmanville Cemetery
Board, which shall consist of five persons appointed by by --law . of the.
-; Council, two of such persons to be mernbers of Council appointed ann�

ually and the , remaining three persons to hold office for three year
and until their successors are appointed, unless their term of office

` Provided that-of the three persons so appointed for three
years, the first person so appointed shall hold office for three

appointed for two years from the first day of January, A-.0 1961;
and the third person so appointed for one year from the first day
of January, A.D.. 1961.

(C) to request 'the town council to. have any necessary
proceedings taken for the recovery of any money or other,
property given, bequeathed or de.vised for the care of any
cemetery or part thereof*
to prepare and present to-tthe town council its annual
.estimates of receipts and expenditures, on or before `the 15th day
of February in each year.
DUTIES OF SUPERINTENDENT
5.41) There shall be appointed by the town council a Super=

including the employment supervision and discharge of all employees#
the keeping in good order ,of all walks, drives and grounds, the enforce -
ment of the provisions of this by-law and all lawful directions of
the Board; provided that before removing any 'tree or shrub from a.
lot or sing�e grave, he shall where reasonably possible, first give
notice thereof to the owner of such lot or single grave;
(d) to give signed orders for all interments and dis4W
interments and to see that all are conducted in a decent and orde
erly
manner, and that quiet and good order are at all times maintained,'
and to attend or caus-e his delegate to attend at every interment and
disinterment,
(e) to delegate with the approval of the Board, such. duties,
as may be proper; and

EMPLOYEES NOT TO SOLICIT BUSINESS
?. No officer or employee shall canvass or solicit business.-
.in connection with any monument or other structure, to be erected, or
in connection with any work to be done in a cemetery, saving and
excepting the selling of lots or single graves by a person authorized,

DUTIES OF THE TOWN TREASURER
801 It shall be the duty of the Town Treasurer. , and he
shall have power,
.(a) to make all sales of lots .and 'single 'graves and re are the
deeds for execution by the Mayor and himself;
(b) to receive all moneys payable to the account , of the town
corporation for the sale of lots and single - graves j and for
perpetual caret and all other monies received by the Board, and .
all other moneys or other property given, devised, bequeathed ' or . set , , 1
aside for the purpose of t he upkeep or care of any lot. or
plot or , portion of a cemetery i and all other moneys property
receivable-by the Board or the town corporation with respect to the
cemeteriesi whether by way of gift, bequest or, otherwise ;
Ac) to set aside for the perpetual care thirty --five p ereent of all
moneys received on the sale of lots and single ravesas rescrib e d
by the ' regulations under The Cemeteries Act and to set aside for
perpetual care all other moneys received for perpetual ' care, and to
set aside for the ' purpos a of the upkeep or care of any lot or plot
or portion of - -a cemetery, any money or other property given, devised
bequeathed or set

subject to the approval of the town council in such securities
as may from time to time be authorized by the provisions of The
Trustees Act or The Cemeteries Act.

other income from money invested or from other property given,
devised, bequeathed or set aside for the purpose of the upkeep or
care of any lot or plot or portion of a cemetery;- and

Superintendent and his staffs . and, upon receipt of a copy, certified
by the Chairman and Secretary, of any resolution of the Board for
payment thereof, to make actual payment of the amount of any account
for goods or services lawfully supplied or performed for the Board.

Irospective purchasers, maps' showing all lots and single graves

(2) Upon pa,Yment in full . of the purchase price of a •lot
or single grave, the Town Treasurer shall prepare a deed according
to the form set forth in Schedule B appended hereto, and shall
after execution thereof by the Mayor and himself record the same in
a Register kept- for that purpose, and deliver it to the .Purchaser.
RIGHTS OR PURCHASERS
lle- (1) The deed of a lot or single grave shall convey only
9the right of burial of human remains therein, and of placing a rparker
cr non•ument, and such rights shall •b•e- sub jett to the provisions of
The Cemeteries Act and regulations thereunder; and of this' By &4l•awj as
amended from time. to tine; and no purchaser shall acquire any right
title or interest except as aforesaid, or pursuant to the said Act or
other Act in that behalf.
(2) Vhere no interment has been made in a plot for more
.than, twenty years and tine owner has 'not maintained and kept it in a
state or repair for more than five ears or has made default

(as provided for in section 28 of The Cemeteries Act, R.S.Ov 1950,

TRANSFER OF LOTS AND SINGLE GRAVES `
12.- (1 Upon the transfer of a lot or single grave ' bar t he' owner
thereof, the Town Treasurer shall upon payment of a fee of two dollars
prepare and have executed by the owner thereof, or by the authorized
personal representatives of a deceased owner upon satisfactory evidence,
of their authority, a transfer in duplicate, in the form set forth in
Schedule , C appended hereto, and shall enter the transfer in the Register
nd deliver one copy to the transferee and keep the other for his records;

o the case of a transfer where an owner is deceased, a notarial copy
of probate or of letters of administration should be procured by the
Town Treasurerip or a satisfactory statutory declaration with such
particulars, including the names and addresses of the heirs and the
name and address of the person authorized to sign a transfer.

MARKERS
'Materials etc. r' Every marke shall be of granite,, or
s
other hard and. durable stone and monolithic, or of any ufficiently
durable and non- corrosive metal, dowelled completely through a base of such
stone as aforesaid, and securely fastened by a.threaded nut at the bottom.
All markers shall be mounted only on a stone or concrete base or footing and
and such stone or concrete base footing shall be at. least four. inches
thick and not more 'than eight inches thick.
(6) (a) Size. Every marker for a single grave shall be of,a
size as nearly as practicable', of 18 inches by '24 i With inches, a.' thickness

of from 4 to 8 inches.
(b) Bronze or other metallic markers do, riot, require a,
foundation.
(7) Flush with Ground, etc. Every marker shall be placed
only by employees of the Board and the surface shall be level and without
shallrojections, and shall be flush with the ground. Not more than one ,marker
be allowed on one grave, and no marker at' the same end, as a monument,

(11) Foundations. All foundations shall be constructed by
the Board and shall be of concrete and of a depth of 5'feet, and set flush

(12) Only One on One Lot. Not more than one 'monument shall
be allowed on one, lot.

any materials placed or any work done, except at such time and in such
manner and in such place as is authorized by the Superintendent.

October, and all litter and debris 'and loose earth shall be removed
at the times above set forth for cessation of work,

CARE OF LOTS ,AND SINGLE GRAVES

(2) Flowers. Cut flowers may be placed and flow ars planted
at the front of a grave under the supe rvis ion and regulation : df the
Superintendent.
(3) Removal of t�Jreaths, etc. Any wreath or artificial flower
not removed on o r before t he first day o f April in any year shall be
removed by the Superintendent and destroyed, and no such wreaths or
artificial fl^wers shall be allowed between the said date and the first
day of November following.

{ 3) Vehicles. No vehicle shall be driven at as eed of more •
than ten miles per hour, or elsewhere than upon the roadways provided
0 'for vehicles.
{4) Parades and Processions. No person shall within a
cemetery take part in any parade or procession except a funeral procession.
(5) Return Watering Cans. Visitors are expected to return
watering cans to their place at the water tape ;
(6) Complaints. Any person having occasion to snake any
complaint shall make it at the office of the superintendent, and not
to any employee in the grounds, unless, in wri, t ing addressed to the
Superintendent.
NOTE: for other prohibitions see section 37 of The Cemeteries , Act,
which provides as follows:

works in a cemetery;

(2) Every person who contravenes- any of the . provisions of
. s,ubsection 1 shall be , guilty of an offence and on- summary
conviction shall be liable to a penalty-of, not less than $x..00
and not more than $40*000
(3) No person shall bring any dog, , goat 'or cattle within the
limits of a cemetery, and every person so doing shall` be guilty
of- an offence and on summary conviction shall be . liable to a
penalty of not more than $20.00
(4) Every person who contravenes 1 r subsection . subsection o 3
shall also be liable , in an action in the' name of the owner of
such cemetery or of a burial plot upon which such damage is
done or other unlawful act committed to • pay all damages occasioned

be applied under the directions of the owner of the cemetery for

PENALTIES .
210 Any person who violates any provision of this by -law
shall upon conviction incur a penalty of not more than $100.00 for each
0 offence, exclusive of costs, and all such penalties shall be recoverable
under The Summary Convictions Act. ,
