BY -LAW NO. 1936
A BY -LAST TO AP'iEND, ZONING BY -LAW IJO. 1587
WHEHEAS the Corporation of the Town of Bowmanville passed
a Zoning By -Law ?dumber 1587 on the 2nd day of August 1955, which
was duly approved by Order of the Ontario Plunicipal Board.
AND Tr1HERLAS by -law 1587 has been amended by by -laws numbered
1612, 1700, 1825, 1835, 1$8$, 1916 and 1933; all of which save
by -laws 1916 and 1933 have been duly approved by the Ontario
Municipal Board.
AND JHLREAS it is desirable to further amend the said
Zoning By -Law 1587;
NOW THLhEFORE the Council of the Corporation of the Town
of Bowmanville pursuant to the Flanning .pct, R.J.O. 1960, Chapter
296, Section 30, and amendments thereto, HEREBY ENACTIS THAT By-
Law No. 1587 as amended be further amended as follows:
1.' By deleting Paragraph (A) of paragraph 71 entitled "General
Regulations in all Zones ", and substituting therefore the follow-
40 ing: (A) (1) Nothing in this by -law shall prevent the use of any
land as a public park, community park, playground,
road allowance, or for any municipal purposes.

(2) -The provisions of this by -law shall not apply to the
use of any land or to the erection or use of any
building or structure for the purposes of the public
ser�!ice by the Corporation of the Town of Bowmanville
or by a local board thereof as defined by The Depart-
ment of Municipal Affairs Act, any telephone or tele-
graph company, any department or commission of the
Government of Ontario or of Canada, including the
Hydro Electric Power Commission of Ontario, provided
that where such land, building or structure is located
in a residential zone or a commercial zone.

such zone shall be complied with, and
(3)any building erected under the authority of this
paragraph shall be designed and maintained in gener-
al harmony with residential and commercial buildings
of the type permitted in such zone, and further pro-
vided that where such land, building or structure is
located in light industry zone, heavy industry zone
or a rural zone the lot coverage and yard regulations
described for such zone shall be complied with.
2. Under the heading "Rural `Lone'? Paragraph 14(b) minimum
yard be deleted and the following substituted therefor:
(B) ?'Minimum Yards'?
1. Front yard: 40 feet for a dwelling and 75 feet for all
other buildings.
2. Side yard: 20 feet for a dwelling and for all other
buildings (.and) side yards of 25 feet except exterior side
yards on corner lots 75 feot.

N O T I C E
NOTICE OF APPLICATION to the Ontario Municipal Board
by the Corporation of the Town of Bowmanville for approval
of a by-law to regulate land use passed pursuant to Section 30
of The Planning Act.
TAKE NOTICE that the Council of the Corporation of the
Town of Bowmanville intends to apply to The Ontario Municipal
Board pursuant to the provisions of Section 30 of The Planning
Act for approval of by -law 1936 passed on the 3rd day of May,
1965. A copy of the by -law set out below together with an
explanation of the purpose and effect of the by -law.
Any person interested clay, within fourteen (14) days
after the 10th day of June 19651 send by registered mail or
deliver to the Clerk of the Town of Bowmanville notice of his
objection to approval of the said by -law together with a state-
ment of the grounds of such objection.
The Ontario Municipal Board may approve of the said by-
law but before doing so it may appoint a time and Place when any
objection to the by -law will be considered. Notice of any hearing
that may be held will be given only to persons who have filed an
objection.
The last date for filing objections will be June 251 1965&

EXPLANATION OF THE PURPOSE AIM EFV17,CT OF BY -LAW
NO. 1936 OF THE TOWN OF BOWMANVILLE
Paragraph 1, simply expends the "Public Use" provisions as set
out in Paragraph 7 (A) in the original zoning by -law relating to
General Regulations in all Zones. The original by -law provided
for a use of land as public or community parks, playground or
highway, while the amending by -law now expands this use provision
to include all purposes of the public service of The Town of Bow -
manville, or local Board thereof, telephone or telegraph company
or Department or Commission of the Government of Ontario or of
Canada. It is provided that where the land, building or structure
concerned is located in a residential or commercial zone there shall
be no open storage, lot coverage and yard regulations shall be
adhered to and any buildings shall be in general harmony with other
buildings of the zone and that where there are buildings in a
light or heavy industrial zone or a rural zone the lot coverage
and yard regulations only shall apply.
Paragraph 2 of by -law 1936 amends the minimum yard requirements
in a rural zone so that the front yard for a dwelling remains at
40 feet while for other buildings it is decreased from 100 feet
to 75 feet and the side yard requirement for dwellings remains at
20 feet while for all other buildings the requirement is reduced
from 100 feet to 25 feet except on corner lots where the require-
ment, is to be 75 feet.
Both amending paragraphs number 1 and 2 of by -law 1936 effect
all lands within the Town of Bowrianville.
