7. Presentations
7.1 Regional Chair John Henry - Annual Address
John Henry, Regional Chair, Regional Municipality of Durham, was present via
electronic means to address the Members of Council and citizens on 2020 Regional
activities and provided an overview of the 2020 Regional initiatives. He made a
verbal presentation to accompany a video. Chair Henry thanked the Members of
Council for the opportunity to provide the presentation and the Mayor and Regional
Councillor's for being on the Regional Committees. Chair Henry highlighted the key
accomplishments in Clarington which included the GO Lakeshore East Extension
becoming closer to a reality, Durham Region Transit On Demand Services, Durham
Region Farm Fresh supporting agriculture communities, and recent announcements
for Provincial and Federal funding for broadband improvements to improve
broadband throughout the Region. He noted that this is the first year that the
annual update is coming in the form of a video and stated that he hoped everyone
enjoys the presentation Link to Video Presentation. Chair Henry thanked the
Bowmanville Hospital for working towards the potential expansion along with
Clarington Hospice. He added that Clarington is still very much open for
business. Chair Henry concluded by thanking the first responders, day care and
health care workers and the Clarington residents for following the regulations for
COVID-19. He encouraged the residents to continue to shop local and order curb
side pick ups whenever possible. Chair Henry thanked the Member of Council and
wished everyone all the best for the holiday season.

8. Delegations
8.1 Laurel Kahler regarding Agenda Item 14.1, Reducing the Speed Limit in the
Northglen Community
Laurel Kahler was present via electronic means regarding Agenda Item 14.1,
reducing the Speed Limit in the Northglen Community. She explained that she
moved from Toronto to Bowmanville and quickly discovered that the speeding in
her neighbourhood was an issue. Ms. Kahler noted that she has been in contact
with Members of Council and Staff. She was provided a Traffic Study from
February 2019 which she believes it no longer valid. Ms. Kahler explained that
Staff advised her that a By-law would be required to lower the speed limit. She
noted that there are no stop signs on her street which results in excessive
speeding. Ms. Kahler believes the 50 kilometers per hour in a residential area is
too high and would like to see the speed limits lowered to 35 or 40 kilometers per
hour. She continued by requesting that speed bumps and stop signs be installed
on William Fair Drive, that there be a dedicated school bus zone, lines painted on
the road at the stop signs on Kenneth Cole Drive, and an updated Traffic
Study. Ms. Kahler concluded that, 15 months after her initial request, she has been
advised a video speed sign will be installed on William Fair Drive. She answered
questions from the Members of Council.
8.2 Laura Markovic regarding Public Access to Municipal Property east of Mearns
Avenue at Longworth Avenue (Agenda Item 13.3)
Laura Markovic was present via electronic means regarding Public Access to
Municipal Property east of Mearns Avenue at Longworth Avenue. She advised
Council that she is a local resident and expressed her concerns regarding a matter
that was brought before Council at the September 28, 2020 General Government
Committee meeting which resulted in a fence being installed at the east end of
Longworth Avenue. Ms. Markovic noted that the majority of the residents in the
area do not support the decision to install the fence and feels the decision was
made based on the request of two homeowners. She responded to the concerns
raised by some of the residents which included garbage, parties, access to the
storm water pond, trespassing and ATV's being used in the area. Ms. Markovic
explained that this area is used and maintained by many of the area residents as an
unofficial trail and they take pride in the care of this greenspace. She believes
fencing off the area will result in teenagers taking the train tracks and noted that she
has never been disturbed by any parties being held in this area. Ms. Markovic is
concerned that a decision was made basis of the opinions of two of the 22
homeowners in the area.

Ms. Markovic continued by listing her recommendations for the fence at the east of
Longworth Avenue:
Open the entrance at Longworth Avenue and remove the trespassing signs
Remove the fencing entirely
Repair the fence along the train tracks
Install no dumping signs
Install storm water pond warning signs
Install no motorized vehicle signs
Install LED light posts at the entrances
Plant trees for privacy
Install signs advising to keep pets on leashes
She concluded by asking the Members of Council to consider these requests. Ms.
Markovic answered questions from the Member of Council.
8.3 Carl Van Belle regarding Agenda Item 13.1 - Proposed Motion to Remove the
Greenbelt Condition on Ministerial Zoning Order for 2423 Rundle Road,
Bowmanville
Carl Van Belle was present via electronic means regarding the Proposed Motion to
Remove the Greenbelt Condition on Ministerial Zoning Order for 2423 Rundle
Road, Bowmanville. He explained that he is the owner of Van Belle's and lives
directly beside his business. Mr. Van Belle advised that they received notice to
provide comments regarding a proposed Ministerial Zoning Order for 2423 Rundle
Road, Bowmanville. He added that he then proceeded to speak to both Staff and a
Member of Council. Mr. Van Belle explained that, after speaking with Staff, he felt
his questions were answered sufficiently and did not feel the need to attend the
meeting. He continued by stating that, after the meeting, he was advised additional
amendments were added to review and include this area in the Greenbelt. Mr. Van
Belle stated that, after he received this information, he called his local Councillors
and the Mayor and was advised that this resolution was sent to Minister Steve
Clark. He was advised that this was only a review but still has concerns that 200+
properties were added in one zoning change. Mr. Van Belle expressed his concerns
with transparency and accountability and believes they were not given enough time
to digest the amendment. He added that proper notice and consultation should
have been given. Mr. Van Belle explained that a meeting of the homeowners took
place and a petition of the homeowners concerns was submitted to the

Municipality. He stated that Staff have a responsibility to consult with the property
owners and that he believes that the properties being added to the Greenbelt will
limit existing property owners. Mr. Van Belle concluded by asking for the letter to
the Minister to be recalled and for Paragraph three to be deleted.
8.4 Jim Hamilton regarding Agenda Item 13.1 - Proposed Motion to Remove the
Greenbelt Condition on Ministerial Zoning Order for 2423 Rundle Road,
Bowmanville
Jim Hamilton was present via electronic means regarding Agenda the Proposed
Motion to Remove the Greenbelt Condition on Ministerial Zoning Order for 2423
Rundle Road, Bowmanville. He explained that he is the owner of Welcome Feeds
and has been at their current location for 11 years after applying for a Zoning
By-law amendment. Mr. Hamilton is asking for Paragraph 3 to be rescinded and for
the Ministerial Zoning Order (MZO) to be resubmitted with no amendments. He
stated that he is concerned with the lack of public consultation, transparency and
public consultation and does not feel that 200+ properties should be impacted by
this MZO. Mr. Hamilton added that if the Greenbelt co ndition is added it will
drastically reduce the property values. He concluded by asking the Members of
Council to reconsider the MZO without any amendments. Mr. Hamilton answered
questions from the Member of Council.
8.5 Dave Bass regarding Reducing the Speed Limits Residential Streets
Dave Bass was present via electronic means regarding reducing speed limits on
residential streets. He thanked the Members of Council for allowing him to speak
as a delegation. Mr. Bass explained that he is asking for the speed limit to be
reduced on Granville Drive in Courtice. He explained that this is a newer
community and the speeding has become increasingly worse since 2014. Mr. Bass
explained that an electronic speed sign with temporarily installed but he does not
believe the results were accurate as it stated the average speed was 36 kilometers
per hour. He noted the residents in the area are concerned with speeding and they
have tried to install their own signs, which were removed. Ms. Bass explained they
have tried to speak to their neighbours and even park on the road to make people
slow down. He requested that a stop sign be installed at William Ingles Drive and
Granville Drive. Mr. Bass believes that putting up stop signs and posting a lower
speed limit will help to reduce the speed. He concluded by advising the Members of
Council that these changes will reduce speeding in the area and prevent any
accidents. Mr. Bass answered questions from the Member of Council.

13.3 Motion to Amend Something Previously Adopted (Proposed Motion
Regarding Public Access to Municipal Property)

That, in accordance with subsection 10.12.17 of the Procedural By-Law, Resolution
#GG-325-20 from the General Government Committee meeting of September 28,
2020, regarding public access to municipal property east of Mearns Avenue at
Longworth Avenue, previously adopted by Council at the Council Meeting of
November 2, 2020, be amended to replace Paragraph 6, which reads:
“That Staff install signage, similar to the signage in place on the fence at
Mearns/Longworth, indicating the property is Municipal/EP property and
that no trespassing is permitted;”
With the following paragraphs:
“That the gate be removed from the chain link fence installed at the
terminus of Longworth Avenue, east of Crough Street;
That Public Works Staff be directed to install a removable bollard inside
the opening in the chain link fence to deter entry by motorized vehicles;
That existing signage posted on the chain link fence be removed and
replaced with signage to indicate that motorized vehicles are prohibited,
and users enter at their own risk;”

That, in accordance with subsection 10.12.17 of the Procedural By-Law, Resolution
#C-418-20, regarding Council’s support of the Ministerial Zoning Order to change
the zoning of 2423 Rundle Road Bowmanville, previously adopted by Council at the
Special Council Meeting of October 26, 2020, be amended to delete Paragraph 3,
which reads:
“That the Province commit to reviewing the lands south of
Highway 2 between Hwy 418 and Maple Grove Road for inclusion in
the Greenbelt based on their contributions to the systems of
agriculture, natural heritage and water resources”
That the Minister of Municipal Affairs and Housing be advised of:
(i) the foregoing deletion;
(ii) that the letter dated October 27, 2020 which was forwarded to the
Minister regarding Resolution C-418-20 is withdrawn and rescinded;
and
(iii) a replacement letter be sent advising the Minister of Resolution C -418-
20, but not containing the language in the foregoing paragraph
requesting the Province to review the said lands for inclusion in the
Greenbelt.

Special Council Meeting of October 26, 2020, be amended to remove the
conditions of support by deleting Paragraphs 2, and 4, which read:
That the applicant carrying out the necessary studies and implementing the
recommended works from:
Traffic Study;
Hydrological/Hydrogeological study;
Environmental Impact Study;
Servicing Study; and
Storm water management plan;
That should the Bowmanville site be redeveloped, the applicant commit that 25% of
the units be developed as affordable housing units (for low income families).
That the Minister of Municipal Affairs and Housing be advised of:
(i) the foregoing deletion;
(ii) that the letter dated October 27, 2020 which was forwarded to the
Minister regarding Resolution C-418-20 is withdrawn and rescinded;
and

I support a motion to recommence the work being done on the review of environmentally protected
lands(EP) in rural Clarington. I support Official Plan mapping that is limited to provincially required
EP land. I support full and comprehensive notification to property owners to ensure transparency
and accountability.
I urge Council to follow the lessons learned from East Gwillimbury and support Councilor Neal with
his proposal to a resolution for this matter.
Reasons:
The mapping is wrong, and an overreach;
Stressful, hard on people;.
In the upcoming election cycles you need to be seen as on the side of reasonableness and fairness.
What needs to be done next:
Correct mapping, remove overreach.
Make mapping available, even as it is being developed. Good staff resources to do this.
I would be glad to help with some design refinements on the presentation of the various mapping
elements.

White Owl Properties Limited
White Owl Properties Limited (formerly Miller Group) own the subject lands at 1100 Hancock
Road in the Municipality of Clarington (Community of Courtice). A portion of the subject lands
is used as an organic and wood waste composting and processing facility. A portion at the
south end of the property is located within the Courtice Employment Secondary Plan Study
area.
The property is also in proximity to the Southeast Courtice Secondary Plan Area.
Macaulay Shiomi Howson Ltd. are planning consultants for White Owl, who have an interest
in both the Secondary Plan processes that are underway. White Owl has been recently
contacted by the Mayor’s office to discuss concerns about odour related to the organic and
wood waste composting and processing facility (the ‘facility’). These concerns are coming
from the existing community in Courtice. The future development in the Southeast Secondary
Plan Area proposes to bring residential uses in closer proximity to the facility, which may only
lead to additional or greater odour concerns.
On behalf of White Owl, we would like to outline our first and main concern related to the
planning processes. The composting and processing facility provides a service to the
community, which can produce odour, noise and other environmental factors. As demand and
waste diversion efforts increase, it may be necessary to not only maintain a higher level of
service or intensity of operations at the facility but it may also result in capacity constraints,
which may require an expansion of the facility.
We would like to ensure that these planning processes take into account the existing and
potential future expansion of this facility. While White Owl is not opposed to development
within the Secondary Plan Areas, it is our belief that additional policies may be mutually
beneficial to both the Municipality and White Owl.
On September 18, 2020, a letter was provided to the Planning Department with comments
and a recommendation that certain policies (noted below) be added to Section 10
Implementation and Interpretation:

10.XX Organic and Wood Waste Composting and Processing Facility
10.XX.1 Applications for development in the Southeast Courtice Secondary Plan Area shall
be accompanied by supporting reports or studies outlining the potential noise, vibration and
odour factors related to the Organic and Wood Waste Composting and Processing Facility
located at 1100 Hancock Road, in proximity to the Secondary Plan Area.
10.XX.2 The Municipality of Clarington shall require the appropriate warning clauses related
to noise, vibration and odour – related to the Organic and Wood Waste Composting and
Processing Facility - be incorporated into subdivision agreements or purchase and sale
agreements, to the satisfaction of the Municipality.
10.XX.3 The warning clauses noted above may include provisions regarding the current
operations at the Organic and Wood Waste Composting and Processing Facility and any
potential future increases in operation or physical expansion.
We have review the draft Secondary Plan and note that the following policy appears to have
been added to at least partially deal with the concerns noted above:
5.5.3 Applications for new development may be required to undertake studies to
ensure compatibility with uses adjacent or in the vicinity in accordance with the
Province’s D-6 Series Guidelines, addressing such adverse impacts as noise,
vibration, dust and odour or the location of industrial facilities on adjacent
employment lands.
While we appreciate that this new clause has been added, we are still of the opinion that a
policy related to ‘warning clauses’ should still be added to the Secondary Plan. This could
include wording like the following:
5.5.3 (a) where impact studies have outlined a requirement for mitigation measures
to deal with land use compatibility, the mitigation measures shall be undertaken to
the satisfaction of the Municipality and warning clauses may be included in the
subdivision agreement and/or purchase and sale agreements, as deemed
necessary by the Municipality.
Generally, White Owl would like to support the Municipality in its planning endeavors,
however, reducing land use conflicts is of importance and should be taken into account. We
believe that the proposed policy is mutually beneficial to White Owl and the Municipality and
should be included in the final Secondary Plan.

Our property, Durham Farms Ltd is directly affected by the new zoning recommendations and I firmly oppose the
proposed rezoning , it’s lack of due process, lack of forethought as to the effects to adjacent land accesses, It’s heavy
handed approach clearly demonstrates a lack of proper conference from landholders, stakeholders and the like, and
we demand some explanation as to the lack of communication and back door approach initially.
The backlash to this proposal, the defeat of similar proposals in adjacent communities, stands as an example as to

These types of plans should take years to develop, with proper consultation from those whom these decisions affect.

I believe the existing EP area makes sense in my location along a portion of Bowmanville
Creek by using the high water mark of Hurricane Hazel.
The review needs to not include unreasonable amounts of property outside of the existing EP
area.
I had approval from CLOCA to build my home and garage even though just outside the EP
area and that was fine.
According to your new proposal I would need to build in the middle of a field 150 Yrds from
any creek which makes no sense when my existing home is twenty five ft above the water line
already.
I do believe there must be rules but there needs to also be common sense.
The devaluation of my property if proposed plan goes through would be terrible.

Greetings Council. I have been a resident, tax payer and voter here for 35 years now. I have
made a considerable investment in this area and in this property, far too much to see it
eroded away by some idiotic policy change. I feel conservation concerns have been well

Enclosed is a picture from my house. As you can see, the 407 and 407 maintenance building are
quite close.
I own my home and property in Hampton. I have a little less than 10 acres of land zoned
agriculture.
The farm adjoining mine was expropriated and the 407 and 407 maintenance building was built.
My question is ... how can a major highway and a huge ugly maintenance shed be built on my direct
neighbouring lot without any regard for the environment and then try to force detrimental zoning
changes on me?
I have no water flowing through my land, so my land is not essential to the watershed.
I believe that I should not be treated any worse than my neighbors... the 407 and their huge ugly
maintenance shed that was recently built on on land that had to as environmentally sensitive as
mine!
Somehow the proposed changes stop at my property line, I have many close neighbors to the

south and west. None of these people are affected by your environment restrictions.
My mailing address is 95 Perry ave Hampton. If you can pull up a map outline our property to
illustrate to council how incredibly wrong and unfair it would be to impose this rezoning on us.

I support a motion to recommence the work that was being done on the review of the Environmentally
Protected (EP) lands in rural Clarington, so that we may all work together in a supportive and positive

I support the Official Plan Mapping that is limited to the provincially required EP lands, so that our family
and our future generations may continue to be the great caretakers of our precious sacred lands,
without fear of interference.
I also support full and comprehensive notification to All rural landowners and farmers to ensure true
transparency and accountability to the residents represented by Mayor Foster, Clarington Council and

I live in Mitchell’s Corners and was very disappointed when I learned of the land grab by the Environmental
Council/Board. My land is already under my stewardship and I take that job very seriously. It is protected and
maintained by me. I do not need any government bureaucracies taking it over and doing it for me. This is a big
issue for me. If you feel the necessity to do so I will pursue a corresponding deduction in my taxes since I will not
own 50% of my land. It will also affect my ballot in the next election along with others that I will convince to do
also.

Hello I hope this finds you in time. My name is Kevin Nyberg and I live at 4045 Highway 2
Newcastle Ontario L1b0r4.
I strongly urge you to please review the EP lands being discussed here in rural
Clairington on December 14th 2020 because this decision affects my entire family today
and also there future.
First off my wife and I bought this land to possibly retire early and start a hobby farm
to help supplement our reduced income plus have a couple animals to help with grocery
costs. With the EP land my 73 acres goes down to a merely 1 acre of agricultural not
even enough for a small garden and a chicken coop.
Second we have land on Brownsville that currently is already under the current zoning
already parcelled of as residential we were going to gift to our children to help them
with there future but now that land is also being taking away from us and them to
become EP lands I don’t get it!.
Third we have 100’s of apple trees on the land that were from the previous owners
that have not been taken care of and if not acted on soon will die I find it a waste of the
land to not save them. We also have 2 clearings in the back approximately 15 acres that
is clear land which is also being affected someone needs to come look or at least contact
the owners before this zoning is changed!.

considered for Greenbelt Expansion. We would like council to listen to the concerns of the residents of this area
prior to any recommendation to expand the Greenbelt here.
As farmers in the study area, we have seen many changes in the past few years - Holt Road bridge construction
making a full cloverleaf at the 401, doubling the traffic, the construction of the 418 feeder road to the 407 and all the
new over and under passes on local roads in the area, OPG's proposed expansion are just a few projects that
contribute a concerning danger for our farm machinery road travel. This area is certainly not what it was and
continues to change. Traffic volumes continue to increase in the area which make it difficult and dangerous for
farming here.
Farm land preservation is a huge priority for us but the planning that has happened to our area in and around Holt
Road south of Hwy 2 over the years has led to a less than idyllic life for those of us who try to farm here.
We are requesting that this Special Study Area 2, with any reference to Greenbelt expansion, be removed from the
Clarington Official Town Plan unless someone can convince us that it would be advantageous to us as landowners.

should be a time line in being able to voice our objection

3. Manager’s Report – Safety: Bryan presented the Board with an Incident Report: A bantam
aged player was injured Sunday November 8th. He was tended to on ice and an ambulance
was called. First Aid Certificates were extended to June 2021. He will schedule first aid and
defibrillator courses for staff in 2021. Bryan will draft “COVID Outage Protocols” for the
next board meeting. Risk Management: The question was brought up: what about clients
waiting outside during inclement weather – the Board decided no action was needed as
clients can wait in their vehicles. Bryan will monitor what other arenas are doing. Rentals:
Family skates and birthday parties: after much discussion, we maintain the following: i)
Instructional” activities only; ii) maximum 20 people; iii) same Health Group/organizations;

Manager’s Report cont’d:
Staff: Bryan reported his staff have done a great job with all the protocols in place and they
are addressing any issues.
Inspections: Cimcoe performed all safety checks in compressor room and all are in line
with TSSA regulations. Also, CSABS2 – who is responsible and how often is this
required?
Complaints: We only have one (1) ref change room. Bryan has made changes so there is
an area for both refs while maintaining social distancing. Other: Parking Lot Lights: Not
on, which is causing a tripping hazard. Bryan will follow up and have them working
ASAP. Will follow up to see if we can improve the quality of lighting in the parking lot.
4. Financial Report – Todd revised the update and anticipated we will have a $35K
Operating Loss for the fiscal year end 2020, plus the replacement of the lobby floor,
increasing our loss to $55K. Todd is working on the 2021 Budget.
5. New Business – COVID Update: Wheelchair designation parking spots were reopened.
IB Storey Report: The Board reviewed the report in detail and questioned who is
responsible for what inspections and asked who and how often will the CSABS2 Report be
required? Advertising: Futures Sign – we concluded that we require more information and
deferred it to the next meeting. A sub committee consisting of Sue White, Gary Oliver and
Shane Armstrong will look at advertising ideas. Projects/Rob’s List: Reviewed the list of
projects from the Municipality and discussed dates for completion. Website: We now have
ownership of the domain name for the website. Beacon Solutions will be looking after
maintaining and updating the website.
Christmas Dinner/Meeting: Due to COVID restrictions we will forgo the traditional dinner
meeting and will meet at the arena for our regular meeting.

2.1. Inclusive Communities Grant
Erica Mittag shared that the Inclusive Communities Grant was recently launched.
This program looks at projects and initiatives that help improve accessibility for
seniors and people with disabilities. The Municipality of Clarington is looking to
submit an application for the installation of charging stations for mobility devices
along paths, trails and in parks across Clarington. The hope is this will support
more people in becoming active and using the paths, trails and parks in our
community. This is a one-time grant funding program with projects beginning
February / March 2021 and completion by March 2022. Some locations could

use existing power from a nearby source; others may require solar powered
options. The Accessibility Advisory Committee will be consulted on location
selections. Councillor Janice Jones had brought a motion forward to General
Government Committee on November 30, 2020 for Council’s support of the
application. This will be ratified December 14, 2020 at Council.
The Members discussed the initiative and wondered about protection from
vandalism, seasonal components and specifics of the charging stations. Erica
indicated that City of Sarnia has launched a similar project so she will connect
with them for best practices and learnings from their experience. Other factors
mentioned will also be considered and included as part of the plan. The
Committee will be consulted on design choice for benches and structures.

11. Inclusive Communities Grant Program
Whereas the Municipality of Clarington engages with its Accessibility Advisory
Committee on matters surrounding accessibility in the community;
And whereas on November 6, 2017, through Resolution #GG -456-17, the
Municipality of Clarington endorsed Clarington’s Multi-Year Accessibility Plan 2018-
2023;

And whereas the Multi-Year Accessibility Plan 2018-2023 identifies the need to
explore the inclusion of mobility device charging stations in new and redeveloped
public spaces;
And whereas more people are participating in outdoor activities as a result of the
COVID-19 pandemic and utilizing our trails, paths and parks;
And whereas the Ministry for Seniors and Accessibility has launched an Inclusive
Communities Grant Program that supports 100% of eligible costs up to $60,000 for
programs that create more accessible environments for people of all ages, abilities
and backgrounds;
Now therefore be it resolved that the Council of the Municipality of Clarington direct
Staff to submit an application to the Inclusive Communities Grant Program for the
purpose of installing charging stations for mobility devices along paths, trails and in
parks within Clarington.
12. Request for Promotional Campaign for Durham Region Transit On
Demand for Bus Service
Whereas GO Transit has announced that the GO Bus Route 90 will be discontinued
as of Saturday, December 5;
And whereas the Municipality of Clarington has many residents who rely on the GO
Transit bus route to, and from, Newcastle;
And whereas the Region of Durham has recently instituted an On Demand bus
service which services all of Clarington’s urban and rural residents, but they may not
be aware of the service;
Now therefore be it resolved that Durham Region be urged to launch an extensive
promotion campaign of their On Demand service to ensure that all residents of
Clarington are aware of the service.
13. Elexicon
That Clarington request that Elexicon provide:
a full explanation as to the drop in revenue by $1.2M to Clarington in 20 19;
a pro forma profit and loss statement for the non -regulated entity for 2019, as
opposed to just top line revenue; and
a breakdown of the 2020 year to date revenue.

Statement condemning the display of symbols of hate in our community; and

16. 2021 CUPE Negotiations -Open Session Resolution
That the Memorandum of Understanding (MOU), attached to Report CAO -022-20 as
Attachment 1, between CUPE Local 74 –Outside Bargaining Unit and the
Municipality of Clarington be approved to extend all the terms and conditions for the
Outside Bargaining Unit, for one additional year, to expire December 31, 2021;
That, consistent with past practice, student, non -permanent part-time employees and
special purpose and committee position rates be adjusted at the same rate as the
Outside CUPE employees, effective January 1 or July 1, as appropriate for each
group, and as included in the annual budget;
That, consistent with past practice, the terms and conditions of employment for
unionized employees as provided for under the extension MOU, be approved for
non-affiliated employees; and
That CUPE Local 74 Executive be thanked for their continued efforts to work
effectively with the Municipality, and that they be advised of Council’s decision.

Gallagher has accepted the position of Municipal Clerk, effective November 16, 2020.
1.2 After a successful recruitment process, John Paul (JP) Newman has accepted the
position of Deputy Clerk, effective January 4, 2020. JP comes to Clarington with a vast
amount of experience, including most recently at the Township of Scugog as
Clerk/Director of Corporate Services.
1.3 In order to complete the appointment, Staff are recommending the passage of the
attached draft by-law appointing John Paul Newman effective January 4, 2021.

Whereas subsection 228(2) of the Municipal Act, 2001 grants the Municipality the authority to

1. That Staff be directed to bring forth a zoning by-law amendment which:
(i) Retains the EP zoning in place prior to the zoning by-law review;
(ii) Includes schedules from other authorities as additional information in
the zoning by-law listing applicable land use regulations;
(iii) Contains advisories with respect to the obligations to comply with land
use controls of external agencies.
2. That Staff take all steps necessary to amend Clarington’s Official Plan (the
“OPA Amendment”) by way of a municipally initiated amendment, with the
Natural Heritage designation in Map D and Environmental Protection Area in
Map A of the Official Plan being limited to:
a. Provincially Significant Wetland;
b. Areas designated by CLOCA as being within a floodplain (red line on
CLOCA maps);
c. Areas designated by the GRCA as being within a floodplain;
d. Land designated on the current Region of Durham Official Plan, Schedule
B Map B-1 as containing Key Natural Heritage and Hydrologic Features;
e. Land which is Significant Woodland;
3. That Section 17.3 of the Official Plan Special Study Area 2 -Greenbelt
Expansion be deleted.
4. If any other amendments to the Official Plan are subsequently required as a
result of refined mapping, they shall be at no cost to the landowners for
application fees.

Motion to Amend Something Previously Adopted
Regarding Removing Conditions of Council’s Support of the Ministerial
Zoning Order to Change the Zoning of 2423 Rundle Road, Bowmanville
1. That, in accordance with subsection 10.12.17 of the Procedural By-Law,
Resolution #C-418-20, regarding Council’s support of the Ministerial
Zoning Order to change the zoning of 2423 Rundle Road Bowmanville,
previously adopted by Council at the Special Council Meeting of October
26, 2020, be amended to remove the conditions of support by deleting
Paragraphs 2, and 4, which read:
That the applicant carrying out the necessary studies and
implementing the recommended works from:
• Traffic Study;
• Hydrological/Hydrogeological study;
• Environmental Impact Study;
• Servicing Study; and
• Storm water management plan;
That should the Bowmanville site be redeveloped, the applicant
commit that 25% of the units be developed as affordable housing
units (for low income families).
2. That the Minister of Municipal Affairs and Housing be advised of:
(i) the foregoing deletion;
(ii) that the letter dated October 27, 2020 which was forwarded to the
Minister regarding Resolution C-418-20 is withdrawn and rescinded;
and
(iii) a replacement letter be sent advising the Minister of Resolution C-
418-20, as amended above.

the manner described in section 2.4 of this Report in order to clarify the
responsibilities of Department Liaisons.

1. Background
1.1 Corporate records indicate that the concept of Department Liaisons was first introduced
in Clarington in 1983 (although they were called Department Chairs until 2011 when the
Procedural By-law was changed). There is no report, resolution or direction to indicate
what the expectations of a Department Liaison could, or should, be other than the
following reference in the current Procedural By-law:
Section 5.1.1 (b) – Each Member shall be appointed as a Department Liaison as
soon as is practical after the first Meeting of Council or a vacancy occurs for
which he has been appointed Department Liaison. The Department Liaison shall
take the chair during that portion of the GG Committee or PD Committee meeting
dealing with the matters pertaining to the Department for which he has been
appointed Department Liaison.
1.2 In 2018, Council appointed Department Liaisons until December 31, 2019. In 2019,
Council appointed Department Liaisons until December 31, 2020 – hence the reason
that the matter is before Council.
1.3 As a result of the organizational changes that took effect in July 2020, staff suggested ,
in a memo that went to General Government Committee on September 14, 2020, that it
would be appropriate to pass a resolution appointing Department Liaisons based on the
new structure. Staff also suggested that because the first round of organizational
changes eliminated one department, Council should have a Councillor appointed to the
Financial Services Department rather than have that department remain as part of the
Mayor’s liaison portfolio, as has been tradition. On September 21, 2020, Council
appointed liaisons and directed that the matter be reviewed at the November 30, 2020
General Government Committee (GGC) meeting.
1.4 At the November 30, 2020 GGC meeting, Resolution #GG-437-20 was moved to
appoint liaisons for a one-year term ending December 31, 2021. That motion was
referred to December 14, 2020 Council meeting. At Committee, there were concerns
expressed regarding the need for an Emergency and Fire Services Department Liaison.
Report Overview
The following information is provided to assist Council in its deliberation of the role of
Department Liaisons.

1.5 As a result of more recent organizational changes, the Clerk’s Department is now a
division within the Legislative Service Department and the Corporate Services
Department will cease to exist effective January 1, 2021. Accordingly, effective January
1, 2021, there will be a total of seven departments: Community Services, Emergency
and Fire Services, Financial Services, Legislative Services, Office of the CAO, Planning
and Development Services, and Public Works. Resolution #GG-437-20 shows the
Mayor as having been appointed liaison to “Administration”, but consistent with all of the
organizational changes that have been made, the proper reference for purposes of
appointing Department Liaisons is “Office of the CAO”.
2. Discussion
2.1 The practice of lower tier municipalities having Department Liaisons (or Chairs) was
discussed in a recent report (November 2016) from Scugog. It included a summary of
the practices across Durham Region. The following extract is from Scugog’s report:
The practice of having Departmental Chairs adds questionable value in Scugog.
While certain departments have benefitted from having a heightened level of
attention and advocacy from their assigned member of Council, the majority of
department heads feel that this is an outdated and counterproductive governance
feature. Other municipalities have abandoned this practice for a variety of
reasons; the presence of Departmental Chairs can serve to blur the line between
the political and administrative realms, leading some to question where the line of
the department head ends, and the role of the Department Chair begins. ln
addition, the practice of rotating Chairs within GPA meetings adds unnecessary
administration and works against meeting efficiency. It is therefore recommended
that this practice be eliminated in Scugog, The GPA model is proposed to
continue with the Mayor (or in his absence, the Deputy Mayor) chairing GPA
meetings in their entirety.
2.2 In December 2018, Whitby eliminated all but one of its Department Chairs. The
following extract is from Whitby’s report to Council:
Section 2.9 of the Procedure By-law stipulates that the Mayor shall appoint six
Members of Council, excluding the Deputy Mayor, to serve as a Department
Chair for a 16 month term, with the Mayor being the chair for the Office of the
CAO and Economic Development. With the exception of the Chair of
Finance/Budget, who is responsible for overseeing the presentation of the annual
budget with the Treasurer, Department Chairs typically have not performed an
active role. As Department Chairs do not play an active role, do not have any
authority beyond that of Council, and given the few municipalities that continue to
appoint Department Chairs, it is recommended that this practice be abandoned in
Whitby, with the exception of the Chair of Finance/Budget.

2.3 In Durham Region, only Clarington and Uxbridge continue to appoint Department
Chairs.
2.4 Whether to continue with the practice of having Department Liaisons (or Chairs) is a
decision of Council. From staff’s perspective, there can be a benefit in continuing with
the practice. Department Liaisons can play a key role in reviewing and understanding a
department’s functions, business planning and budget. However, there should be a
clearer articulation of what the role entails in our corporate documents. To this end, staff
are recommending that, if Council’s desire is to continue with Department Liaisons, the
following clause should be added to Section 5.1.1 of Procedural By-law 2015-029 to
clarify the role of a Department Liaison:
(c) A Department Liaison’s primary responsibility is to maintain good
communication and relationships between Council and the Department to which
the Liaison has been appointed in the following ways:
• The Department Liaison and Director shall maintain regular communication in
areas of concern within the Department;
• The Department Liaison shall obtain information from the Director to ensure
an understanding of all reports coming from the Department for consideration
by Council; and
• The Department Liaison shall provide guidance or support to the Department
if requested by the Director.
2.5 If the role of Department Liaisons is to be preserved, staff’s recommendation is that
each of the current seven Departments have a liaison. At both the GGC meetings on
September 14, 2020 and on November 30, 2020, the need for a liaison for the
Emergency and Fire Services Department was raised. There was a suggestion that,
instead of having a liaison to this Department, Council should consider having a
councillor appointed to oversee an economic development portfolio or perhaps a
portfolio of environmental issues. In the opinion of staff, the role of a liaison to the
Emergency and Fire Services Department should continue, if for no other reason than
this Department, by comparison, has the second largest operating budget only behind
Public Works.
2.6 A separate but related issue of whether there is a need for the Director of Emergency
and Fire Services to be present (physically or virtually) at GGC and Council meetings
was raised during the GGC meetings. In the opinion of staff, the issue of attendance at
meetings extends to all departments; the issue is whether it is necessary for
Department Heads (or their designates) to be in attendance for the entiret y of our
meetings. The Acting Director of Planning and Development (or her designate) does not
attend GGC meetings unless there is an issue on the agenda that directly impacts the

Department, and even then, it is just for the portion of the meeting devoted to that issue.
Similarly, Department Heads or their designates (other than Public Works) do not attend
Planning & Development Committee meetings unless there is something on the agenda
that directly impacts their departments. In the opinion of staff, this approach should be
extended to all departments for all meetings – Department Heads (or their designates)
should only be expected to be present (physically or virtually) during those portions of
the meetings where their attendance would be required to provide input or answer
questions from Committee/Council, but otherwise to be on call. This will result in a far
more efficient utilization of senior staff time. Because this represents a fundamental
change to how our Municipality has run its meetings, direction from Council is sought.

4. Conclusion
It is respectfully recommended that Council provide direction to staff on the role of
Department Liaisons and the need for Department Heads to physically or virtually
attend committee and Council meetings.

By-law 2020-082
Being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for
the Corporation of the Municipality of Clarington
Whereas the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the Corporation of the Municipality of
Clarington for ZBA2020-0014;
Now Therefore Be It Resolved That, the Council of the Corporation of the Municipality of
Clarington enacts as follows:
1. Section 6.4.41 “SPECIAL EXCEPTIONS – AGRICULTURAL EXCEPTION
(A-41) ZONE” is hereby amended by deleting the following words:
“January 15, 2021”
And replacing them with the following words:
“December 14, 2023”
2. Schedule ‘A’ attached hereto shall form part of this By-law.
3. This By-law shall come into effect on the date of the passing hereof, subject
to the provisions of Section 34 and 39 of the Planning Act.

By-law 2020-083
Being a By-law to exempt Lot 5 of Registered Plan N632 from Part Lot Control
Whereas the Council of the Corporation of the Municipality of Clarington deems it
advisable to exempt from Part Lot Control, for Lot 5, in Plan N632 registered at the Land
Titles Division of Whitby ;
Now Therefore Be It Resolved That the Council of the Corporation of the Municipality of
Clarington enacts as follows:
1. That Subsection 5 of Section 50 of the Planning Act shall not apply to those lands
described in Paragraph 2 within the By-law.
2. That this By-law shall come into effect upon being approved by the Municipality of
Clarington and thereafter Subsection 5 of Section 50 shall cease to apply to Lot 5
in Plan N632.
3. This By-law shall only be used to create 2 single detached lots and 1 retained lot
described as Parts 1 to 3, inclusive, as follows:

Being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the
Corporation of the Municipality of Clarington
Whereas the Council of the Corporation of the Municipality of Clarington deems it advisable to
amend By-law 84-63, as amended, of the Corporation of the Municipality of Clarington to permit
the development of 1 single detached dwelling on the subject lands (ZBA2020-0012);
Now Therefore Be It Resolved That the Council of the Corporation of the Municipality of
Clarington enacts as follows:
1. Schedule ‘4’ to By-law 84-63, as amended, is hereby further amended by changing the
zone designation from
“Holding – Urban Residential ((H)R2-24) Zone” to “Urban Residential (R2-24) Zone”;
as illustrated on the attached Schedule “A” hereto.
2. Schedule “A” attached hereto shall form part of the By-law.
3. This By-law shall come into effect on the date of passing hereof, subject to the
provisions of Sections 34 and 36 of the Planning Act.

Now Therefore Be It Resolved That the Council of the Corporation of the Municipality of
Clarington enacts as follows:
