BY-LAW NO. 99-120
Being a by-law to stop-up and close and authorize the conveyance of part of the
unopened road allowance between Lots 2 and 3, Concession 4, former
Township of Darlington
WHEREAS Council at its meeting of June 14, 1999, passed Resolution#GPA-315-99
which authorized the advertisement of a Public Hearing, as required by the Municipal
Act, to stop up and close and authorize the conveyance of part of the unopened road
allowance between Lots 2 and 3, Concession 4, former Township of Darlington,
described as Parts 1, 2 & 3, Plan 40R-19013;
WHEREAS Council at its meeting of June 14, 1999, approved the recommendations in
Report WD-26-99 which declared Parts 1, 2 &3 to be surplus property;
WHEREAS Debra Lei Nixon, abutting property owner on the east side of Part 1, Plan
40R19013 signed a Waiver and relinquished the first right of refusal to purchase the
east half of the subject part of the road allowance to be closed and conveyed;
WHEREAS Council approved the recommendations in Report WD-26-99 and
established the selling price and authorized the conveyance of surplus lands as follows:
Parts 1 & 2 - $11,525 - Crooked Creek Golf Club Limited
Part 3 - $ 550 - Peter and Joan Tax
WHEREAS the notice of the Public Meeting to be held by Council to consider this by-
law was advertised in the local newspaper on June 16, 23, 30 and July 7, 1999;
WHEREAS notice of Council's intention was sent to the Regional Municipality of
Durham by Registered Mail on June 15, 1999 and approval was received by the
Municipal Clerk by Registered Mail on June 25, 1999; and
NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE
CORPORATION OF THE MUNICIPALITY OF CLARINGTON that part of the
unopened road allowance between Lots 2 and 3, Concession 4, former Township of
Darlington, described as Parts 1, 2 & 3, Plan 40R19013, are hereby stopped up, closed
and authorized to be conveyed.
