HomeMy WebLinkAbout2000-125 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 2000-125 Being a by-law to authorize the sale and transfer to Blue Circle Canada Inc. of easements in Parts 2, 4, 5, 9, 10, 12, 15, 17 and 18 of Reference Plan 40R-19943, and subject to these easements,to authorize the sale and transfer to Central Lake Ontario Conservation Authority of Parts 2, 3, 4, 5, 6, 8, 9, 10, 11, 12, 15, 16, 17, 18 and 19 on Reference Plan 40R-19843 WHEREAS at its meeting on September 25, 2000, Council of the Municipality of Clarington passed By-law No. 2000-124 declaring Parts 2, 3, 4, 5, 6, 8, 9, 10, 11, 12, 15, 16, 17, 18 and 19 on Reference Plan 40R-19843 to be surplus; AND WHEREAS at its meeting on September 25, 2000, Council of the Municipality of Clarington passed By-law No. 2000-123 stopping up and closing as a public highway Parts 8, 9, 10, 11 and 12 on Reference Plan 40R-19843; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON ENACTS AS FOLLOWS: 1. The sale and transfer to Blue Circle Canada Inc. of a perpetual easements in the lands more particularly described as Parts 5, 9 and 18 on Reference Plan 40R-19843 for the purposes constructing, operating, maintaining and repairing thereon a portion of an overflow channel and permitting Blue Circle Canada Inc., its officers, employees, contractors, agents and licenses,pedestrian, equipment and motor vehicle access to the aforesaid Parts 5, 9 and 18 for such purposes, is hereby approved. 2. The sale and transfer to Blue Circle Canada Inc. of a perpetual easement in lands more particularly described as Parts 2, 12 and 15 on Reference Plan 40R-19843 for the purposes of constructing, operating, maintaining and repairing thereon an acoustic berm and permitting Blue Circle Canada Inc., its officers, employees, contractors, agents and licenses, pedestrian, equipment and motor vehicle access to the aforesaid Parts 2, 12 and 15 for such purposes, is hereby approved. 3. The sale and transfer to Blue Circle Canada Inc. of a perpetual easement in lands more particularly described as Parts 4, 10 and 17 on Reference Plan 40R-19843 permitting Blue Circle Canada Inc., its officers, employees, contractors, agents and licenses,pedestrian, equipment and motor vehicle access to and from Parts 23, 24, 25, 26, 27 and 28 on Reference Plan 40R-19843 and Part 2 and 3 on Reference Plan 40R-19842, is hereby approved. 4. The sale and transfer to Central Lake Ontario Conservation Authority, subject to the easements referred to in paragraphs 1, 2 and 3, of the interest in fee simply in the lands more particularly described as Parts 2, 3, 4, 5, 6, 8, 9, 10, 11, 12, 15, 16, 17, 18 and 19 on Reference Plan 40R-19843, is hereby approved. 5. The Mayor and Clerk are authorized on behalf of the Municipality to execute and deliver the transfers necessary to implement paragraphs 1, 2, 3 and 4 of this By-law.
