By-Law No. 2000- 150
Being a By-Law to establish Reserve Funds
For Development Charges—Imposed by
By-Law No. 2000-108 and to Repeal
By-Law No. 99-142
WHEREAS, the Council of the Corporation of the Municipality of Clarington passed By-
Law No. 2000-108 to impose development charges under the Development Charges Act,
197, S.O. 1997, c.27;
AND WHEREAS under Section 34 of the Development Charges Act, 1997, the
Municipality is required to establish a separate reserve fund for each service to which the
development charges relates;
AND WHEREAS Council passed By-Law No. 99-142 to establish separate reserve funds
for the services to which the development charges relates;
AND WHEREAS Council considers it desirable to change the names of the reserve funds
established by By-Law No. 99-142 and expedient to repeal By-Law No. 99-142 and to
replace it with this By-Law.
1. THAT By-Law No. 99-142 is repealed.
2. THAT the following reserve funds are hereby established:
a) General Government(including financing);
b) Library Services;
C) Fire Protection Services;
d) Indoor Recreation;
e) Park Development and Related Facilities;
f) Public Works Department;
g) Roads and Related (including financing); and
h) Storm Water Drainage and Control Services.
3. THAT all development charges collected pursuant to the Development
Charges By-Law which identifies the quantum to be collected, be paid into
the reserve funds in accordance with the percentage applicable to each
service category specified in the prevailing Development Charges By-
Law.
4. THAT available balances remaining in the original development charges
Reserve Funds established under By-Law 99-142 and this By-Law be
transferred into the appropriate new development charges reserve funds.
5. THAT this By-Law shall take effect on August, 1, 2000.
By-Law read a first and second time this 1 ltn day of September, 2000.
By-Law read a third time and finally passed this 11th day of September, 2000.
