BY-LAW NUMBER 98-39
being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law
for the Corporation of the Municipality of Clarington.
WHEREAS the Council of the Corporation of the Municipality of Clarington deems it
advisable to amend By-law 84-63, as amended, of the former Town of Newcastle to allow
the development of an autowrecker facility within an enclosed building (DEV 97-094);
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the
Municipality of Clarington enacts as follows:
1 . Section 24.4 "SPECIAL EXCEPTIONS - GENERAL INDUSTRIAL (M2) ZONE" is
hereby amended by adding thereto, the following new Special Exception 24.4.16 as
follows:
"24.4.16 GENERAL INDUSTRIAL EXCEPTION (M2-16) ZONE
Notwithstanding the provisions of Section 24.1 and 24,3, those lands zoned (M2-
16) on the Schedules to this By-law, shall only be used for a motor vehicle
wrecking yard within an enclosed building, with no outside storage."
2. Schedule "3" to By-law 84-63 as amended, is hereby further amended by
changing the zone designation from:
"General Industrial (M2)" to "General Industrial Exception - Holding ((H)M2-16)";
as shown on the attached Schedule "A" hereto.
3. Schedule "A" attached hereto shall form part of this By-law.
4. This By-law shall come into effect on the date of the passing hereof, subject to the
provisions of Section 34 of the Planning Act.

PART LOT 8, BROKEN FRONT CONCESSION, FORMER TOWNSHIP OF

At a meeting held on February 23, 1998, the Council of the Municipality of Clarington
passed the following Resolution #GPA-98-98:
"THAT Report PD-23-97 be received;
THAT the application to amend the Comprehensive Zoning By-law 84-63 of the
former Town of Newcastle, as amended, submitted by Plantactics Group Ltd. on
behalf of Global Automotive Recycling be approved;
THAT the amending By-law attached to Report PD-23-98 be forwarded to Council
for approval;
THAT the "H" - Holding symbol in the amending By-law not be removed until
such time as the applicant has submitted an application for site plan approval and
entered into a site plan agreement with the Municipality;
THAT a copy of Report PD-23-98 and the amending By-law be forwarded to the
Region of Durham Planning Department; and
THAT all interested parties listed in Report PD-23-98 and any delegation be
advised of Council's decision."
Please be advised that By-law No. 98-39 was approved by Council and will be processed
in accordance with the provisions of the Planning Act.

Application is hereby made to exempt from Part Lot Control Lots 60 to 63, Blocks 71 to
84 all inclusive on Plan 40M-1904 and Lots 1, 2, 17 to 22, 26 to 33 all inclusive and
Blocks 63, 64 on Plan 40M-1907.
The purpose of the application is to permit the construction of eight (8) semi-detached
dwelling units and sixty (60) street townhouse units in Plan 40M-1904 and thirty-two
(32) semi-detached dwelling units in Plan 40M-1907.
The Municipality's concern with respect to the provisions of all major services are
satisfied, as are the Region's servicing requirements.
The subject lands are properly zoned. The zoning of the lands which are subject to this
application are Blocks 71 to 84 on 40M-1904 are zoned R3 and Lots 17 to 33 and Block
63 and 64 on 40M-1907 are zoned R1.
' The Municipality's solicitor has not been requested to establish that the subject lands are
part of plan of subdivision within the meaning of the Planning Act, or to establish that
the subject plan was never deemed not to be registered plan of subdivision.
For you additional information, a copy of Planning Report PD-21-98 is enclosed to assist
you in processing this application.
respectfully request that favourable consideration be given to this matter and, when
approved, that the Regional Municipality of Durham affix its approval to the certified
copies of By-law 98-38 and return two of them to this office.
We will arrange for the registration of the approved by-law immediately upon receipt of
same.

We are pleased to advise that, in accordance with By-law No. 165/83, as
amended, of the Regional Municipality of Durham and Section 50(7:1)of the
Planning Act, R.S.O. 1990, c.P.13, as amended, this part-lot control by-law
has been approved. Enclosed are two copies of the by-law bearing the
approval stamp.
In accordance with Section 50(28) of the Planning Act, R.S.O. 1990, c.P.13;
as amended, a certified copy or duplicate'of this by-law must be registered
in the Land Registry Office.
Furthermore, it is requested that once all: of the transactions have taken
place, the yy-la repealed to restore part46t control on the land.
