BY-LAW NO. 96-65
being a by-law to authorize the conveyance of part of the
closed road allowance between Lots 6 and 7, Concession 6,
former Township of Clarke, Municipality of Clarington, to
Erwin Zacharias
WHEREAS Council, at its meeting of February 26, 1996, authorized
advertisement of a Public Hearing, as required by the Municipal
Act, to convey the closed road allowance between Lots 6 and 7,
Concession 6, former Township of Clarke, designated as Part 5, Plan
40R-16671;
WHEREAS Council, at its meeting of January 8, 1996, passed By-law
No. 96-1, being a by-law to exempt a quit claim transfer of a
portion of the closed road allowance between Lots 6 and 7,
Concession 6, former Tonwship of Clarke, to the owner of the
abutting lands from the provisions of By-law No. 95-22 ;
WHEREAS Council authorized the Mayor and Clerk to execute a quit
claim transfer of the portion of the closed road allowance (closed
by By-law 1563 on October 3, 1967) , now shown as Part 5, Plan 40R-
16671, from the Municipality to Ahmad Khodkar, for nominal
consideration and subject to specified conditions;
WHEREAS notice of Council' s intention was sent to the Regional
Municipality of Durham by Registered Mail on March 19, 1996, and
approval was received by the Clerk by Registered Mail on
March 22, 1996 .
WHEREAS the notice of a Public Hearing to be held by council to
consider this by-law was advertised in the local newspaper on
February 28, March 6, 13 , 20, 1996;
NOW THEREFORE BE IT ENACTED BY THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF CLARINGTON that the closed road allowance
between Lots 6 and 7, Concession 6, former Clarke Township,
designated as Part 5, Plan 40R-16671 is hereby authorized to be
conveyed to Erwin Zacharias .
BY-LAW read a first and second time this 25th day of March, 1996 .
BY-LAW read a third time and finally passed this 25th day of March
1996 .
