By-law 96-107
being a by-law to amend the Servicing
Agreement made between the Municipality
of Clarington, Willsonia Industries
Ltd. and Clarington Place Limited
WHEREAS by By-law 94-77 passed on May 24, 1994, Council
authorized the execution of a Servicing Agreement made as of
May 24, 1994, between the Municipality of Clarington, Willsonia
Industries Ltd. and Clarington Place Limited;
WHEREAS after considering a verbal report from the Municipality' s
Solicitor, Council determined that it is expedient to amend the
aforesaid Servicing Agreement as follows :
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY
OF CLARINGTON HEREBY ENACTS AS FOLLOWS :
1 . Amendments to Article it of the Servicing Agreement made as
of May 24, 1994, between The Corporation of the Municipality
of Clarington, Willsonia Industries Ltd. and Clarington
Place Limited to:
(a) delete from paragraph 11 . 1 the figure 1121" wherever it
appears and replace it with the figure 1160" ; and
(b) add a new paragraph 11 .2 as follows :
1111 . 2 For the avoidance of doubt none of the
provisions of paragraph 11 . 1 of this
Agreement shall apply so as to require
Cineplex Odeon Corporation as lessee under a
lease from Clarington Place Limited dated
June 4, 1996 of Parts 2, 4, 8, 12, 14, 16 and
19 shown on Reference Plan 40R-16730 to enter
into a direct agreement with the Municipality
pursuant to paragraph 11 . 1. "
are hereby approved by Council .
2 . The Mayor and Clerk are hereby authorized to execute an
amending agreement to the aforesaid Servicing Agreement to
give effect to paragraph 1 hereof.
