BY-LAW 95-85
being a by-law to declare the seat of
a member of Council vacant
WHEREAS Section 43 of the Municipal Act, R.S.O. 1990, requires
that the Council of a Municipality forthwith declare the seat of
a member of Council vacant where the seat of a member of Council
becomes vacant pursuant to Section 38 of the Municipal Act,
R.S.O. 1990;
WHEREAS John O'Toole was a member of Council of the Municipality
of Clarington and a member of the Council of the Regional
Municipality of Durham for Ward 2 of the Municipality of
Clarington;
WHEREAS John O'Toole ran for election to the Legislative Assembly
of Ontario on June 8, 1995; and
WHEREAS with the publication of the election results in the
Ontario Gazette on June 17 1995, his seats on the Clarington
Council and the Regional Council, respectively, became vacant;
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF CLARINGTON:
1. THAT, in accordance with Section 43 of the Municipal Act,
R.S.O. 1990, the seats held by John O'Toole are hereby
declared to be vacant .
By-law read a first and second time this 19th day of June 1995
By-law read a third time and finally passed this 19th day of
June 1995
