CORPORATION OF THE TOWN OF NE'wCASTLE
By-law 78-4q
A By-law to amend Restricted Area By-law Number 1653 of the former
Township of Clarke, as amended,
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
advisable to amend Restricted Area By-law, Number 1653 of the former Township
of Cl&1."ke, 88 amended,
NOW '!'HI<:t(E:roRE the Council of the Corporation of the Town of Newcastle ENACTS
as follows:
1. Section 8 of By-law 1653, as amended, is hereby amended by
adding thereto the following subsection 8.3.
"8.3 Special Provisions
(a) "M1-1" Part of Lot 12. Concession 3
notwithstanding arr:f provision of this By-law to the
contrary, that part of Lot 12, Concession 3, which
is designated ''M1-1'' on the attached Schedule "X"
hereto IIl8\V' be used for no other purpose than the
sorting, cutting, indoor and outside storaee of used
rubber tires, and for an accessory single family dwelling,
provided that no buildings or stractures mq be erected,
and no land mq be used for outside storage. below the top
of bank of the Graham Creek, as dete1'm1ned by the
Ge.naraska Conservation Authority without the written
consent of the Ge.naraska Conservation Authority and
provided further that no building permit shall be issued

:in respect of the subject lands until the owner of the
said lands bas entered :into a DevelolD8I1t .Agreement, as
described :in Section 35(a) of the Pl~fng Act, with the
Corporation of the Town of Newcastle.
2. Map 2 of Schedule "A" to By-law 1653 is hereby amended by
changing to "M1-1" the zone designation of the lands shown
as "ZONE ClU1G!1 TO M1-1" on the attached Sohe<hiJ.e "xn
hereto.

3. This By-law shall come :into effect on the date hereof, subject
to receiving the approval of the Onta:rio Municipal :Boa:rd.
