THE CORPORATION OF THE TOWN OF NEWCASTLE By-Law No. 78-37 Being a by-law to stop up and close and authorize the conveyance of that portion of Carscadden Street, North of Mill Street, in the Town of Newcastle (formerly in the Village of Kendal) designated as Parts 1 and 2 on Reference Plan lOR-804 filed in the Land Registry Division of Newcastle (No. 10). WHEREAS the Council of the Corporation of the Town of Newcastle deems it desirable to pass this by-law. AND WHEREAS Notice of Intention of the Council to pass the said by-law in accordance with the requirements of Section 446 of The Municipal Act. R.S,O. 1970. Chapter 284, was published in the Orono Times on the following dates: April 5th, 1978 April 12th, 1978 April 19th, 1978 April 26th, 1978 AND WHEREAS Notice of the Intention of the Council to pas$ this by-law was sent by registered IDail to the Regional Municipality of Durham, on the 31st day of March, 1978 and the Regional Council has g~anted its approval to the proposed by-law. NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF THE CORPORATION OF THE TOWN OF NEWCASTLE AS FOLLOWS: 1. THAT portion of Carscadden Street, North of Mill Street, in the Town of Newcastle, in the Regional Municipality of Durham, (formerly in the Village of Kendal), hereinafter described be hereby stopped up and closed: ALL AND SINGULAR that certain parcel or tract of land and premises situate, lying and being in the Town of Newcastle, Regional Municipality of Durham, Province of Ontario and being composed of all that portion of Carscadden Street, North of Mill Street, according to a plan of the former Village of Kendal made by William Murdoch, P.L.S. more particularly designated as Parts One (1) and Two (2) according to a plan deposited in the Land Registry Office for the Registry Division of Newcastle (No. 10) on March 9th, 1978, as Plan 10R804. to-- . . . ~ -- By-Law No. 78-37 - 2 - 2. THAT portion of Carscadden Street hereinbefore described shall be conveyed by the Corporation of the Town of Newcastle to abutting owners.
