By-law Number 79-10
A By-law to amend By-law 77-84 of the Town of Newcastle being
a By-law to amend Restricted Area By-law Number 2111, as amended,
of the former Township of Darlington
WHEREAS the Council of the Corporation of the Town of Newcastle has
approved By-law 77-84; and
WHEREAS the Ontario Municipal Board, cognizant of the interests of the
objectors to the By-law, has expressed an unwillingness to approve By-law
77-84, as submitted, and has suggested that the Council of the Town of
Newcastle amend said By-law to apply the provisions of Section 35(a) of
the Planning Act to the subject lands.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1.
Section 1 of By-law 77-84 is hereby amended by adding thereto, after
the words "without the written consent of the Central Lake Ontario
Conservation Authority" the following:
"and provided further that no building permit shall be issued in
respect of the subject lands until the owner of the said lands has
entered into a development agreement, as described in Section 35(a)
of the PlRnning Act, with the Corporation of the Town of Newcastle."
2. This By-law shall come into effect on the date hereof, subject to
receiving the approval of the Ontario Municipal Board.
BY-LAW READ a first, second, and third time and finally passed
this 12th day of February A.D. 1979.
