HomeMy WebLinkAbout90-44 . - '" THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NO. 90-44 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By- law 84-63, as amended, of the Corporation of the Town of Newcastle to implement Applications DEV 89-57 and OPA 89-47/N; AND WHEREAS said by-law shall be passed pursuant to Section 24(2) of the Planning Act, whereby it would not come into effect until such time the appropriate Official Plan Amendment has received the necessary approvals; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 16.5.8 "Special Exceptions - General Commercial (Cl)" Zone is hereby amended by adding thereto the following new Special Exception 16.5.8 as follows: "16.5.8 GENERAL COMMERCIAL EXCEPTION (Cl-8) ZONE Notwithstanding Section 3.14 a), 3.14 d) i) and ii), 16.1, 16.2 and 16.3 those lands zoned (C1- 8) on the Schedules to this by-law may be used in accordance with the following zone regu1ations: (i) RESIDENTIAL USES i) an apartment building (ii) NON-RESIDENTIAL USES i) bakery shop ii) bank or fmancial estab1ishment, business, professional or administrative office iii) eating establishment iv) retail commercial estab1ishment v) school; commercial vi) service shop; personal For the purposes of this provision the Non-Residential Uses are to be located on the first two (2) floors of the Residential building. (iii) REGULATIONS FOR RESIDENTIAL USES a) Density (maximum) 42 units per hectare b) Yard Requirements (minimum) i) ii) iii) Exterior Sideyard Interior Side yard Rearyard Nil 8.9 metres 29.0 metres c) Dwelling Unit Area (minimum) i) ii) 1 Bedroom Dwelling Unit 2 Bedroom Dwelling Unit 75 sqtuare metres 100 sqtuare metres d) Lot Coverage (maximum) 25 percent e) Landscaping Open Space (minimum) 10 percent . - 2 - (ill) REGULATIONS FOR RESIDENTIAL USES (Cont'd) f) Building Height (maximum) 14 metres g) Off-Street Parking Spaces (minimum) 27 h) Parking Area Location on Lot i) No entrance shall be permitted within 1.2 metres of the boundary of the side yard lot line boundary of a Residential Zone. ii) Parking space setback from boundary of a Residential Zone Nil (iv) REGULATIONS FOR NON-RESIDENTIAL USES a) Yard Requirements (minimum) i) ii) ill) Exterior Sideyard Interior Sideyard Rearyard Nil 8.9 metres 29.0 metres b) Floor Area Total, Leaseable (maximum) 2200 square metres c) Off-Street Parking Spaces (minimum) 57 d) Parking Area Location on Lot i) No entrance shall be permitted within 1.2 metres of the boundary of the sideyard lot line boundary of a Residential Zone. ii) Parking space setback from boundary of a Residential Zone Nil 2. Schedule "3" to By-law 84-63, as amended, is hereby further amended by changing the zone designation from "Urban Residential Type One Exception (R1-12)" to "General Commercial Exception - Holding ((H)C1-8)" as shown on the attached Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of passing hereof, subject to the provisions of Section 34 of the Planning Act.
