THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 90- 116
being a By-law to amend By-law 84-63, the Comprehensive
Zoning By-law for the Corporation of the Town of
Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle
deems it advisable to amend By-law 84-63, as amended, of the
Corporation of the Town of Newcastle in accordance with application
DEV 89-040 and OPA 89-27/0, to permit the development of a daycare
centre.
AND WHEREAS said By-law shall be passed pursuant to Section 24(2)
of the Planning Act, whereby it would not come into effect until
such time the appropriate Official Plan Amendment has received the
necessary approvals;
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation
of the Town of Newcastle enacts as follows:
1. THAT By-law Number 90-156 be hereby repealed.
2. Section 6.1, It Agricultural (A) It zone is hereby amended by
adding thereto, the following new Special Exception 6.4 . 35 as
follows:
"AGRICULTURAL EXCEPTION (A-35) ZONE
Notwithstanding Section 6.1, those lands zoned A-35 on the
Schedules to this By-law may, in addition to a single family
dwelling, may be used for a day nursery. The placement of
buildings and structures shall be subject to the regulations
set out in Section 6.3 in respect of a single detached
dwelling.
3. Schedule "1" to By-law 84-63, as amended, is hereby further
amended by changing the zone designation from:
"Agricultural Exception (A-I)" to "Agricultural Exception
(A-35)"
4. Schedule "A" attached hereto shall form part of this By-law.
5. This By-law shall come into effect on the date of the passing
hereof, subject to the provisions of Section 34 of the Planning
Act.
