THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 90-1Z.5
being a By-law to amend By-law 84-68, the Comprehensive Zoning By-law for the Corporation of the
Town of Newcastle.
WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-
law 84-68, as amended, of the Corporation of the Town of Newcastle to implement application
DEV 90-018.
NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. Schedule 12.4 Special Exception - Urban Residential Type One (R1) is hereby amended by
adding thereto the following new Special Exception 12.4.26 as follows:
"12.4.26 URBAN RESIDENTIAL EXCEPTION (R1-26) ZONE
Notwithstanding Section 12.1, those lands zoned "Rl-26" on the Schedule to this By-law may
in addition to the other uses in the "Rl" zone, be used as a nursing home or a residence for
supervised living arrangements. For the purpose of this subsection, a residence for supervised
living arrangements shall mean a dwelling in which the proprietor and/or his agent resides and
supplies lodging including the provision of meals, and supervised care to the residents, in
rooms furnished by the proprietor with necessary furnishings in return for monetary
compensation, to a maximum of 44 persons, exclusive of the proprietor and his immediate
family. The placement of buildings and structures shall be subject to the following zone
regulations:
a)
Yard Requirements (minimum)
i) front yard
ii) rear yard
iii) interior side yard
b)
c)
Lot Coverage (maximum)
Building Height (maximum)
2 metres
18 metres
9 metres on one side
5.5 metres on the other
25 percent
10.5 metres"
2. Schedule "8" to By-law 84-68, as amended, is hereby further amended by chAnging the zone
designation from:
"Urban Residential Exception (R1-3)" to ''Urban Residential Exception (R1-26)"
8. Schedule "A" attached hereto shall form part of this By-law.
4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions
of Section 84 of the P1Al1ning Act.
