THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 88- 197
being an Interim control By-law passed pursuant to Section 37 of the
Planning Act, 1983.
WHEREAS the Council of the Corporation of the Town of Newcastle directed a
Study be undertaken for the Area which includes the Bowmanville Harbour,
the surrounding water's edge, and the general area in and around samel and
WHEREAS the Council of the Corporation of the Town of Newcastle deems it
necessary to prohibit any further use of land, or land under water,
buildings, or structures in the said areal
NOW THEREFORE the Council of the corporation of the TOwn of Newcastle
enacts as follows:
1. Notwithstanding the provisions of Comprehensive Zoning By-law
84-63, the area identified as "Land Affected by By-law" as per the
attached Schedule "A" shall be SUbject to the provisions of this Interim
Control By-law. No person shall within the "Land Affected by By-law" use
any land or land under water, building, or structure for any purpose other
than for a purpose for which the land, building or structure was lawfully
used on December 19, 1988.
2. Notwithstanding Section 1 of this By-law, a self-propelled
recreational small craft not exceeding sixty feet (60 ft) in length may be
permitted to be located, moored, or stored within the affected area.
3. Schedule "A" attached hereto shall form part of this By-law.
4. This By-law shall come into effect on the date of passing hereof,
and shall remain in effect until December 19, 1989.
