THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 87- 5
being a by-law to amend By-law 79-69 entitled
"a by-law to adopt a POlicy in respect of
Parkland Dedication in the Town of Newcastle
under Section 35 of The Planning Act
(Subdivisions) (Valley Lands)
WHEREAS the Council of the Corporation of the Town of Newcastle deems
it desireable to amend By-law 79-69 to provide for specific identification
of the valley lands that will be acquired gratuitously.
NOW THEREFORE THE COUNCIL OF THE CORPORATIONOF THE TOWN OF NEWCASTLE ENACTS
AS FOLLOWS:
1. THAT Section 2 of Schedule IIAII to By-law 79-69 is hereby
repealed and the following substituted therefore:
Section 2. IINotwi thstandi ng the above requi rements, the Town
shall require the gratuitous dedication of the valley
lands associated with the Black and Farewell Creek
systems in the Courtice Urban Area, the Bowmanville
and Soper Creek systems in the Bowmanville Urban
Area, and the Foster and Graham Creek systems in
the Newcastle Village Urban Area.
The Town may also require the gratuitous dedication
of flood susceptible lands or lands with hazardous
characteristics to the Municipality or appropriate
Conservation Authority as a condition of development
approval where such dedication is consistent with the
objectives and long term goals of such Conservation
Authori ty. II
