THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 94-59
being a by-law to declare the
seat of a member of council vacant
WHEREAS Section 43 of the Municipal Act, R.S.O. 1990, requires
that the Council of a Municipality forthwith declare the seat of
a member of Council vacant where the seat of a member of Council
becomes vacant pursuant to Section 38 of the Municipal Act,
R.S.O 1990i
WHEREAS the late Councillor Kenneth G. Hooper was a member of
Council of the Municipality of Clarington and a member of the
Council of the Regional Municipality of Durham for Ward 2 of the
Municipality of Claringtoni and
WHEREAS with the passing of Councillor Hooper on Wednesday,
March 30, 1994, his seats on the Clarington Council and the
Regional Council, respectively, became vacanti
NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CORPORATION OF
THE MUNICIPALITY OF CLARINGTON:
1. THAT, in accordance with Section 43 of the Municipal Act,
R.S.O. 1990, the seat held by Kenneth G. Hooper is hereby
declared to be vacant.
By-law read a first and second time this 11th day of April 1994.
By-law read a third time and finally passed this 11th day of
April 1994.
