THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 94-33
being a by-law to approve a Settlement of Action
between the Corporation of the Municipality of
Clarington and Dineen Construction Limited
WHEREAS, by letter dated February 24, 1994, the Municipality's
Solicitor recommended a Settlement of Action brought against the
Corporation of the Municipality of Clarington by Dineen
Construction Limited;
NOW THEREFORE BE IT RESOLVED BY THE CORPORATION OF THE MUNICIPALITY
OF CLARINGTON:
1. THAT the Settlement of Action by Dineen Construction Limited
against the Corporation of the Municipality of Clarington, be
approved as outlined in the letter dated February 24, 1994
from the Municipality's Solicitor Dennis Hefferon, to the
Municipality of Clarington;
2. THAT the Municipality's Solicitor be authorized to take the
necessary actions to complete this transaction; and
3. THAT funds be primarily allocated from the Legal/Consulting/
Professional Fees Reserve Account #2900-26-X with any excess
to come from the Working Funds Reserve Account #2900-1-X, to
implement the Settlement of Action.
