BYL THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 94-200 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the former Town of Newcastle. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the former Town of Newcastle. NOW THEREFORE BE IT RESOLVED TIIAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. 16.5.17 GENERAL COMMERCIAL EXCEPTION (Cl-17) ZONE Notwithstanding the provisions of Sections 16.1 and 16.3, those lands zoned (Cl-17) on the schedules to this By-law shall be subject to the following zone regulations: a) Permitted Non-Residential Uses i) assembly hall; ii) bakery shop; iii) bank or financial establishment, business, professional or administration offices; iv) day nursery; v) dry cleaners distribution centre; vi) eating establishment; vii) eating establishment, take-out; viii) laundry - coin operated; ix) medical or dental clinic; x) place of entertainment; xi) printing or publishing establishment; xii) retail commercial establishment; xiii) school, commercial; xiv) service shop, light; xv) service shop, personal; xvi) shopping centre containing any of the uses listed in this section; xvii) supermarket; xviii) theatre; and xix) veterinary clinic. b) Regulations for non-residential uses a) Yard Requirements (i) setback from northerly street line of a building or structure with a minimum building facade of 45 m (min.) (max.) 7.5 m 11.0 m (ii) setback from the westerly street line of a building or structure with a minimum building facade of 45 m (min) 4.5 m (max.) 6.0 m - 2 - (iii) setback from the southerly street line (min.) 4.5 m (min.) 12.0 m (min.) 12.0 m (iv) setback from the easterly property line (v) setback from any residential zone (vi) Total floor area, leasable (max.) 8100 m2 for the purposes of this amendment, Building Facade is defined as the exterior wall of a building exposed to public view or that wall viewed by persons not within the building. 2. Schedule "4" to By-law 84-63 as amended, is hereby further amended by changing the zone designation from: "Urban Residential Exception - Holding ((H)R3-1O)" to "General Commercial Exception - Holding ((H)Cl-17)" "Urban Residential Type One (R1)" to "General Commercial Exception - Holding ( (H)Cl-17)". "Urban Residential Type One - Holding ((H)R1 Y' to "General Commercial Exception - Holding ((H)Cl-17)" "Special Purpose Commercial (C5t to "General Commercial Exception - Holding ((H)Cl-17)" as shown on the attached Schedule "A" hereto. 2. Schedule "A" attached hereto shall form part of this By-law. 3. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act.
