THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW NO. 94~177
Being a by-law to authorize the execution of
an Offer to Sell between The Corporation of
the Municipality of Clarington and Mary Jean
Burnett for the purchase of certain lands
required for the reconstruction of Lawson
Road, Courtice.
WHEREAS the Municipal Act, R.S.O. 1990, c.M.45, s.191 (1) states
that:
"The Council of every corporation may pass by-laws for
acquiring or expropriating any land required for the
purposes of the Corporation ..."; and
WHEREAS The Corporation of The Municipality of Clarington requires
certain land for the reconstruction of Lawson Road.
NOW THEREFORE BE IT ENACTED AND IT IS HEREBY ENACTED AS A BY-LAW OF
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON AS FOLLOWS:
1. THAT the Mayor and the Clerk are hereby authorized to execute,
on behalf of The Corporation of the Municipality of
Clarington, and seal with the Corporate Seal, an Offer to Sell
from Mary Jean Burnett attached hereto and marked Schedule "A"
and forming part of this By-law, that portion of Part Lot 35,
Concession 3, former Township of Darlington, described as Part
2, Plan 40R15743.
BY-LAW read a first and second time this 24th day of October, 1994.
BY-LAW read a third time and finally passed this 24th day of
October, 1994.

Dear Sir:
Re: Municipality of Clarington, Part Lot 35, Concession ID, Darlington,
Lawson Road (South Side), Burnett Property
We hereby agree to sell our property to the Municipality of Clarington as discussed in our conversation
with Totten Sims Hubicki on September 29, 1994. The parcel of property to be sold is described as
Part 2, Plan 40R15743 deposited on August 25, 1994.
The selling price has been established at $500.00. Our agreement to the conveyance is with the
understanding that all land transfer costs, ie. solicitor, legal surveys, etc. are to be paid by the
Municipality of Clarington. Permission to en~r the subject property by the Municipality of Clarington
and/or their contractors is granted, effective this date.
In the event that this transaction does not close by December 30, 1994, the Municipality shall restore the
lands to its original state within 14 days after December 30, 1994.
Please provide the undersigned with a schedule of events that will be necessary to complete this
transaction.
No statement of adjustments to be prepared with respect to this
transaction.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON accepts this OFFER and
hereby agrees to carry out the above terms and conditions.
