HomeMy WebLinkAbout93-205 • - DN: BYLAW.CBM THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW NUMBER 93- 205 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law of the former Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Municipality of Clarington deems it advisable to amend By-law 84-63, as amended, of the former Corporation of the Town of Newcastle in accordance with application DEV 88-026 to: a) permit the establishment of an Extractive Industrial use; and b) to recognize the existing single detached dwelling pursuant to Section 39 of the Planning Act 1990; AND WHEREAS the Council of the Corporation of the Municipality of Clarington in approving the application deems it appropriate to incorporate a Holding (H) symbol on part of said lands which would be removed at such time that the provisions of Section 3.9 within the Comprehensive Zoning By-law of the former Town of Newcastle have been satisfied; NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Section 25.1 'Extractive Industrial (M3)" zone is hereby amended by adding hereto the following new Special Exception 25.4.3 as follows: "25.4.3 EXTRACTIVE INDUSTRIAL EXCEPTION (M3-3) ZONE Notwithstanding Section 25.1, those lands zoned "M3-3" on the Schedules to this By-law shall permit the existing single detached dwelling. Pursuant to the requirements of Section 39 of the Planning Act, 1990, the single detached dwelling may be permitted for a period of three (3) years, ending December 13, 1996. 2. Schedule "2" to By-law 84-63 , as amended, is hereby further amended by changing the zone designation from: "Agricultural (A)" to "Holding Extractive Industrial ((H) M3)" and "Agricultural (A)" to 'Extractive Industrial Exception (M3-3)" 3. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act. BY-LAW read a first time this 13 day of December 1993.
