I Submitted By MUNICIPALITY OF CLARINGTON-LEGAL 40 Temperance St. 2012 04 12 Bowmanville L1 C 3A6 Tel 9056233379 Fax 9056236020 IFees/Taxes/Payment Statutory Registration Fee $60.00 Total Paid $60.00 I File Number Applicant Client File Number: CORRECTION TO SCHEDULE"A" BY-1" #92- 232 being a by-law to designate the property known for municipal purposes as 6720 Jewel Road, R.R. 91, Orono, Lot Z., Concession 6, former Township of Clarke, now in the Town of Newcastle as a property of historic or architectural value or interest under the Ontario Heritage Act- WHEREAS the Ontario Heritage Act, R.S.O. 1990, C.0.18 authorizes the council of the municipality to enact by-laws to designate properties to be of historic or architectural value or interest for the purposes of the Act; and IMREAS the Council of The Corporation of the Town of Newcastle has caused to be served upon the owner of the property known for municipal purposes as 6720 Jewel Road, R.R. 01, Orono, Lot 21 , Concession 6, former Township of Clarke and upon the Ontario Heritage Foundation, Notice of Intention to'Designate the aforesaid real property and has caused such Notioe of Intention to be published in the Canadian Statesman and the Newcastle independent, newspapers having general circulation im the area of the designation, once each week'for three consecutive weeks, namely May 13, May 20 and May 27, 1992; and WHEREAS the reasons for the designation of the aforesaid property under the Ontario Heritage Act are contained in Schedule "A" attached to and forming part of this by-law; and WHEREAS the Local Architegtural Conservation Advisory Committee of the Town of Newcastle has recommended that the property known for municipal purposes as 6720 Jewel Road, R.R. #1, Orono, be designated as a property of historic or architectural value or interest under the Ontario Heritage Act; and WEERFAS no notice of objection, to the proposed designation was served upon the Clerk with the period prescribed by the Ontario Heritage Act; NOW TEMPORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: 1. The property known for municipal purposes as 6720 Jewel Road, R.R. 41, Orono, which is more particularly described in Schedule ITB" which is attached to and forms part of this by-law, is hereby designated as a property which has historic or architectural value or interest under Section 29 Of the Ontario Heritage Acct, R.S.O. 1990, 0.0.18. 2. The Solicitor for the Town of Newcastle is hereby authorized to cause a copy of this by-law to be registered against the title to the property described in Schedule "B" hereto. The Town Clerk is hereby authorized to cause a copy of this by-law to be served upon the owner of the property described in Schedule "B" hereto and on the Ontario Heritage Foundation. The Town Clerk also is authorized to cause notice of the passing of this by-law to be published in the Canadian. Statesman and the Newcastle Independent, newspapers having general circulation in the area of the designation, once each week for three consecutive weeks- By-law read a first and second time this 14th day of December 1992. By-law read a third time and finally passed this 14th day of December 1992. Paragraph 2 (1)(c) of the Regional Municipality of Durham Act, 1973, S. O. 1973 c. 78 amalgamated The Corporation of the Town of Bowmanville, The Corporation of the Village of Newcastle, The Corporation of the Township of Clarke and The Corporation of the Township of Darlington as a town municipality bearing the name The Corporation of the Town of Newcastle on January 1, 1974- The Corporation of the Town of Newcastle therefore became the successor in law of The Corporation of the Township of Clarke on January 1, 1974. By subsection 1(2) of the Regional Municipality of Durham Amendment Act (Newcastle- Clarington), 1993, S. O. 1993 c. 3, on July 1, 1993, The Corporation of the Town of Newcastle was continued as a town municipality under the name of The Corporation of the Municipality of Clarington. Subsection 4(1) of this Act deemed all references to The Corporation of the Town of Newcastle or to the Town of Newcastle in any other Act, regulation, by-law, resolution, agreement or other document to be references to The Corporation of the Municipality of Clarington and to the Municipality of Clarington respectively. To replace Schedule "A" as attached to Instrument DR1042347 SCHEDULE "K 6720 Jewel Road, Concession 6, Township of Clarke, was built for John Galbraith and Flora MacConnachie circa 1856. This structure known as Floradale, is one of the earliest fine stone houses in Clarke. The following features are designated as being of architectural value: Exterior: - the T shape construction the verandah and gingerbread trim of the south wing the original bargeboard, lightning rods, finials and pendants the Cross and Bible front door with its rectangular sidelights and three part transom the three-segmented bay window at the north wing the nine-segmented pointed arch window in the south gable the original stone voussoirs Interior - the wood trim and pine floors the casings around the 18"window recesses - the kitchen's eight original doors and four foot high wainscoting the iron and ceramic hardware - the plaster work the ceiling and cornices of the north wing the original brass valance of the bay window SCBEDULE 'B" TO BY-LAW #92-232 ALL AND SINGULAR that certain parcel on tract of land and premises situate, lying and being in the Town of Newcastle, in the Regional Municipality f Durham (formerly int he Township of Clarke in the County of Durham) and being composed of part of Lot 21, in the Sixth Concession of the Geographic Township of Clarke, now designated as Part 3 on Plan 10R--1000 registered at the Registry Office for the Registry Division of Newcastle (No. 10) .
