THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW 192- 22 Being a By-Law to authorize the execution of an offer to Lease Agreement with Oswenda Investments Limited in respect of a lease agreement for premises situated at 143 Duke Street, Bawmanville (Tourist Information Centre) THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS: That the Mayor and the Clerk are hereby authorized to execute, on behalf of the Corporation of the Town of Newcastle, and seal with the Corporate Seal, an offer to Lease Agreement between Oswenda Investments Limited and said Corporation, which is attached hereto and marked Schedule "B". By-Law 92-22 SCHEDULE "B" LEASE RENEWAL AGREEMENT THIS AGREEMENT dated as of the First day of May, 1990 BETWEEN: Oswenda Investments Limited (hereinafter called the "Landlord") PARTY OF THE FIRST PART and The Corporation of the Town of Newcastle (hereinafter called the "Tenant") PARTY OF THE SECOND PART RECITALS: A. By a Lease dated the First day of May, 1990, the Tenant leased from the Landlord for and during the term (the "Term") of one year & eight months, commencing on the 1st day of May, 1990, and expiring on the 31st day of December, 1991 certain premises (the "Leased Premises"), known as the gas station office located at the Flying Dutchman Hotel, 143 Duke street, Bowmanville in the Province of Ontario; and B. The Landlord and Tenant have agreed to renew the Lease for a further three (3) years in accordance with the terms and conditions as the lease dated May 1st, 1990 and with an increase of $25.00 per month, per annum, as outlined below: YEAR ONE: January 1992-December 31, 1992 - $275.00 per month YEAR TWO: January 1993-December 31, 1993 - $300.00 per month YEAR THREE: January 1994-December 31, 1994 - $325.00 per month 718 ~ > . By-Law 92-22 . ~ PAGE TWO The consideration for this Agreement is the mutual covenants and agreements between the Parties and the sum of One Dollar ($1.00) that has been paid by each of the Parties to the other, and the receipt and sufficiency of which is acknowledged, and the Parties hereto agree as follows: 1. The foregoing Recitals are true in substance and in fact. 2. This Agreement shall enure to the benefit and be binding on the Parties hereto and their respective successors and assigns. 3. The Landlord hereby consents to the said extension. IN WITNESS WHEREOF the Landlord has duly executed this Agreement at Rexdale this day of, 199 .
