HomeMy WebLinkAbout92-148 DN: C6-8.BYL THE CORPORATION OF THE TOWN OF NEWCASTLE BY-LAW NUMBER 92 -148 being a By-law to amend By-law 84-63, the Comprehensive Zoning By-law for the Corporation of the Town of Newcastle. WHEREAS the Council of the Corporation of the Town of Newcastle deems it advisable to amend By-law 84-63, as amended, of the Corporation of the Town of Newcastle in accordance with application DEV 88-060 to permit a Motor Vehicle Service Station, Motor Vehicle Body Shop and Motor Vehicle Sales Establishment. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Town of Newcastle enacts as follows: 1. Section 21.1 "Service Station Commercial (C6)" zone is hereby amended by adding thereto the following new Special Exception 21.4.8 as follows: "21.4.8 SERVICE STATION COMMERCIAL EXCEPTION (C6-8) ZONE Notwithstanding Section 21.1 and 21.3, the lands zoned C6-8 on the attached Schedules to this By-law, may only be used for a Motor Vehicle Service Station, Motor Vehicle Body Shop and Motor Vehicle Sales Establishment and shall only be used in accordance with the following regulations: a) Lot Area (minimum) b) Lot Frontage (minimum) c) Yard Requirements (minimum) Front Yard Interior Side Yard Rear Yard 3.5 ha 197 m 9 metres 20 m 150 m 2. Schedule "7" to By-law 84-63 as amended, is hereby further amended by changing the zone designation from: "Service Station Commercial (C6)" to "Service Station Commercial Exception (C6-8)" Zone as shown on the attached Schedule "A" hereto. 3. Schedule "A" attached hereto shall form part of this By-law. 4. This By-law shall come into effect on the date of the passing hereof, subject to the provisions of Section 34 of the Planning Act. BY-LAW read a first time this 8th day of June 1992. BY-LAW read a second time this 8th day of June 1992. BY-LAW read a third time and finally passed this 8th day of June 1992.
