THE CORPORATION OF THE TOWN OF NEWCASTLE BY -LAW 85- 85 being a by-law to establish the composition of the Newcastle Public Library Board WHEREAS Section 9(1) of the Public Libraries Act, 1984, provides that a public library board for a municipality whose population is less than 100,000 shall be composed of at least five (5) and no more than nine (9) members appointed by the Municipal Council. AND WHEREAS Section 9(3) of the Public Libraries Act, 1984, provides in the case of a publiC library board whose population is 10,000 or more, school boards with jurisdiction in the municipality shall be represented on the public library board in the following manner: Two Members of the public library board shall be persons recommended by the board of education and one member shall be a person recommended by the separate school board. NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE ENACTS AS FOLLOWS: 1. THAT the Newcastle Public Library Board shall be composed of nine (9) members; 2. THAT the publiC school board shall recommend to Council the names of two (2) persons to be appointed to represent the publiC school board; 3. THAT the separate school board shall recommend to Council the name of one (1) person to be appointed to represent the separate school board; 4. THAT Council shall appoint one of its members to serve on the Newcastle Public Library Board; 4. THAT the remaining five (5) appointments be filled by residents of the municipality who are qualified to be appointed and who have submitted applications seeking appointment pursuant to the publication of a public notice of Vacancies on the board published by the Clerk of the Town of Newcastle; 6. THAT the term of appointment shall be for a term concurrent with the term of the appointing Council, and that the appointments shall be made at the first meeting of Council in each term or, not later than its next regular meeting. 7. THAT pursuant to Section 14(2) of the PUblic Libraries Act, 1984, the first meeting of the Board in a new term shall be called by the Chief Executive Officer of the Board appointed under Subsection 15(2) of the said Act. THAT pursuant to Section 24(1) of the Public Libraries Act, 1984, the Newcastle Public Library Board shall submit to the appointing Council, on or before the 20th day of January in each year, the Board's current budget, containing an "Qperating Budget" and a "Capital Budget."
