THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 82- 37
. being a By-law to amend By-law 81-125 of the Town of Newcastle.
WHEREAS on the 21st day of September 1981, the Council of the
Corporation of the Town of Newcastle passed By-law 81-125;
AND WHEREAS the purpose of By-law 81-125 was to amend Restricted Area
By-law 2111, as amended, of the former Township of Darlington to
define areas and establish zone provisions to control the development
of Special Purpose Commercial Nodes, in conformity with the Durham
Regional and Darlington Official Plans;

AND WHEREAS, in light of certain comments and objections received,
Council now deems it desirable to amend By-law 81-125;
NOW THEREFORE, the Council of the Corporation of the Town of
Newcastle enacts as follows:
1. Section 1 of By-law 81-125 is hereby amended by deleting
Subsections (i) a}, e), f) and i), and by adjusting the numbering of
the remaining Subsections accordingly.
2. Section 1 of By-law 81-125 is hereby amended by deleting
Subsection (ii) b), and by deleting from Subsection (ii) e), the word
"tavern", and by further amendi ng thi s Subsection by adjusti ng the
numbering of the remaining Subsections accordingly.

3. Section 1 of By-law 81-125 is hereby amended by deleting from
Subsection (iii) j} i) the letter "b)".
4. Section 1 of By-law 81-125 is hereby amended by deleting from
Subsection (iii) j} iii} entitled "Tavern and Take-out Restaurant"
the words "Tavern and II .

5. Section 1 of By-law 81-125 is hereby amended by deleting from
Subsection (iii) k} i} the words "With the exception of ingress and
. egress provided in association with a motor vehicle service station
or a motor vehicle gasoline bar", and by capitalizing the word "all",
and, by further del eti ng the word "other".
6. Section 1 of By-law 81-125 is hereby amended by deleting from
Subsection (iii) k) ii) the words "other than a motor vehicle service
station or motor vehicle gasoline bar".
7. Section 1 of By-law 81-125 is hereby amended by adding to
Subsection l(dd)(iii) a further Subsection, p) as follows:
"l(dd}(iii}p} Development or redevelopment of lands subject
to this "SPECIAL PROVISION" may only proceed if
fully serviced by municipal water and sewage
systems. "
8. Section 1 of By-law 81-125 is hereby amended by deleting
Subsection (iv) entitled "Other Permitted Uses" in its entirety.

9. This By-law shall come into effect on the date hereof, subject
to the provisions of Section 35(10) of the Planning Act, R.S.O.,
1970.

By-law read a third time and finally passed this 29th day of
March 1982
