HomeMy WebLinkAbout2017-010 THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2017-010 Being a by-law to repeal Interim Control By-law 2016-056 WHEREAS on June 13, 2016, Council directed staff to undertake a study of the land use planning polices in the Glenview Neighbourhood in Courtice (as shown in Figure 1 of Report PSD-044-16) and report back to Council on the results of the study; WHEREAS on June 13, 2016 the Municipality passed Interim Control By-law 2016-156 pursuant to section 38 of the Planning Act, R.S.O. 1990, c.P.13 in relation to the Glenview Neighbourhood; WHEREAS Holland Homes and Katalin and Sandor Kis (the "Appellants") appealed Interim Control By-law 2016-156 to the Ontario Municipal Board; WHEREAS staff undertook the necessary study and recommended amendments to Comprehensive Zoning By-law 84-63 through Report PSD-072-16 to implement the findings of such study; WHEREAS on December 12, 2016, Council approved the Zoning By-law 2016-098 which amended certain sections of By-law 84-63 as they applied to portions of the Glenview Neighbourhood, and notice of such approval was given in accordance with the requirements of the Planning Act; WHEREAS no appeals were filed in relation to Zoning By-law 2016-098; WHEREAS because By-law 2016-098 is in full force and effect, the Appellants have withdrawn their appeals of Interim Control By-law 2016-156. NOW THEREFORE BE IT RESOLVED THAT the Council of the Corporation of the Municipality of Clarington enacts as follows: 1. Interim Control By-law 2016-056 is repealed. 2.
